East Valley Tribune
Posted: Tuesday, October 5, 2010
The lawyers who represented a woman in the case of missing baby Gabriel Johnson since February no longer will be representing her in future court proceedings because they stated in court documents that she no longer can afford to pay them.

Surely they are kidding. Put a mortgage on that huge house of theirs. There is no reason that taxpayers should pay for her defense.

I was so focused on the claim that TPS can't pay her attorneys that I didn't even notice her appeal wasn't successful.

Tammi, Tammi, Tammi. You said right in the news that you didn't want a plea deal. Because you're innocent, remember?
But you had your attorneys try to get you a plea deal. Because you know you're guilty, guilty, guilty.

An excellent point was made on the EVT website under this article. Why WAS TPS offering "top dollar" for internet spyware people in the CL ads a few months ago if she can't afford to pay for an attorney?

10/04 Order directing the Office of Public Defense Services to appoint new counsel for TPS. This sure sounds like a done deal. Maybe there is a financial affidavit or bankruptcy filing that we just don't know about yet. Glad I don't live in Arizona.

The private attorneys' motion to withdraw as counsel was apparently based upon the "fact" that Tammi S could no longer afford to pay them--so perhaps something was attached to the motion (affidavits, e.g.) that would support the court's granting withdrawal of private counsel and also appointing public counsel.

I take it at some point you had a computer expert look at that data?" HHJP, 6/21/11

OMGoodness...realistically, how long can TPS delay this? I mean are we talking years or will the last day defiantly be March 20, 2011?

Baby Gabriel custody ploy is alleged
State: Suspect sought to adopt baby's mom
by Laurie Merrill - Dec. 7, 2010 12:00 AM
The Arizona Republic
The state has alleged that a Scottsdale woman charged in the disappearance of Baby Gabriel Johnson discussed adopting his mother as a way to gain custody of the child, according to a defense motion.
The state says Tammi Smith, 38, who wanted to adopt Gabriel, and Elizabeth Johnson, 24, of Tempe, the baby's mother, also discussed seeking a change of venue to Tennessee in the custody case.
In addition, the state alleges, the two talked about using child-support payments to pressure the baby's father, Logan McQueary, into surrendering his rights, according to the motion.

I don't get it. How is this alleged ? TPS and JS ( I think) both said this. It's documented. And the fact to change the venue to Tennessee, what is that about ? You know the request to change the venue to Tennessee seems interesting to me at this point ????

And docketed 12/10/2010 by Defendant 2:
12/09/2010- Pro Per Mail (Party 001)
I hope this is the seven page letter EJ sent to the judge and attorneys. I have gotten this mixed up in the past , but I think when the clerk specifically notes "Defendant 2" it refers to TPS.
