Wow, I am just walking into this thread but I have read the entire thing. First, Mike let me tell you how sorry I am that you are going through this. I won't make my typical Illinois is "lazy" comments about the their government. I am a native.
I believe my cousin is a police officer in Berwyn - let me find out. He is a 3rd cousin. I know he went through Chicago's academy with my ex roomate years ago.
I used to work for a private defense firm in Des Plaines, IL - I know the surveillance work is a little slow probably due to the work comp laws and aribitraitor issues Illinois is currently having. -- I can discuss the details about this in a PM - but what I am thinking is if your lawsuit is filed, you could try to promise them some type of payment/cut from that - if it works. I don't fare well with my ex boss, but he is REALLY good at what he does. Just a thought.

I didn't see dates on the myspace photos. Is the one of Emily in the yellow outfit a modeling pic or was she taking a class of some type? And was it one that was sent to you after she left?

Thank you. Well I haven't been on lately, Just been busy. I talked to a lawyer (Jeffery Leving) he is a real good lawyer and said he will take the case. However he wants 10,000 to start. I also talked to the police and the reason the D.A Wont put criminal charges against Nigia is becasue the alligations that she put on the letter. I think that is crap, they are going by something that they have no proof on. These are the alligations that she put.
1. You have threatened to deport me (True)
2. You have threatened to kill my family (Fulse)
3. You have a history of abuse (Fulse)
4. You have a criminal record. (Fulse, I was arrested once in my life, I was never convicted of the crime nor did i plea to anything. Case was dropped.
None of that is true. So I don't know what to do

Nice to see you posting. Were you able to check out any of the resources suggested in earlier posts? And some of the info for resources here at WS? Several are listed in the missing persons forum here, and at the lighting the way home forum.
Were you ever able to reach David Thelen and his organization who specialize in parental abduction?
Can you let us know more about what Jeffrey Leving has offered to do for your case? Since you currently have custody, how can he help recover Emily? I remember when he took on the Elian Gonzalez case ages ago, but at that time Elian's location was known. Does Jeffrey Leving have any other success stories with recovering abducted children when their whereabouts are unknown?

I called the Berwyn Police again today and talked to Detective Cerolio again. He said that the D.A. Will not file criminal charges on Nigia because of my credibility issues and because of the alligations Nigia put on the letter. The D.A. Is not giving me my time of day to clear my name of all this. All I do is make calls and calls, I am sick of doing it. I cannot deal with this. I just can't. I cannot stand when people make promises to me, and never happen. The police don't want to do anything. I may be leaving/moving out of ILLINOIS in a few months to stop dealing with all this. I have no money to do anything and Jeffery Leving wont do this for free. He said he will start with the followiing.
1. Subpoena the Berwyn Police for all records.
2, Subpoena Nigia's older brother and wife into court to testify about the whereabouts.
3. Subpoena myspace for Ravelli's myspace location/IP Address
4. File a possiable lawsuit against the Police
5, Get media involoved.
I am trully at the end of my rops with this case. I don't want to let anyone down but i cannot deal with a case where the police/D.A Wont listen to me and think that I am lying about everything. That is their damn problem.

I know all this is up against you, but what ever you do don't put your hands down, don't ever give up, you have to keep fighting for that little angel, nothing will be worse then to totally give up, please don't give up, we all are here for you, this is a storm in your life and it will soon pass on over, keep the faith it all will pay off in the long run, that little angel is all worth everything you go through. oh and by the way who is Ravelli? and do you have the whole myspace url? if so you can private message me with it. is that the mom? I have to tell you that your child is the most beautiful child I have ever seen, we all want to help in some way or another. keep them dukes up, your in for a championship fight and you ain't a quiter. someone is going to come along and help you I promise. it might take a while, for example here in tennessee a young boy went missing and was missing for 5 years and was just found last week in montana. every case has different dynamics and yours may be more complex but this is all going to come to a end soon.

