The jury will not see this testimony. JG already excluded it.

Proffered on the record only for purposes of requesting an appeal, testimony will not make it to this jury.

Absolutely. I'm just cutting off the discussion others were having that said "Oh, CPD or neighbors couldn't have hacked it, because it was coming through the VPN."

I was just talking to my husband about this. (He has Cisco VPN). I asked him if BC was already on the computer through VPN and since the computer was left on, that is how they could have messed with files through VPN. (he said, sure).
Also, there is VPN software that could be installed on another computer. But there is no reason he would have needed to be on the VPN to get to any files on the computer. He could have just went straight to the computer, outside of the VPN.

This is better than a State/UNC/Duke/Wake free-for-all game at the Dome or Cameron.

state saying they are prejudiced by the guy (and to a degree they are) but yet they apparently soon want to introduce new technical evidence. Going to be sticky!

Kurtz should remind the judge that this witness explained the expertise of JW and why he should be allowed to talk about the files...then allow JW to be recalled.

I will say Nancy Coopers little girls appeared to be very well-behavied in the shopping cart, while she was checking out. What a sad sight to see. the last time they would ever be out with their mom.

This might all be moot considering the state of the jury.

I say, let the guy in after the router evidence gets testified to..as maybe it does show exactly who accessed the computer via VPN.... And this witness hasnt even completed his report yet..so bottomline maybe his FINAL anaysis may end up either proving Pros. or Def. side of things....
Just as aside.I liked this witness..he did come across very affable!! pleasant and forthcoming.... Yikes, whole line of typing got missed...Regarding the Cisco coming in late in the game regarding the router...Who found it??Wonder who left it there?...Geesh, I wish Cisco had a better controls of tracking their gear!!
