Two men accept plea deal on federal gun charges

Matt Stowe, district attorney general for the 24th Judicial District, was not immediately available for comment on whether the guilty plea in federal court might affect any decision to refile charges against Mark Pearcy in the Holly Bobo case.

Mark Pearcy was arrested on May 29 by the Tennessee Bureau of Investigation on charges of tampering with evidence and accessory after the fact in connection with the kidnapping and murder of Bobo in Decatur County.

The District Attorney General's Office for the 24th Judicial District dismissed Mark Pearcy's charges in the Bobo case last month but reserved the right to refile those charges in the future.

The release also said the pending federal charges against Pearcy effectively require "the state to wait until the conclusion of any federal proceedings before the state can obtain custody of Mr. Pearcy to proceed with state charges against him."

Jeffrey Pearcy is still charged in Henderson County with evidence tampering and accessory after the fact in connection to the alleged video, and authorities have said they're waiting to present those charges to a grand jury.

How long can Jeff P be charged but with the case not being presented to GJ? Is there some time limit in which the DA must eventually either present to the GJ or drop the charges? It seems like this guy's life has been in limbo for how long now? Accusation hanging over his head but no GJ and no trial date and no nothing. Just charged and in a holding pattern.

Is there some point where DA will have to chit or get off the proverbial pot? TIA

The case against Mark Pearcy is an order of magnitude weaker than that against his brother, so if they didn't continue against the brother it is highly unlikely that they would against him.

I suspect that is the last we will hear about this supposed video.
 
As far as I know, charges were never dropped for Jeff Pearcy, only Mark.

The DA stated yesterday that once MP is sentenced he plans to recharge MP.

Local prosecutor chosen for Holly Bobo case

Local prosecutor Jennifer Nichols has been appointed to aid in the upcoming Holly Bobo trial.

Hi Dr. Know.

I think that is from a Memphis news source, so "local" would mean from Memphis.

I think the choosing of that attorney is part of the DA's plan to put together a death penalty team.
 
Matt Stowe, district attorney general for the 24th District, said he has unfinished business with Mark Lynn Pearcy, who pleaded guilty to federal gun charges in court Monday.

"When the feds finish with him, we'll be waiting," Stowe said today.
Stowe said he will have to wait until Pearcy's federal court case is finished before he can refile state charges against Pearcy in the Holly Bobo investigation in Decatur County.


Pearcy was charged in May with tampering with evidence and accessory after the fact in the Bobo murder and kidnapping investigation. Those charges were dismissed last month while prosecutors waiting for Pearcy's federal case to be resolved.

Pearcy and his uncle pleaded guilty to federal gun charges after accepting a plea deal. His sentencing date is scheduled for Feb. 19.

Wednesday, Pearcy posted a message on his personal Facebook page to District Attorney Matt Stowe, saying, "If by trying to convict innocent people on false allegations is the reputation you are wanting to gain in your professional career, then you're on the fast track."

His attorney, Olin Baker, issued a statement Thursday...

"Mr. Pearcy would like the case officially dismissed or his day in court," Baker's statement read. "At this point, the district attorney will do neither."

Agreed! This kind of stuff concerns me when it comes to trial, a la Casey Anthony. :notgood:
 
Well this just keeps getting better and better.......................



One of the Attorneys for Jason Autry is now suspended for a 18 months.
He is also the attorney for one of the defendant's in the Vanderbilt rape case.

Fletcher called the action against his partner "a settlement of an old complaint that was expected."

For the first 60 days, Herbison will be on active suspension.

The last 16 months of his 18-month suspension will be spent on probation, subject to conditions.


The article then goes on to say:
Potentially more of an issue with the suspension is Long and Herbison's representation of Jason Wayne Autry, who is one of the suspects charged with murder and kidnapping in the Holly Bobo case.

Twenty-fourth Judicial District Attorney Matt Stowe, who is prosecuting the Bobo case, told News 2 he "expects a delay" because of Herbison's suspension and evidence still being tested at a crime lab.