Passport info
Has anyone checked to see if Emily has a passport, here is a resource from the Children's Passport Issuance program. The mother is not suppose to get a passport with out fathers sig, unless it was before paternity was done. There is also a way to have the child's passport put on hold or pulled. I am wondering if Emily's mother has filed a ppo on him, or if there are any evidence of the alleged abuse ( been to a dv shelter, and did she mention this to the Friend Of the Court when he filed for visitation). I am a Domestic violence advocate and have some cases similar to this, but Mike should really check out this link.

Ravelli is the little brother of Nigia. Emily does have a passport. It was issued to her in december of 05 when I took Nigia to court. The media was all over my block a few hours ago because a guuy died in a fire. I talked to a few repoters and they said, they cannot take the story or run her picture. I was mad about it but just said....Thank you to the reporters. I think its crap that they dont care about children and care about other things that dont even matter in this world.

Mike- I know you are frustrated... but you have to slow down. Slow down and think of how many news stories you have seen with minor children ( even the ones who are accused of murder ) who have their faces blurred in the media.
Leaving IL is not going to help.....

Emily is young and resilient.... If you don't believe me think about all of your recollections between the ages of 2-4 or 3-5. What you remember is what Emily will remember about this time of her life and your absense right now.
Though your frustrations you mentioned Leving would subpeona Nigia's older brother and wife here in Chi town and subpeona Ravelli's info for myspace.

and can we have you reunited with Emily while she is still young resilient and will have few if any memories about this time of her life.

What em I suppose to do? I mean, Everyday I wake up dealing with the thing. No leads, No information, no one bringing in anyone for questioning, no rallys, no news coverage, I mean' its going to be 8 months on thanksgiving and it just is the same everyday. I never get any phone calls anymore regarding her case.

as we all say this is a complicated case due to the fact that she may be out of the country. this is a moment of your life that is testing you to the limit, you have to indure this time and refocus on everything, including working peacefully with the law enforcement officials, I know you have tried and tried but don't give in, those officers have children too, keep your childs face in view of them as you consult with them keep their focus on that beautiful child as you plead with them, in addition keep the ncmec ppl involved, they are very good at what they do. keep on going with this, don't give up, if you need take a day or so to refocus and don't overload yourself with emotions even if it is hard you need that time to keep yourself in good health. I have a strong feeling that she is fine and not being harmed, but time will take care of you and emmy, maybe not tomorrow, maybe not next week, maybe not next month, but this will come to an end and all the effort will be worth it.

This is an excellent post. Mike, are you in contact with NCMEC?
You didn't answer about talking to David Thelan. I know he is difficult to reach so keep trying. You might have to call 8-10 times before you can reach him.
I don't understand why Berwyn would say 'credibility' issues. you have no criminal record. Ask them then, theoretically, how anyone can make an accusation not file a police report and have LE believe them. Tell them kindly, it is like you accusing them of making threats against you, and having that believed without proof.
I am going to give you a call shortly, and will see if I can get you in contact with Christine. She is a little more knowledgable than myself with a few things... and I am having computer problems so I can not do much searching right now.

I intend on pestering the Dr. Phil show to death.
On tuesday, he had a dad on whose wife took their baby to Brazil! She illegally re-marries in Brazil. She then dies and the stepfather of the child wants to keep him. Dr. phil featured this story. I sat there thinking, why not Emily?! Why can't he feature this story?????

I found Emily through a mention on another website and followed what was going on through her father's myspace. I had no idea there was a thread about her here. I was thinking about her today and wondering if there had been any developments so I googled her and ta-da.
I haven't read the entire thread yet but just want to say I am so glad to see that you are posting here Mike and I am so sorry nothing has changed. It is unfair that men do not have the same parental rights as the mother does. If the table's were turned and it had been you who abducted Emily the police would be actively hunting you down. It is obvious what a wonderful father you are. The reason Emily caught my eye to begin with was because of her radiance and beauty. She is a gorgeous little girl. Stay strong.

I recently heard of a case where a woman managed to get her two daughters back from Brazil despite the dad being a citizen. So it's not impossible to do so. I'm going to look into it. Know a lot of people are pulling for you here.
