thanks @JMarsh for explaining some in's and out's regarding QB's! I think that we are not going to see the full picture for awhile, and it might be on the defense side. I am open to other explanations, but right now it appears that Chase wrote the cheques knowing that Joey was gone, we will see :)

Exactly. Chase told LE that he couldn't pay his rent because Joey is gone. And yet he cashed thousands of dollars in checks he wrote from Joey's QB account, and took the cash out at various casinos:

Charles Ray Merritt: Timeline of Evidence in the McStay Family Murders

This is compiled from the preliminary hearing, warrants, phone records and various witness accounts.

February 22, 2010

Withdrawal for $1500 at San Manuel Casino in Highland, Ca by Chase Merritt.

March 8, 2010

2 withdrawals for $503 at Commerce Casino in Commerce, Ca by Chase Merritt.

2 withdrawals for $504 at San Manuel Casino in Highland, Ca by Chase Merritt.
And, as we now know, took money several times from Joey's mother.

Especially the fact that he owed Joey 30+ thousand.
And printed himself a cheque within an hour of receiving an email from Joey telling him he had overpaid him $42,845!

So Joey said go print yourself some more of my money. I can't believe anyone would believe these cheques were printed with Joey's authorisation.

Can I ask you where you got this information? We haven't seen any of Joey's emails. Was this in the prosecution's opening statement?

You are welcome. We'll get the information eventually.

And, Joey just happened to give that check authorization, at the same exact time he and his family vanished.

The family goes missing, and within an hour or two, 'someone' sits down at the computer and writes out a check to 'chase merritt' , with the missing man's 'permission. '

We don't know when the family went missing.

Yes, but did you listen to the defense's rebuttal in their opening? I hope we are all still on board when this evidence is presented. It's going to be interesting to check notes. I'm not sure where you are getting that Chase then immediately wrote checks after getting that email, though.
It's in the OS.

Did the defense say Joey didn't send that email?

OS isn't evidence but the prosecutor wouldn't say that if it didn't exist.

Where is the defense opening statement?

I don't think Chase wrote that check. At the time of Joey going missing, Chase had a bench warrant out for his arrest. He may not have thought he'd be believed. And maybe he was hoping Joseph would get back OK, and it wouldn't be an issue.

I do appreciate the time and effort you are putting in, trying to make sense of these circumstances. You are doing a great job coming up with possible explanations.

But I do have to say, with great respect for you, I feel like you are having to twist like a pretzel, to justify some of the situational aspects.

Some are surmising that Joey and family were killed, and then Chase, who has a criminal history of theft and fraud, and who has a long history of conning customers and business partners out of money, then sat down at Joey's computer and stole money from the account, backdating and deleting the evidence. The evidence of that is those checks ended up in Chases's possession, some cashed by him, and spent at various casinos in the following months. And yet, He complained that he was behind on his rent.

But the 'pretzelly' explanation is that Joey actually decided to give Chase greater access to his finances, and purposely opened up a portion of his QuickBook account, telling Chase to write himself checks as needed, and sign them himself. And then Chase would delete and backdate, because that is the way Joey set up the custom account for him, and he also expected Chase to add his own name again, so he could teach him to use Joey's accounts from now on...o_O

I guess we'll see.

Well the check written on the 4th from JM's computer was for $4,000.00 with paul mitchell in the memo. That check was not printed.

On the 5th a check for $4,500.00 was written, printed and deposited into CM's bank account (paul mitchell in memo). This was done from CM's computer.

I think it's safe to assume both checks were written by the same person.

Also, if JM wanted CM to have a check for $4,500.00 wouldn't he have given it to him at lunch?

Possibly.

Right, but that is my point. I set up a custom account so my son could write checks for tuition and books. So the portion that he had access to had his name entered and set up by me.

My question is, IF Joey had wanted Chase to write himself checks, wouldn't Joey have set up that custom account with an entry for Chase Merritt? Why did chase have to make his own if Joey had supposedly set it up for him?

BBM
That's what I'm thinking. But CM accessed QB using JM's log in info.
