Jason Jay Midyette, 10 weeks, Murdered 2/2006

yes, this is a new thread, don't be thrown by the date in the subject line....

Jason Jay Midyette was brought into an ER in Boulder in February, 2006. He never did wake, and was taken off life-support a week later.

Monday, July 24, 2006, the Boulder County Coroner, Thomas Faure, declared Midyette's death a homicide.

Rocky Mountain News article, published July 25th, 2006.

The child of a wealthy family, in Boulder, now definitely a murder victim, and no one is saying it outright, but they're definitely wondering about the parents. I've submitted an article to the Crime Library about this one, don't know when it will be up.

Parents:

Alex Midyette, age 26
Molly (Bowers) Midyette, age 27

Grandfather:

Boulder architect and property owner, J. Nold Midyette. He owns the east half of the Pearl Street mall, a locale familiar to anyone who has ever read in-depth about the JonBenet Ramsey murder.

It sounds like the baby was being beaten/abused almost from the time he took his first breath.It also sounds like someone didn't like the sound of a baby crying and acted upon it.

The mental health history of all surrounding this child should be under intense scrutiny.

I hope whomever is responsible for the death of this child is brought to justice. A perfect example of how child abuse is widespread - With all their money, wonder if they had a nanny?

I've been doing some more reading on this. Below is a partial timeline:


Feb. 24, 2006, 12:40 p.m. One of Jason Jay "J.J." Midyette's parents calls their family doctor, but since the office is closed for lunch, the parent leaves a message stating that the 9-week-old is "not himself." After consulting with the doctor, a nurse calls back, saying if Jason continues to act that way to take him to the emergency room or if he seemed to be doing better to bring him into their office at 3:30 p.m.

3:30 p.m. Alex and Molly Midyette show up with Jason for the appointment. The doctor later tells police she was "scared" by his grave condition and sent them to the emergency room. http://tinyurl.com/f7law

So the parents wait...approximately 2-3 hours for the appointment. Also, from what I've read the injuries were closed injuries, in different stages of healing...supposedly no outward bruising...fractures in his feet, ribs, etc...

I am really angry that it has taken this long to rule the death a homicide. And I'm even more angry that there hasn't been an arrest. Who else could have done this but the parents?

This seems to be another case of "money talks". I would venture to say that if these parents were not from an influential family, they would already be in jail. I would also guess that this is why they had four consultants working on the autopsy. It makes me so angry that justice is slow for those with money, and it sometimes never comes.

Can I say that the DA doesn't give me a confidence vote. Should people move out of Boulder? I would. This is way beyond prejudicial this is criminal.

I dug this story out of the back pages because I saw Seamus McGraw on TV over the weekend (can't remember if it was NG or The Lineup... or elsewhere) and he was talking about this case. There were two other infants that had died due to abuse since little Jason. Mary Lacy was ALL OVER THEM. She prosecuted them quickly. They were pretty poor. Now these people, they're not poor by any stretch. Is Mary Lacy intimidated?

If I read it correctly, the other people who were arrested for the deaths of the 2 infants that died before Jason did not hire attorneys and admitted their role in the babies' deaths.

Jason's parents, on the other hand, have hired high powered attorneys and are NOT cooperating with the investigation. However, this child died way back on March 3rd, 2006. That's over 7 months ago!! Why on earth would Lacy be taking so long to charge these parents?????

It's been clear from the get-go that the child had obviously been chronically abused, because he had bones that had been broken before and were still healing. Jason was only 10 weeks old, and this little baby had a total of 27 broken bones in different stages of healing. He never had a day in his little life without pain!

The story indicates that the DA has established that the parents were the only caretakers of this child. There was no nanny, no babysitters, etc... Apparently, the parents aren't pointing any fingers to any other possible suspects, either. Shouldn't this be an "open and shut" case????? I'm ANGRY as h*ll about this! What is the hold up, Mary?

You rock MsSheila! You bet she's corrupt, just as...

...Alex Hunter was before her...These people don't prosecute those with money like the Ramseys...Whether they're actually taking money or favors from those who are wealthy and connected with criminal cases, or whether they just choose to back away from the folks in these cases because of "social standing"...it's corruption, and they are full of it...

Imagine if the Ramsey case occurred in a trailer park, for example...You don't think the parents wouldn't have been arrested almost immedately??

The Boulder DA's office smells worse than a pile of dead fish in the summer sun, if you ask me...

Does anyone remember holding their little newborns? Remember how tiny they were? How anyone could intentionally hurt a little one like that is way beyond anything I'll ever understand.

I went to college with a girl who had a bone disease. Every bone in her body had been broken except 2 or 3, according to her review of early childhood. I wonder if ML was waiting on autopsy reports to determine if there was evidence of a rare bone disease and that this could have caused some of the delay.
Also, with the fiasco created over the JBR case from its beginning in 1996, I wonder if BLE and DA's office was unsure of who to charge (mother, or father, or both, etc) in what could very well become yet another "high profile" case. BLE makes my head want to explode!

It was already determined that there was no bone disease. According to this article, it took 5 full months to get the autopsy results. I assume part of the reason for that was to look for any bone abnormalities. Here's some info from the article I'm looking at.

The coroner's findings came nearly five months after the child's death. During that time, Faure consulted with four specialists or outside laboratories on various aspects of the autopsy results:

Dr. Ross Reichard, with the medical investigator's office at the University of New Mexico, did a neuropathologic examination of the boy's brain. He reported finding "traumatic injuries of varying ages."

Dr. Peter Bullough of the Hospital for Special Surgery, an affiliate of Cornell University, found evidence of healing fractures that would fit a time frame of about 2-3 weeks prior to the child's death.

Mods- is there any way to change the title of this thread to reflect the fact that it involves Mary Lacy and a dead baby who's parent's she has not yet charged.... 7 months after the death? And the date on the title is incorrect. Jason died in March of 06

Who do I need to write to to call for Mary's job? Enough is enough. She surely knows or at least suspects that the talking heads on legal shows will be all over this? Maybe I should start campaigning them if they haven't already covered it.

Hi Brefie- I don't know who you have to get ahold of, but if you want to write a letter- I sure as heck will too. And the media (aside from what looks to be the Boulder newspaper) is not covering this at all.
