trial thread: 3/28/2012

New thread for a new day. Please remember the rules

When posting an opinion please remember to use IMO or JMO.

the crown will present its case in chapters:

Chapter 1: The day of the kidnapping. The surveillance video showing Rafferty driving up the street outside Tori's school and McClintic walking Tori up the street. Witnesses from and around Oliver Stephens public school will talk about seeing Tori.
An identification officer will use photographs and maps to show the route from Woodstock to Guelph.
Tori's mother, Tara McDonald, will testify about the frantic hours the family spent looking for Tori.

Chapter 2: Terri-Lynne McClintic. "She was an essential part of all that happened," Gowdey said. "I expect her credibility will be a major issue in this case."

Chapter 3: Guelph -- video surveillance and bank records detailing the events there.

Chapter 4: the Mount Forest death scene, which the jury will visit. "It will be difficult to go to the very place where this happened, I know that, but understanding the crime scene is crucial to understanding the crime," Gowdey said. Photographs, some of them graphic, will be used to explain "exactly how the killing happened."
"Unfortunately it is only through them that you can fully understand (the) evidence," Gowdey said.

Chapter 5: Police interaction with Rafferty.

Chapter 6: The searches of Rafferty and McClintic's residences and the evidence found.

Chapter 7: The Honda Civic. What was found inside.

Chapter 8: Rafferty's connection to the Mount Forest area.

Chapter 9: Comments Rafferty made to friends after April 8. "He had some interesting things to say to other people about Terri-Lynne McClintic and about the kidnapping itself," Gowdey said.

Chapter 10: The May 15 weekend and Rafferty's actions.

Chapter 11: The BlackBerry. The BlackBerry allowed police to track his movements April 8 and after.

Chapter 12: A recap of the surveillance video.

Salem's warning from last week:
Okay everybody - LISTEN UP! We are not bashing, accusing or blaming Tori's family here. It won't be allowed.
Children walk home from school every day without incident. Parents are not perfect, it's just not possible. Tori's parents DID NOT do this to her. TLM and an accomplice DID. That is where the blame goes.
We had a lot of family bashing in the early parts of this investigation after Tori went missing and a lot of baseless accusations - NONE OF WHICH PROVED TO BE TRUE. Victim and family bashing will not be allowed during this trial.
Thank you,
Salem

-The first witness the Crown will call in this phase of its 12-part case is OPP Detective Sergeant Jim Smyth. The officer is already known to jurors.

-After Smyth, Identification Constable Gary Scoyne will take the stand for the third time in this trial. If his latest tesimony is anything like his previous two stints on the stand he'll likely give a brief, chronological summary of the latest evidence before the court.

Wednesday marks the start of "Chapter Four," which will deal with the alleged events and evidence from the crime scene near Mount Forest. It promises to take significantly longer, although its first day will be a short one.

Quote:
LONDON, Ont. — The trial of a man accused of killing eight-year-old Victoria Stafford is expected to hear testimony today about happenings in the area of Mount Forest, Ont.

Tori's remains were found partially clothed in a field near Mount Forest more than 100 days after she went missing April 8, 2009.

The jurors will be going to the crime scene but not today. I'm not sure when they will be going but I suppose it will be announced. JMO

It would just makes sense that they use their time wisely and either go today when they are done court since it is only half day or tomorrow when they can't use the court room because of scheduling issues.

Will we find out from the autopsy whether or not Tori's head injury's were caused by only the hammer or is it possible her death could have been caused by the boulder's thrown on her while in the garbage bag. Is it even possible without having had a doctor at the scene after which event she passed? Or can autopsy tell this... large rock or hammer. IMO Can they get DNA from the rocks..who threw which rock? IMO I think rocks that big are boulders...at least in my garden. IMO

Respectfully, I don't think that it matters which of the events caused little Tori's death. It was stated by the Crown at the beginning of the trial that it didn't matter who wielded the hammer - there was evidence of broken ribs and damage to the liver that were enough to cause her death. There is no doubt that MR is going to be found guilty of something... Just weather or not there is enough evidence to find him guilty of 1st degree Murder ( as he is charged ) or something lesser. IMO

Thankful little Tori was recovered with great dignity and respect by all Law Enforcement, and her journey out of Mt. Forest, was not the same as her journey there.

Mike Knoll: Here's a quick hit from LFP reporter Randy Richmond:

A short day of testimony is expected in the first-degree murder trial of Michael Rafferty Wednesday.
The Crown's case is moving to a new and intense chapter, the scene near Mount Forest where Victoria Stafford died, but will start slowly Wednesday with two witnesses on the stand.

The jury will get Thursday off and resume sitting Friday.
The Mount Forest chapter is to include autopsy results and the jury's visit to the remote laneway where Tori's body was found more than two months after her April 8, 2009 disappearance.

Rafferty, 31, is charged with murder, kidnapping and sexual assault causing bodily harm in the death of the eight-year old Woodstock girl.

http://www.lfpress.com/news/london/r.../19559436.html

Prayers for Tori's family and all of us who love her like she's our own little princess. God give us all strength to endure this testimony. It will be heartbreaking to follow but we have to do it for Tori.

They may have needed a day or two before they hear the autopsy reports. This is going to be heart wrenching. After TLM first testified to what happened I was blown away for days.
