BBM: If I were on a jury and the defense used this logic as to why she sould be found not guilty or that there should be little, if any award of damages - this would backfire BIG TIME with me!
This is basically saying that ZG's life is less valuable than someone who had more money, a better job, a better place to live or a different circle of friends.
I believe that ANYONE can be slandered/defamed. Well, maybe Manson, FCA, Bundy, Dahmer, etc...IMO those kinds of people couldn't be slandered/defamed.
A single mother who is looking for a job and a new place to live...yes, she can be slandered/defamed.

I couldn't agree more! Even if ZG has a terrible reputation that the whole world knew about, FCA, CA and FCA's lawyer's have no right to add to that reputation by smearing and certainly for laying out what reputation she does have for all the world to see. IMO of course.

I distinctly recall that, at the time (in 2008), when this whole issue came up, someone here at WS was in touch with ZG. She wasn't in a good place in her life and what happened with this case made it worse. IIRC, she and her children were receiving death threats and were thoroughtly harassed to the point "we" who were posting at the time urged her to find an attorney. Well, she certainly did.
When you have nothing, your reputation is all you have. I don't know what sort of reputation she had at the time, but her experience with FCA certainly didn't improve her lot in life.
I searched for a link to the thread where this was discussed and can't find it. It's possible that, because of comments made about her, it was pulled. I did find this thread which went nowhere in September, 2008. I am not a very good sleuth at finding 3-year-old posts, but I remember it all like it was yesterday.
Zenaida wants her day in court; regardless of the outcome, she will get it (or so it seems for the time being.)

I know, I know, so many names were being thrown out there like bait, but the name was used on the 911 tape 1st, and I know OCA used to hang out at Sawgrass prior, but who actually got that name, who went to the lengths to use this paticular name? Or was it just another combined effort? I still think the 31 days was in some way to get ducks in a row to confuse the masses. In my own life, if the little butterball isn't visiting, we call each other at least once a week, but I think to myself if they had lived here and I was pretty much the sole provider of my granddaughters care, you best believe I'd be making a call to authorities with-in a week if a story didn't wash as to their whereabouts or if I did either talk to my grandaughter or at least heard her in the background. I also know as sure as the sun comes up, if I had a daughter who couldn't be trusted, I sure would not put my neck out there and sway myself to believe my daughter had a job and a babysitter/nanny when I know I was always the babysitter and always supported the family, kwim?

Everything seems so much clearer now. CA smugly admits to prepping in advance to this, showing off by reciting pages numbers and dates, so perhaps she had it in her mind what M & M's end game was, and she just had to show them up. CA's big mouth, like she knows more than seasoned attorneys in this instance - even her own. Mr. Conway's advice to CA was "STOP" over and over, and she still had to run her mouth. If she had just stuck with her instructed yes or no answers...what a fool, she ended up putty in their hands.

Gawd,,, that total farce on their part still makes me laugh while shaking my head in utter disbelief; how CA (and GA as well)thought she'd get the one upmanship on this Depo. The best part was when M&M showed CA her MS page-funny! I sometimes feel that all this Foundation stuff in part was to not only get off the hook with creditors at the time, but forseeing all these outlandish things that were blantantly said would from shield them from anybody suiing them that unfortunately crossed their paths that they percieved as offensive-gave them free reign to flap their traps while being protected from a lawsuit. This is why I think we do not see a combined lawsuit against not only OCA but her parents as well. While I do support the efforts of TES and the others, I still hold out hope that they all will be victorious with their cases, it is 1 way to stop OCA in her tracks from trying to profit by a book-nobody is interested, an interview-nobody is interested; besides, I'm sure she is well aware any money she makes in the future(questionable)will be subject to a lien for a long time to come. Good.
Now I need to ask an attorney in here a Q. If there is a judgement/lien on her and she marries after the fact, is the lien still active or is it closed? tia.

Totally agree princesspjs. It wouldn't even matter to me if she had been a crack head street walker. She is a human being who has feelings unlike any of the Anthony's. Futher more the felon was no better then ZG, as a matter of fact IMO she was way worse then ZG. I'll bet ZG can tell you what the name of each one of her childrens fathers are and the felon can't even tell you 1 name of who Caylee's dad is/was. I realize ZG may not get much from this law suit but I can have my dreams that she would put the felon in the poor house for the rest of her life. I also feel it is a crying shame that at least Cindy isn't included in these law suits.

The thanks button was way too little to thank you for slogging through that mish-mash. Someday, I may revisit the case in depth, I have two file-boxes full of documents which are stored in the basement!
It will soon be a year since the trial started, and I haven't gotten my life totally back on track yet. I blogged under my pen name for nearly three years and put my life on the back-burner. I'm nowhere near catching up on getting my garden and house back together. It's also been nice to spend time with my friends and family who indulged me in my journey.

Me either CarolinaMoon - I was thinking last night about how much time I actually spent online here at WS during the hearings, the doc dumps, the jury selection and the trial and now just shake my head in awe because it totally consumed my life for months and I do mean consumed. I guess that's why I haven't jumped into any other crime searches and trials. It was worth it for Caylee but not sure I could do it again - and it still feels like there is much unfinished business here in these threads.
But back to M&M and CA in particular. Mr. Morgan knew if he could get Cindy angry and keep her angry she wouldn't be able to stop herself from telling a version at least of the truth. And she is far too arrogant to see what he was doing.
They say if you want to win an argument, never never lose your temper! Ha ha on you Cindy!!! Morgan wins.

When this case gets going, I wonder how far M&M went on a diggin expedition before, during and after the fact and what kinds of information is going to come up maybe per their PI? I just now thought of the many various possibilities that there is going to be much more to this trial than the other only because I have a feeling a lot more stuff has been documented, quietly investigated, right down to the foundation money. Lots of possibilities there to be righty questioned and hopefully, rightfully answered...well, rightfully brought to light.

