Travesty of Justice is right. I am disgusted.

I will be looking forward to this appeal. Anyone have an idea how long that would take? I'm assuming years?
 
Another person in shock here. I was worried about the manslaughter charge, but never thought they'd come back with guilty on the murder charge!

Didn't Shapiro do enough to show that Rachelle was not acting like a bereaved mother who was terrified of MM and kept a virtual prisoner by him?

I did see comments around the internet saying that the texts MM sent during the housing hearing made people feel he was controlling and nasty, and there was a lot of hatred of MM after Sprinsky's testimony about locking Bella in the closet. But he wasn't on trial for those things, so I was hoping the jury wouldn't take that into consideration and would only think about the evidence (or lack thereof) that tied him definitively to the actual murder.
 
Murder 2 was an option that was later added correct? Not the original charge...

That's correct. It was only first degree murder until the prosecutor asked for lesser included charges of second degree murder and involuntary manslaughter.

I listened to Shapiro but couldn't bring myself to listen to that DA for more than a couple of sentences. I am just sick about this and believe that Shapiro will win on appeal.

I don't even feel like having lunch now.
 
Sounds like Rb will definitely walk. The DA are just releived the verdict went their way and someone payed for a child's life, imo

I was a law clerk on the Appeals Court so I know quite a bit about MA appeals (though not other states').

MM is entitled to one direct appeal of his conviction, in which he can challenge the sufficiency of the evidence, evidentiary rulings, and other trial errors. If he loses that one he can bring an unlimited number of motions for new trial (called collateral appeals), but if he tries to litigate issues not raised on direct appeal, they are very likely deemed waived. Collateral appeals are much less likely to be successful than direct appeals, but winning them is not unheard of depending on the issues raised.

Success on direct appeal depends a lot on whether trial counsel raised issues, so he is definitely in a better position than many criminal defendants, having been represented by a lawyer as good as Shapiro,

Shapiro has quite a number of issues on which he can appeal.

You mentioned sufficiency of evidence. This is a very broad and complex area, but I do think Shapiro will use it, especially in conjunction with his motion for a directed verdict that the judge denied.

The jury instructions will also come under scrutiny, and not just for the implied joint venture stunt pulled at the last minute. Shapiro may home in on what Sanders said with respect to evidence and RB's testimony (starts at 29:50 in the linked video). While Shapiro did impeach RB, Sanders made an untenable statement that could sway jurors in her instructions "the government does not know if in fact Miss Bond is telling the truth, since that is a question for you alone to decide."

Its interesting how the premise that all mothers MUST care and love their babies continues to live on even with the huge data to prove otherwise. It would be hard to believe that McCarthy knew nothing and wasn't involved in some way.

smh smh smmfh..... jeez. I have nothing. i just hope for appeal. i watched this whole thing and am mystified how they came to this decision.
