GA - Caliyah McNabb, 15 days, Newton County, 7 Oct 2017 *Arrests*

For some reason I can’t edit any posts today... if you look at the “statute” section of his charges and hers they’re the same. “16-5-1” Murder, felony.

The difference that sticks out to me is just that he’s also charged with concealing death.

My gut says she did this.
 
According to The Daily Mail both are due in court for arraignment on January 23.

Cortney will be in Judge John M. Ott's courtroom. His court calendars can be found here, but it's clunky as all get out. PDF's are released by date, so far nothing for the 23rd. I couldn't find any searchable databases either.

This is an interesting read on murder classifications in GA. It says that in GA there is no 1st, 2nd degree etc... So I guess it’s odd that her charges state 2nd degree. In my opinion, they’re somehow both at fault... just not clear as to who’s the one that delivered the final blow :(

There are still many articles lingering online that haven't been updated to reflect the new law, including lawyer sites, so it can be confusing. I'm only aware of Georgia's unusual murder laws because of the Ross Harris case.

Thank you for this update! I thought this quote from the article you posted was interesting...

“Although Atlanta police have not charged anyone under the new law, it is one that will be considered in future child death investigations, according to Capt. Paul Guerrucci, commander of the homicide unit.

“The key word on second degree murder, as it relates to a child, there has to be criminal neglect,” Guerrucci said.”

So “criminal neglect” huh? I know nothing about law lol so I don’t understand why they were both charged with same statue code but with different descriptions. It could mean something or nothing I really don’t know. My gut says she played a big part if not the one that actually killed her. Could “criminal neglect” simply be that she put baby in harms way because they were high or putting baby in the middle of a heated argument/ physical abuse by CM?
 
Just seen this news about cortney. Not surprised in the slightest, I too think she did it. Where's the other kiddie? With her parents?

Cortney signed her rights to older daughter over to the state so her dad couldn’t have custody of his grandchild. She is seemingly currently in foster care. This is according to Fighting for Caliyah FB. I couldn’t get the link to copy straight to the correct post but just scroll down a bit and it’s there. Cortneys dad is trying to fight it.

Good question. Perhaps there is something in the background to her reasoning of why she doesn't want him to have her other child? Maybe she was abused by him as a child? And maybe she blames him for her terrible parenting skills and choices now as an adult herself? Just a theory of maybe why.
 
I think in my opinion only that she is trying to spite her dad. If I remember correctly the kids were left at someone's house for days and her dad went and picked them up and said to Courtney she wasn't having them back. She managed to snatch one child but had to ring the police to get the other. There is police recordings dotting about somewhere from the incident. She is just being selfish and thinking about herself trying to get one over on her dad, instead of thinking about her other little girls feelings and well being. All my own random thoughts.x

Yep I recall the same and completely agree with you. It’s unbelievable how hateful she can be.

I agree, IMO Cortney is selfish and very immature. You remember the October 3 incident correctly: on October 2 Cortney left the kids with her cousin overnight. On October 3, the cousin called Cortney's father after failing to reach Cortney or Chris to get the kids so he picked them up. Cortney then called the police who responded on a "custodial interference" call.

In the call Cortney seemed to not understand that Caliyah was an infant. She told the 911 operator she didn't know why her dad took the kids because they know her cousin and play over at her house all the time.

Cortney's father also called 911. He said the cousin called him at 4:30 and told him she couldn't get in touch with Cortney or Chris. He still had Caliyah. His call was a little garbled and he sounded upset. He also said he believed Chris was on the run from the police but didn't give more information about that (this was before Caliyah went missing). He said he felt the problem (why Cortney called the police) was that he had taken his car back. He also said that in his mind they abandoned their kids.

So it sounds like Cortney was angry that her dad took his car back and that he took the kids, even though her cousin called him when she couldn't get hold of Cortney.

On the day Caliyah disappeared Cortney told the 911 operator that her daughter said "Papa" had her, apparently meaning Cortney's dad. Cortney said she called him and her grandparents and they didn't have Caliyah and that her dad was on his way to her house.

IMO Cortney has a hot/cold relationship with her dad. She seems to rely on him to help her out when she needs something and they do seem to be in contact regularly. But I don't think she likes it when in her mind he interferes - like taking the kids when her cousin couldn't reach her.

Held without bond. Made 1st court appearance 1/8/18. Arraignment Jan. 23rd; also for Chris McNabb
Christopher Michael McNabb (27) "father" - charged & indicted (1/5/18) on 8 counts for malice murder, 2 counts of felony murder, 2nd degree murder, aggravated battery, 2 counts of 1st & 2nd degree cruelty to children & concealing a death; held without bond; under suicide watch. 10/10 arrested for a probation violation involving a burglary.

It briefly mentioned them on WSB this morning. It sai a couple who plead guilty to killing their newborn has been ordered to stay in jail “a few more months”. I back it up an replayed 3 times thinking I heard this wrong. I’m looking for an online link. This can’t be correct.

COVINGTON, Ga. - The Covington News was exclusively allowed in the courtroom with a camera Tuesday afternoon to photograph the arraignment of Christopher Michael McNabb and Cortney Marie Bell.

McNabb and Bell are expected to be in court again for a pre-trial hearing April 10 at 8:30 a.m.
