Omg this is insane, I cannot believe this, oh why oh why did they have a faulty warrant. There is no doubt in my mind he is guilty on all. I hope the jury comes back with the right verdict, my gawd I'm shaking. This is how come we did not hear anything about what was found on his laptop. Wow can't deny Derstine did a good job on getting evidence dismissed.

For three months leading to the murder of Victoria 'Tori' Stafford, Michael Rafferty searched the Internet for 'underage rape, real underage rape, real underage rape pictures, pre-teen nude, pre-teen model galleries and nude pre-teen.'

He also accessed a 'how-to-guide' on raping children and dozens of child pornography videos, including some featuring incest and one purporting to be a "snuff movie" involving a child.

On March 28, 2009, 10 days before the kidnapping, Rafferty watched a movie about a man using a story about his lost dog to abduct a blonde, eight-year-old girl walking home alone after school. She is taken away in the man's car and forced later to perform sexual acts.

On April 23, 2009, after the kidnapping, he downloaded a movie about Karla Homolka.

I knew it! I knew this was a Bernardo/Homolka copycat! There was no doubt in my mind.

I'm shaking with anger right now. The jury had to know about this!!

But none of his disturbing Internet activity could be considered as evidence that Rafferty wanted or planned to rape eight-year-old Tori, largely because it was found under a faulty OPP search warrant.

From Blatchford, they tried:

At one point during that argument, prosecutor Michael Carnegie snapped, “We always talk of the faith we have in the jury system [yet] we always seem to ignore it whenever we have evidentiary applications.”

Let's not go there. MR's mom is NOT responsible here, she is not on trial, there is no reason to be discussing her at this point.

Thanks,

Salem

From Blatchford, http://fullhttp://fullcomment.nation...erty-evidence/

Yet throughout the nine weeks of the trial, as even police witnesses sometimes grew tearful in the stand and journalists snuffled, the jurors maintained their composure and gravity, as jurors before them almost always have done.
‘The jurors were tougher, smarter and more resilient than the system credited’

None of them swooned.

No one gasped in horror.

Not a one ever put up a hand, asking for a break.

As ever, the jurors were tougher, smarter and more resilient than the system credited. They deserved more than the judicial equivalent of a pat on the head.

Odds are, in the words famously uttered by the actor Jack Nicholson in the movie A Few Good Men, they could even have handled the truth.

City TV Reported that there was an OPP video (which we didn't see and the jury didn't see) The interogator likened him to Paul Bernardo at which point Rafferty gagged and hyperventilated.

IMO a jury has the right to hear everything that pertains to evidence. How can we expect a fair trial for the victim and their family when we omit things due to human error?

I will never understand this.

I wasn't downing his mother. I was just thinking she must feel awful knowing now because i am sure she didn't know about the laptop when she said her son was innocent. Again i was not trying to be rude in any way towards his mother.

"No remorse. No empathy. No nothing. You're just hollow," Smyth tells him.

"You know what a psychopath is, Mike?" Smyth says at another point.

"I have never met one," Rafferty says.

"Well, I just met one tonight. It's you."

After everything we've heard, this is too much to bear. Our justice system.

I'm going to go for a long walk, and then I'll pour a large drink. Where is everyone? Are you all doing the same?

I'm crunching on my salt-free tortilla like a maniac, that's what I'm doing. That jury better come back with First Degree Murder and nothing less--if they don't when they get home and get to hear what we just heard they will regret it forever. MOO!
