I think everything was pointing to Joey already having a plan in place to phase CM out altogether.

He started implementing his plan by giving MSM more job duties, including welding, and giving CM other duties with less pay. I think Joey wished CM would quit altogether, and move on.

Even easygoing laid back Joey knew CM had become more of a liability than ever an asset. IMO. He truly had become a thorn in Joey's side.

Imo, Joey knew he would fare far better without CM.

No more complaints about CM. No more shoddy work from CM. No more of CM spending more time at the casinos instead of fulfilling his job duties. No more loans for CM that wouldn't ever be paid back. No more having to support CMs family everytime he went back to jail. No more having to pay for the same material, and supplies twice.

He had every reason in the world to get rid of CM, and no incentive to keep him.

Imo, and this was all in the process of being done before the final strike of betrayal happened, when CM began stealing from Joey's business accounts.

Nothing was ever enough for CM. He wanted more, and more, but was too lazy to work for it.

So CM took what he wanted, just like he had stolen before, and ripped off other victims, pretty much throughout his adult life, filled with criminal behavior.

This time the only way to steal money from Joey, he knew he had to murder them all.

Boles testified after this jailhouse call IIRC In Boles cross examination, McGee went into detail about "flyers" and what they are, which is basically the cell phone chooses a cell tower WAY further away than necessary.

He showed this as an example:
2/10 12:37pm - in Rancho Cucamonga

one minute later:

2/10 12:38pm - in Riverside Lake Mathews area 18 miles from CM's home.

I have a snip of a map with the tower of where the call on Feb 9:32 was pinging. It is actually closer than the above call that pinged down that way a few days later, with no explanation. You can see Riverside, and you can see Lake Mathews.

Hi Missy! Fellow Canuck here. This is VERY interesting, especially if you did a lot of research at the Millard/Smich trials. The pinging was so much easier to follow and was a lot more logical. The data in terms of cell phones/pings/messages/calls leaves a lot to be desired in this trial.

You're right, because there is much more that Merritt pilfered from her. What a great guy he was.

I still find that so reprehensible, and unbelievably callous, but then I realize this is THE man accused of committing quadruple homicide, including two small little boys.

So I guess I shouldn't be shocked after all by his horrendous aftermath behavior.

I agree OBE!

So in part 1 - in one of the wiretapped calls - Merritt told his sister the location or a description of where the gravesite was. He later was on a wiretapped call with Jarvis and told her he only knew where the gravesite was located after talking to his sister....

another lie...they just keep piling up

edited to add...just saw that Tortoise posted about the same thing. :)

I read that MSM told JM to get rid of CM from the business or MSM wouldn't deal with JM anymore?
So yeah, i wouldn't be surprised if JM said something to Merritt just prior to the murders happening. IMO
Will have to look for that article now to try and post a link.

Wiretap showed he told his sister the location of the graves and then when Cathy asked him the same thing he said his sister told him the location.

I thought the defense case was supposed to create doubt :D

This was almost a year after the grave's were discovered... even I could have told you where they were after a quick google search. JMO
