Luka Magotta AKA Eric Newman Trial, Week beginning Oct 27, 2014 - Trial Thread #3

Yeah, the other kitten video was taken a year before. December 2010.

Thanks. Guess he was in a state of psychosis then too. This is a very frustrating and disturbing case to follow and this defense is doing a massive disservice to the truly mentally ill, imho. Not that I don't believe LM fits the criteria for a few diagnoses, but he certainly planned this and knew exactly what he was doing.

I found this tweet from @salimah_shivji amusing:

This is this afternoon's cross-examination, in a nutshell.
Crown prosecutor: Did you ask him about ___? Watts: No, I did not.
7:51pm - 18 Nov 14

So those were the pictures of LM and JL together! Were they just normal pics, or sex pics or what? :/

You can't really blame Watts for not asking all that, he's not a police officer and I get the impression that trying to get answers about anything out of LM was like banging your head against a brick wall :banghead: It probably took hours and hours and hours of coaxing just to get LM to say anything at all about the day of the murder.

Translation: #Magnotta Trial resumes. Crown asked Watts about the fact that #Magnotta deleted True Faith off of his computer June 1, 2012

Translation: Watts did not ask about it. Not about True Faith or other images and films of the Colombian that were cleared the same day #Magnotta

3 days after Lin's body was found, #magnotta deleted material from his computer. Watts didn't ask about that. not high on list of priorities

salimah shivji ‏@salimah_shivji · 2m2 minutes ago
Crown: You didn't ask why #Magnotta deleted information from computer that could get him in trouble (pics/video)? Didn't find it relevant?

suemontgomery ‏@MontgomerySue · 3m3 minutes ago
Watts says he discussed other things he thought important re state of mind. But you raise good points, he tells crown #Magnotta

suemontgomery ‏@MontgomerySue · 1m1 minute ago
But you're right, Watts concedes, it could go either way #Magnotta

suemontgomery ‏@MontgomerySue · 2m2 minutes ago
#Magnotta told Watts he stayed with Chris in Paris for a few days. did you confront him that it was just 1 night? no, says watts

**just want to clarify that they are talking about JC Robert.

salimah shivji ‏@salimah_shivji · 2m2 minutes ago
Watts says prosecutor raises good pts, but he focused on what seemed pertinent about #Magnotta mental state, didn't act as investigator.

suemontgomery ‏@MontgomerySue · 2m2 minutes ago
Stress and feelings of persecution seemed diminished after the murder so #Magnotta could go out and party in Europe. Not unusual, Watts says

Translation: The German Rubert said #Magnotta seemed normal to him . But psychotics may have a normal life, says Watts . Not inconsistent.

suemontgomery ‏@MontgomerySue · 2m2 minutes ago
#magnotta couldn't remember how or when he uploaded his video to the Internet, Watts says.

The problem I have with that is it seems that LE were not given access to LM for a forensic assessment. So there has been no official interview or interrogation of him due to his "sensitive mental issues". And in lieu of an interrogation or interview, LE should have at least been allowed to send in a forensic psychiatrist to ask these questions and get it on film. We know LM would have just refused to answer or said I don't know to everything but the jury should at least have been able to see it.

I completely agree. Particularly Dr Allard, who seemed to be arguing that it's not surprising that LM did all these horrendous things - he has schizophrenia :gaah:

I wish the Crown would ask some questions relating to schizophrenia though... I guess they will still be bringing in an expert witness later? They need to give us another motive besides psychosis! and paranoia and show some evidence of LM's attention-seeking, obsession with serial killers etc. Not just "Why did he put a shower curtain on the bed?". Why did he upload a trailer!?!?! That's the important question!

Totally agree!!! The Crown really seem to have dropped the ball in many ways IMO. I just don't understand it. It seems like the Crown has not ever attempted to question LM at all.

Did you ask him why he used the username Catherine on his computer? No. Did you ask him about Manny in Basic Instinct? no #magnotta

suemontgomery ‏@MontgomerySue · 4m4 minutes ago
Watts rented movie Basic Instinct last year because he was working on #Magnotta case. Didn't ask M about it, he volunteered the info

salimah shivji ‏@salimah_shivji · 3m3 minutes ago
Watts didn't ask about Basic Instinct but #Magnotta volunteered info about film & Sharon Stone. He used name Sharon when escorting in '08-9.

suemontgomery ‏@MontgomerySue · 3m3 minutes ago
Did he tell you that he went by the name Sharon at one point? I don't recall that. Judge points out reference in report #Magnotta

suemontgomery ‏@MontgomerySue · 3m3 minutes ago
In 2008-09 #Magnotta used name Catherine when working as an escort. As teen dressed up in g'ma's clothing.

It's weird that the fax about JL's head hasn't really been mentioned either... Couldn't the defence use that to show that LM was co-operating and feeling remorseful? Ian Brady and Myra Hindley would never ever ever have revealed the location! Poor Luka... failed model, failed pornstar, failed escort, failed necrophiliac, failed cannibal, failed psychopath, failed serial killer. He really can't do anything right, can he?

Even his imaginary friend doesn't talk to him any more. :giggle:

Translation: Watts asked #Magnotta why he had bought a return ticket Paris - Montreal . But #Magnotta did not remember

Translation: #Magnotta Said he did not consume hard drugs regularly.

salimah shivji ‏@salimah_shivji · 2m2 minutes ago
Crown is now asking about #Magnotta drug use. He told Watts he was offered illegal drugs at times by clients, he would mostly refuse.

Pause de l'après-midi au procès #Magnotta.

Afternoon break

That fax obviously got argued out since it came from his own legal defense team. Not sure what the argument would have been or if an agreement was made before the fax was sent.

And yes...he even fails as a defendant in his own trial. Not one person bothers to mention him during the trial because he's just not that interesting in person. Just his past deeds in context to the real person this trial is about... Jun Lin.

LM doesn't have to say one word to LE, the Crown or any psychiatrists they send his way. Not much prosecutors can do about it and it allows LM to basically testify without taking the stand. The crown can't really cross examine what he said either.

I don't know about the Crown having another witness. At the beginning of the week there was talk that the testimony could be wrapped up this week? Unless this is the last defence witness and then the crown only has 1 or 2?

He doesn't. But thanks to Dr Barth in Germany, it appears that LE never even tried when they first brought him back to Canada. Their mistake IMO. They should have sat him down as soon as he got back and interrogated him, on film, or tried to. It appears they did not.

I would also think that the defense would not be so willing to let someone pass on a NCR verdict without wanting to know if they really are. But who am I kidding?

salimah shivji ‏@salimah_shivji · 1m1 minute ago
Crown shows Watts #Magnotta text message log. It shows him exchanging with somebody to obtain marijuana.

salimah shivji ‏@salimah_shivji · 1m1 minute ago
Watts says it was the 1st time he saw those text messages. Says it's relevant but not inconsistent with what #Magnotta told him.

Ooh, will we hear what he texted to his sister AFTER the murder!?