Casey's physical description of ZFG, the age and other details that she gave, were different from this woman. But the police found that this woman with a very similar name had visited those apartments on the date, which was quite a coincidence, so of course they took an interest.

I'm sorry I don't have a link to it. I remember hearing her say that in a couple of interviews with national media. One might have been with JVM and one might have been some morning news program.....I'm sorry I'm not more help.

That's true about there being other ZG's ("Zanny" G's and Zenaida G's) in the area...there were others.... (according to property records, phone records, various public records online, etc)...I remember one of them was much more in line with Casey's description, a former event planner, grad of the hospitality school at the university (event planning, same school mentioned by JG remember? Rosen school of hospitality or whatever it was) much more the right age, look, and better match to other details (Search under Zan G. ). I think Ricardo had a Zan in his phone too if I remember correctly, or maybe a Xan... I guess they must have checked those out to make sure they weren't "Zanny". Or maybe not lol.

one of the times I heard her say that was in an interview pretty near the end of the case, could even have been with Vinnie P....... (?)..... If I find a link I will post for you (I just saw it on TV though.)  I remember being surprised that her lawyer would let her still be saying that at that late date, I mean they had to be in possession of Casey's police statement....(?)

easy for her to say AFTER the arrest of FCA. It is the time period where any and all news was of the Zenaida nanny at large that is important.. in my view.

Haven't we been through what this defamation suit is all about? No one in the LE expected the description FCA gave them of ZG to be an accurate one - after they interviewed her on the first night and found that everything -bar none- she told them was all lies. Obviously LE would have been fools to follow her statement, which led them to start interviewing ZG close by, and in particular, one who had been to Sawgrass apartments.
Then we have more lies with what FCA told or didn't tell her mother, who she knew was going out to make media appearances.
And bottom line - this is a defendent who claimed all along - for three long years - that her daughter had been kidnapped. Which allowed the taint to stay on ZG, Roy Kronk and a few others - only to pop up at a trial and whoops- Caylee apparently drowned.
Right there to me seems like defamation. Allowing someone's name to be tied to your case even by mistake for three years? When you know perfectly well this person is a stranger? Yet you go so far as to allow this person to bring a case against you - and never get around to admitting ZG was just one more figment of your imagination?
And around and around the track we go....again and again...

Yep, lots of words were thrown out there, lots of people were blamed in 1 way or another for this crime and at the last minute Surprise, take it all back, Caylee drowned...ahhh, NO. They can't keep throwing bricks and hiding their hands over and over again or hide behind 10000 more excuses or more lies. The coulda, woulda, shoulda dance has ended as far as I'm concerned. They said it, it's done, move on and now face the music. That's it.
May I add, unless it's another slick manuver, I've often wondered just why OCA has not filed something against 1 or both her parents. Pretty strange if you ask me-I mean considering what was flung far and wide at trial and supposedly prior to all this.

Bottom Line. if you lie in the course of committing a crime by implicating someone else, real or fiction, you should suffer the consequences.

BBM. Exactly right on all accounts especially the last part! I always thought it odd she never called 911 herself from JB Park, let alone frrom Sawgrass-2 separate stories taking place on 2 separate days-1 involving just dropping off Caylee, the other was a supposed grab and run. And where oh where is that demanding note she spoke about Zanny handing her at the park? Never did see that!
Something else that has always nagged at me-This physical description which in all honesty did sound like that other woman's (RC)description. I never nailed it down myself, and I'm not going on what RC said about meeting up with GA at a donaton site, but just when did this description of ZG happen and more importantly just when did RC get into the picture? I'd like to know if she had innocently hung out around Suburban with the rest of the crowds before actually getting invovled in this and Ta Da, that's where the description came from-because someone in the home peeked out the window and tagged her or took a combinaton of what people looked like. kwim?
You are exactly right about implicating people. Something along those lines happened in my neighborhood not to long ago. A neighbor from 3 short blocks down had the cops called on their entire family 5 times in 1 week by a neighbor of theirs who apparently likes to stir pots and crank call the police; making up false stories about his neighbors. The last time his guy called the cops on these people, they got manhandled, a pregnant young woman thrown on the ground, her father threatened with being tazered, her boyfriend was arrested because he touched the cuff of the officers' shirt when he saw his pregnant Gfriend being thrown to the ground and yelled she was pregnant, an innocent boy was walking by when the pd rolled in and he was commanded to get on the ground and was cuffed and taken back to these people's house and he didn't even live there!--so yes, be very careful of implicating innocent persons-the repercussions could be tantamount.

Yes, to all of the above. It is just laughable when comments say there is no case here for Zenaida against FCA because FCA said...whatever!
Someone give me an example of when FCA told the truth about anything - anything at all - anyone? How can her lawyers go into court with an attitude saying indignantly that FCA didn't describe Zenaida? What part of that makes any sense at all?
This woman told lie after lie after lie! Backed into a corner she admits she lied and then tells another lie. So we are supposed to assume FCA meant no reference to Zenaida because Morgan and Morgan aren't using the right lies in this case? It makes me wonder if the legal world has gone completely off their rockers...

My memory is fading fast, but I think some of the other players ("Zanny's" sister, or mother, or roommate or some other children) in FKC's fantasy had names similar or identical to ZG's children. Also "Zanny's" car looked a lot like ZG's. Although I saw that on Nancy Grace so it may or may not be entirely true.

It seems I heard something to the effect of Florida law on defamation that you have to knowingly hurt the person in order to claim defamation. So just picking ZG out of the air or via that card at the Sawgrass is not enough to say she was intentionally hurt. ? Does anyone know.??? I thought the case would be tossed on these grounds?
