OK OK - Molly Miller, 17, & Colt Haynes, 21, Wilson, 7 Jul 2013 - #2

According to the court link okie provided a few replies up, the preliminary hearing was waived. Formal arraignment is 4/22.

Yes, it appears you are correct from what I can tell. 4/22 is next action.

I am not sure what a lot of this means but I suppose formal arraingment of charges? It seems a little strange because I thoght charges already filed a long time ago but I suppose these are the final formal charges? Not sure if I have this right as I dont know anyhting about the formal things in cases.

That's the way I understand it, but I'm certainly no expert. It's just too bad that his current charges are not related to our missing people...

It was good to see the small profile that Fox 25 News did on the case a few nights ago. Hopefully it'll bring some extra attention to the case. I don't know where things would be without the persistence of these families.

And just a little observation from the story they did -- clips of CN being escorted into court showed him looking cocky as ever.

What a busy week in court! I've been out of the groove for a little while, so bear with me while I get back up to speed.

Looking at ODCR, Sabrina's preliminary conference was on Tuesday for her Fraudulent Insurance Claim & False Reporting charges. A preliminary hearing is scheduled for April 24.

Checking in on Con's mom, who was on the phone with Sabrina and Con's aunt the night Colt and Molly vanished, she pled guilty to DUI, Possession of CDS & Transporting a Loaded Firearm charges on March 12 and sentencing is set for July 10. So what happened to her Firing at a Moving Vehicle charge?

http://www.kxii.com/home/headlines/Additional-charges-on-Melissa-Nipp-Greenroyd-sent-to-the-DAs-office-241743111.html

Carter County Sheriff Milton Anthony says additional charges against Melissa Nipp Greenroyd have been sent to the DA's office.

Greenroyd is already facing charges of DUI, firearm, and drug charges. Now she could also face charges of firing at a moving vehicle.

Was this charge plea-bargained away? I don't see why. It's a very serious felony charge and they had her dead to rights on it. Witnesses and everything, unless the witnesses weren't willing to testify. Hmm...

Okay, still looking at ODCR, Con's Carter County charges dated January 3 are the ones connected to the night Colt and Molly went missing. I think there might be a typo on his Eluding charge, because it says arraignment is set for April 2, while his arraignment on the Reckless Driving charge and the Motion to Accelerate on his probation violation is April 23. I also notice that subpoenas have been issued, one is to Sabrina and at least one other to a person listed by name.

Con's January 21 charges are from the high-speed chase with the OHP in Love County, and it says he waived his right to a preliminary hearing, so arraignment is set for April 22. I see his attorney has filed a motion to strike the Habitual Offender thing. Good luck with that, lol.

Subpoenas also issued here, listed names include Con's attorney (!!!), and members of the LCSO and OHP. I'm not totally sure who some these people are.

An MSM summary of the week's court activity:

http://www.ardmoreite.com/article/20140328/NEWS/140329627

For the second time in a week, James Conn Nipp waived preliminary hearing Thursday on charges that might link him to the disappearance of Wilson teenager Molly Miller and her boyfriend, Colt Haynes...

Nipp also waived preliminary hearing in Love County District Court Monday. In Love County, he faces charges of eluding/attempting to elude police officer, assault with a dangerous weapon and unauthorized use of a vehicle in connection with the same July 7 case.

Next on Nipp’s court date schedule is formal arraignment. He will appear in Love County District Court on April 22, and a day later in Carter County District Court. He currently is detained in the Love County Jail…

Graham is scheduled to appear in Carter County District Court for preliminary hearing April 24. She is currently free on bond pending the outcome of her case.

On ODCR, I notice that the DA listed on Con's Love County charges is the husband of the longtime employer of Con's aunt. A few interesting posts from OFMM:

https://www.facebook.com/groups/438762539575189/permalink/535181029933339/?stream_ref=2

Molly's cousin PMF says Con's aunt slammed a door in her face at court this week, and Con's mom told him to "keep smiling, baby. P!$$ on them all."

PMF also says she was contacted by the longtime employer of Con's aunt again:

https://www.facebook.com/groups/438762539575189/permalink/534247146693394/?stream_ref=2

Says the wife explained that her husband is not the DA and is not handling any of these cases at all and has nothing to do with any of it.

