Australia Australia - Two Female Backpackers attacked at Salt Creek, SA, 9 Feb 2016

DRT, do you know if any other matters been listed for hearing? As all the women except for the Japanese lady refused his offers of a lift, perhaps this is the end.

Ah, I'd not thought of that.

It must KILL him to have a female judge.....:happydance:

And the wonderful thing about Justice Trish Kelly is that she appears to be a fairly tough judge. She also presided over the Carly Ryan trial.
.

A WOMAN who fired 27 gunshots into the home of the uncle who allegedly sexually abused her snapped after being failed by the justice system, a Supreme Court judge has found.

A SUPREME Court judge has ruled that sentences handed down to nine members of the Finks Motorcycle Club over a hotel brawl were inadequate.

Justice Kelly said Newman's plan was an incredibly cruel thing to do to a beautiful and impressionable child.
Justice Trish Kelly also lifted a long-running suppression order on his identity, allowing his name and image to be published for the first time.

I use the link http://www.courts.sa.gov.au/CaseLists/Pages/Supreme-Criminal.aspx

All tomorrow's cases have names, there was a lot of initials with mentions early in the week but no RH's.
I also note there is in case he does what was suggested and appeals the case he never defended.

This is updated each day.

To me from the 9 news article above and here http://www.9news.com.au/national/2017/05/01/14/44/salt-creek-attacker-admits-another-offence Justice Blue wasn't hearing any more at the moment. I may be wrong.

"Justice Malcolm Blue then referred the matter to Justice Trish Kelly who presided over the other two cases against the man."

I have been following this for awhile and I thought I would post. I backpacked in AU way back in 1991-92. December through March. I had a great time. I was in Adelaide in January '92 with my buddy. We had a great time and still have great memories.

What a nightmare for these two girls. While reading the court transcripts it was like they were describing there own murders. Only they won the day. Remarkable. They will go on to live happy lives and the creep will rot in jail. Cheers!

Thanks for posting powl44! :seeya:

I'm glad you had a great experience.

And so true - it actually was like they were describing their own murders. Well put.

Amazing women, they are. May their lives be blessed :star:

DRT, I'm replying to your post above but have lost the ability to "Reply with quote", in fact the ability to do virtually anything on WS since last night.

I've looked at both your links but the names are the same on both Criminal Cases and Appeals for today. That seems a lot of appeals for one day, and also peculiar that the names are identical.

O/T Last night while following van Breda, I had serious issues posting. When the trial finished I went to another thread which has huge numbers posting. People started reporting on that thread of the difficulties they were having on WS and we were directed to the following:

If you're having difficulties of any kind, please read posts 45 and 55, and the problems still exist for me today.

JJ looks like you will be doing some tweeting tomorrow. Nice of them to do this before the weekend. :happydance:

I think case 3 is the one he pleaded guilty to and case 1 is the attack of the Tasmanian woman.
We are still waiting for sentencing of the backpacker one I believe.

Its funny there was no appeals when I looked maybe they were added later. I read all the posts so its ok.

Tomorrow seems to be a lot but the same suppressed names were there Monday and Tuesday I believe.

Welcome powl44 to the board. It's a small and friendly group here so feel free to comment we aren't too scary .. most of the time. Nice to hear your experiences.

Salt Creek attacker found not guilty of raping third woman he met online

Justice Trish Kelly handed down her verdict in the Supreme Court today, after the 60-year-old's trial on charges of rape and unlawful detention.

She found him not guilty on both charges.

The woman had come to Adelaide from Tasmania to stay with the man over the 2015/16 new year and the court was told she woke one night to find him tying her hands to the bed before she was raped.

In final submissions prosecutor, Jim Pearce said the woman had "stuck to her guns" during her evidence to the court.

But defence counsel Bill Boucaut described her as a "woman scorned" who had been rejected by the love of her life.

#SaltCreek kidnapper acquitted of online girlfriend rape, to be sentenced for other crimes next week: http://www.adelaidenow.com.au/news/law-order/salt-creek-kidnapper-acquitted-of-charge-he-raped-online-girlfriend-now-faces-sentencing-for-crimes-against-three-backpackers/news-story/d674b02b098820b70bad510d9e11af7b … via @theTiser

Thanks for posting. "She remanded the man in custody to face sentencing submissions for his convictions next week."
Just checked it is not currently scheduled for Monday.

Why can't we know who he is now? There is only one set of proceedings he might appeal?

From what I've read, suppression orders are usually lifted upon conviction. I would imagine his name will be released once he's been sentenced unless there are further ongoing investigations.

Sub judice

In law, sub judice, Latin for "under judgment", means that a particular case or matter is under trial or being considered by a judge or court. The term may be used synonymously with "the present case" or "the case at bar" by some lawyers.

In England and Wales, Ireland,[1] New Zealand,[2][3][4] Australia, South Africa, Bangladesh, India, Pakistan, Canada,[5] Sri Lanka, and Israel it is generally considered inappropriate to comment publicly on cases sub judice, which can be an offence in itself, leading to contempt of court proceedings. This is particularly true in criminal cases, where publicly discussing cases sub judice may constitute interference with due process.

This was a well-written judgment, and as much as I’d like to, I can't find fault with it.

Even if he had been found guilty, there was always the possibility that the sentence he received would be served concurrently with the backpackers' sentence which I imagine will be hefty.

Yes, the judgement is laid out very clearly and concisely. And the unwillingness to have the friends she stayed with before leaving Adelaide come forward as witnesses did not help the victim's case at all.

I think it highlights that if a woman has been raped, we need to get to the police in a timely manner, report the matter to a doctor ... ensure that there are official records somewhere.

I am afraid that there are too many large time delays in this victim's case. The delays and the lack of friend witnesses left room for some doubt.

Agreed with the judgement being well written with both JJ's and SA's comment. In the earlier conversations a few of us thought this was going to be a hard case to prove without the reporting of the rape at the time but at the same time she was an easy target.
