2/19/19 Update: She did not attend due to what her attorney called "mental health" issues that have her in protective custody and under suicide watch at the county jail. She will remain in jail. The case is back in court in 3/28 with a pre-indictment hearing before another judge.

Public Defender Kimberly Schultz filed a motion last week seeking her client’s [Nakira M. Griner‘s] release from jail, arguing that in March, Daniel Griner Sr. told prosecutors he struck the boy with a belt at least four times in the days prior to the child’s death. He was not charged with a crime.

Prosecutors were too quick to charge the mother, Schultz argued, and the father’s admission opens the possibility that he is a suspect.

Superior Court Judge Robert Malestein denied the defense motion, finding that the new information about the father didn’t change his decision that the mother should remain jailed.

He granted a prosecution motion, however, to extend the period to indict Griner by an additional 45 days because of the complexity of the case.

Prosecutors recently received autopsy, anthropology and toxicology reports, Senior Assistant Prosecutor Elizabeth Vogelsong stated, which confirmed the identity of the victim and that he died of blunt force trauma. The injuries that killed the child occurred at the time of death, she said, and included multiple bone fractures.

Other efforts to gain evidence, including from Google and Facebook, are ongoing, she said.

Vogelsong responded that Daniel Griner Sr. was investigated. Detectives reviewed security camera video at the hospital where he works as a registered nurse to confirm he was there during his entire 12-hour shift, which covers the time period during which they think the victim died.

‘He was never at the house when we believe the child was killed,’ Vogelsong said. ‘Nothing in our investigation has shown that Mr. Griner Sr. was involved in the death of the child. Absolutely nothing.’

Those poor little boys...who could beat a child who isnt even 2 yrs old with a belt...just makes me sick...sounds like the father isn't much better. I bet both little boys have been abused at one time or another

Sounds like that is just what the wife/her lawyers are claiming -- that the state "doesn't know" when the child died so that the father could be responsible. Until I hear from prosecutors or LE that the father was abusing the child, I'm not going to put much stock in that claim. The mom is facing charges of murdering her own child so naturally her lawyers are going to be throwing a bunch of mud at the wall to try and get at least one thing to stick, JMO.

A New Jersey mother who allegedly told police she fatally struck her toddler son because he wouldn’t “eat nor listen to her” has been indicted on murder charges.

Nakira Griner was also indicted on counts of disturbing human remains, tampering, endangering and false public alarm in the indictment handed up Wednesday by a Cumberland County grand jury.

SHE ad.itted to hitting the child for not listening or eating. And the poor baby was burned and dismembered. I dont believe her dad with a belt story for a single second. I think she was mad at the dad and this was the ultimate punishment. And now, to try to blame him is just a way of trying to make it even harder.

The Bridgeton woman charged with killing her 23-month-old son and burning his remains may not be competent enough to assist in her own defense, her attorney argued in court Monday morning.

The Judge said he would order a competency evaluation at the jail. During that time, a professional will make the determination as to whether Griner understands the nature of the charges she faces.

Griner’s arraignment has been rescheduled for Aug. 26.

Judge Malestein said he would order a competency evaluation at the jail. During that time, a professional will make the determination as to whether Griner understands the nature of the charges she faces, the basics of court proceedings and whether she is able to assist in her own defense. Arraignment has been rescheduled for Aug. 26.
