Capital murder punishment charge for Wesley is life or death, they haven’t decided if they are going to seek death yet. Abandonment of a child charge only sought for Sini at this time. #SherinMathews

Well I'm glad there are charges but I really don't think he murdered her on purpose. There weren't any plans for what to do with her body.

I'm also glad but I think he could still have killed sherin on purpose. Just because he seemed like he didn't know what to do with the body, and put her in the culvert, does not mean he didn't do it on purpose.
He could have just underestimated how much attention the case got and thought he would have more opportunity to collect sherin from the culvert and bury her.
We don't know if that wasn't his plan, and it just failed. All my own opinions.

Child abandonment is a second-degree felony if the offender abandons the child in his or her care, custody, or control under circumstances a reasonable person would believe would cause the child imminent danger of mental impairment, physical impairment, bodily injury, or death. Second-degree felony convictions come with two to 20 years of prison time and/ or a maximum fine of $10,000.

I'm a little confused about Sini's indictment. On the Grand Jury indictment she's charged under T.P.C. 22.041(e), which is a Felony Class 2 and carries a sentence of 2 to 20 years. But the Probable Cause Affidavit refers to 22.041 a SJF (State Jail Felony) which is 180 days - 2 years, which I think would refer to 22.041(b).

On Wesley's indictment he's charged the same but his Probable Cause Affidavit refers to 22.041, F/2 (Felony Class 2).

So if I understand it looks like the GJ found cause to charge Sini the same as Wesley with the more serious subsection. Does that sound right?? I sure hope so - IMO Sini shouldn't get off lightly for her treatment of Sherin regardless of whether or not she actively participated in her death.

They're reporting that he used a deadly weapon to kill her. Kind of sounds like 'on purpose' to me.
 
Does this mean Sini will not be charged with anything else?

A friend has twin granddaughters. One of them wasn’t thriving. I immediately thought of Sherin! I told her all about this case. I’m so glad he is being charged with Sherin’s murder but I think Sini should be charged with the same thing.
Btw, the twin was finally diagnosed with lactose intolerance and is now gaining weight! Not saying this is what caused Sherin’s failure to thrive but my friend ended up having to take the twin to the E/R to get her diagnosed.

I haven’t been here in awhile but just stopped in to say how pleased I am with the latest news.

IMO they will charge Sini as well -- eventually. They do say they are still investigating, right? I will be even more disgusted than I already am if that woman gets out of jail in only a couple of years!!
 
I still would like to know how the results of an autopsy can rule out a perpetrator? I'm not comfortable believing Sini had nothing to do with the death of this child. Is is possible she could later be indicted, since they did say the investigation is ongoing still? Thanks

The spoons may have contained some kind of forensic evidence but I don't think that's what he used. Seems to me they usually use specific legal terms when stating charges and the legal definition of a deadly weapon is: A deadly weapon is generally defined as a firearm or anything manifestly designed, made, or adapted for the purposes of inflicting death or serious physical injury.

I doubt Sini would get out in 2 years, even if the only charge is the current charge of Child Abandonment. When all the factors are taken into consideration, like the broken bones little Sherin suffered, and that she obviously knew about since she was the one who took her to the doctor, they're going to give her the max.

Autopsy results may not have *ruled out* anyone (assuming we’re discussing Sini) so much as *ruling in* someone (Wesley). Maybe Wesley’s dna was found during the course of the autopsy - that would point to him. The absence of other dna doesn’t necessarily mean no one else was involved, however. If I’m guessing, the charges are the result of the injuries noted in the autopsy, plus Wesley’s statement to the police. At this point, they may not have anything to implicate Sini on more serious charges. It doesn’t mean they’ve stopped looking. JMOO

A friend text me the news, I just couldn't get on here until now.

I'm so glad to see this. Even when it goes quiet, justice is still being sought for Sherin.

I will never understand this. They have lost everything. Their adopted daughter, their bio daughter (who they seemed to fight so hard to keep) their home, everything. And Sherin has lost her life. None of this can be made sense of.

I'm not sure what I would rather this monster have as his punishment. Life behind bars, thinking about what he did with a bunch of other inmates who despise child killers while his daughter grows up hating him. Or sitting on death row for years and years not knowing when his time will come? Hm. It's good enough for Scott Peterson.
 
Yeah, but in Texas you will actually die. Seven people were executed in TX last year, five are scheduled in the next 3 months. CA hasn't executed anyone in over 10 years (farce).

I am disappointed that the delay in recovering the body might have let SM get away with a lesser charge !!
I hope the speculation about WM squealing under the leverage of a potential death penalty will be the eventual outcome.

Is it normal for organized LE searches to miss finding a body in the search area ?
