IMO today we can. Technology has rapidly evolved since this crime.

OT....Wait....there was a second trial? What was the outcome?

They ended up doing OOJ until the kidnapping one is rescheduled but they found Sidney guilty and gave him 10 years on that charge. Still waiting for another kidnapping trial as well as Tammy's trial.

I think she would be risking her entire legal career with a strategy like that. Plus, she's not his only attorney, so she would be risking all of their careers.

I'm so confused as to the lack of cell phone information. I recently watched the 2nd Heather Elvis trial and cell phone information was a big part of the trial. They had pings, data, movement of phones in certain locations and so much information. Can we not get anything from the cloud on ANY of the phones including Holly's? Just seems odd to me in 2017 we can't get better information from cell phones.

I harped on this a ton in another thread. I couldn't give it up. I have probably written at least 8 messages about the lack of cell phone detail but again it was revealed in another thread, phone companies only keep 30 days of actual texts.

You have to get these by warrant.

Britt was under high level of scrutiny at the beginning. Not these guys. And not enough for a warrant.

Until 2014, 3 years later. Cell phone companies don't have this info period. They have who texted who but not what they texted.

TBI lost on this whole deal. Their fault.

But why would she purposefully want a black mark on her own record/career just to get the trial overturned for a disgusting kidnapper, rapist, and murderer?

I *think* the issue isnt so much with smart phones being available but with what network was available in the area, i.e. 2G vs 4G vs LTE. I know where my mom lives in the country they still dont have 4G.

boy listening to this the case is just so screwed up you can't even know whose side anyone is on...defense seems like they are trying to use him as an expert...so they don't have a cell phone expert of their own...get ready for non stop objections...here we go with Terry Britt.

If the defense failed to get a cell phone expert - and that information is crucial to the defense, that might actually rise to the level of ineffective assistance of counsel.