Well, alrighty then, but that's not what ODCR says. Would there be a notice of recusal or something listed if he is NOT handling Con's charges? I don't know.

Says she just played the trump card. I hope that means she contacted the state attorney general's office and reported this phone call. And the previous one.

Oh, woops, I made a mistake. It's not Con's attorney who was subpoenaed, it was the arresting officer. I knew it made no sense when I wrote that, but they do both have the first name and that's what happens when I try to juggle too much info in my head at the same time. Sorry about that!

Anyway, good article in the Oklahoman this morning. Starts out with a rehash of what we already know, and then Page 2 gets a little more interesting:

[Nipp] has been convicted of possessing marijuana and drug paraphernalia from a 2010 case and driving under the influence of drugs in 2011. The judge allowed him to enter a delayed sentencing program for young adults. A substance abuse evaluation detailed in the file reveals he began smoking marijuana at 9 or 10 years old and by 15, considered himself a “pot head”... He was recommended for inpatient treatment but failed to show up.

The assessment, under “attitudes,” states: “Nipp appears to be supportive of crime in general, and appears supportive of an unconventional lifestyle”...

In April, a probation and parole officer filed a violation report, recommending Haynes be returned to court. “Haynes continuously associates with persons having criminal histories and his behavior has not progressed any since being placed on probation,” the officer wrote. On July 18, a bench warrant was issued for his arrest, but he had disappeared.

Of course, by July 18 the bench warrant was too little too late. Colt and Molly were already gone.

Still here for Molly & Colt! Thanks so much OkieGranny for keeping us up to speed. I pray answers come!!!

Picked up a rumor that Con was just moved from Love County to the Carter County jail.

Checked ODCR and there is a Writ of Habeas Corpus filed by Carter County yesterday and issued today:

http://www1.odcr.com/detail?court=010-&casekey=010-CF++1400010

I don't think there's any hearing scheduled for a couple of more weeks so I have no idea what this is about, but anything that gets Con out from under the protective wing of Sheriff Joe is fine by me.

Not sure if it's okay to post because it's just a rumor I've read floating around everywhere -- possibly an altercation in the jail?

Also a rumor that he's already been returned to the Love County jail. No idea what's going on. :dunno:

Con pled not guilty this morning in Carter County to charges related to the chase the night Colt and Molly vanished. Trial date is set for August 11:

http://www1.odcr.com/detail?court=010-&casekey=010-CF++1400010

He was also in court yesterday morning for the other chase, but Love County hasn't updated ODCR yet so I don't know how it went.

Sabrina has a court date tomorrow.

Love County still has not yet updated ODCR. STILL! The hearing was Monday, for Pete's sake. Anyway, my understanding is that Con pled not guilty to charges related to the January chase with the OHP, and his trial date is set for June 16.

At Sabrina's hearing yesterday, the Carter County judge found there was enough evidence to bind her over for trial and her arraignment is set for May 28.

Word is she and her lawyer were all smiles and laughter before the hearing, not so much after. Better start talking, Girlie!

Has anyone heard any info on the reminants in the giant flaming hole????? if they arent in this hole I think being such a small area and such , there would be rumors about where they ARE?????

Miller’s family has been offering a $35,000 reward for information in Molly’s disappearance.

While the the Oklahoma Highway Patrol is assisting the district attorney in the case against Nipp, Molly’s family is still left without answers.

“We’ve spent months out there searching those woods,” Fielder said. “We have been put in the position to have to go out and find our loved one’s body on our own, and that is a position that no family should ever be put in.”

Nipp has denied any knowledge of Molly and Haynes’ whereabouts, according to KFOR.

The Miller family regrettably marked Molly’s 18th birthday without her...

“It’s overwhelming,” Fielder said. “The area is so large that we need to cover. It’s like a needle in a haystack.”

Three weeks ago, Miller's family got a tip with information about where Miller's body might be. Her cousin Paula Fielder told News 9 that an Oklahoma Highway Patrol (OHP) dive team and U.S. Marshals jumped on that tip, but they did not find anything.

"To be quite honest, I thought that was it. I thought we were going to find Molly and Colt that day and were going to get the answer," said Fielder, who has been working to gather information about Molly's whereabouts.

"If everything that is true that we've been told that happened to Molly that night, if any of that is true, and when it all comes to light, I don't know how, and we hear it officially, I don't know how me or anybody else in this family will be the same."
