Pinellas Teacher Charged With Bringing Gun to School

"FORT LAUDERDALE, Fla. - Prosecutors are seeking mental health and medical records of the former student charged in last year's Parkland school massacre.

The state asked Broward County Judge Elizabeth Scherer on Tuesday to order a psychologist and an orthopedic clinic to turn over Nikolas Cruz's records.

Psychologist Daniel Mauer treated Cruz before the Feb. 14, 2018, shooting at Marjory Stoneman Douglas High School that left 17 dead. Prosecutors said they should have access to his records because Cruz told deputies that voices told him to kill people. They want to see if Cruz ever claimed that during sessions with Mauer.

Northwest Broward Orthopedic Associates treated Cruz for a broken arm shortly before the shooting. Prosecutors want to see if any treatment he received could have affected his mental health.

At one point during the hearing, Cruz put his head on the table and covered his ears with his fingers as the court played social media videos of threats he made to shoot up the school. He appeared to not want to hear his voice...."

Pinellas’ sheriff blessed arming teachers. But will his school board go along?

LARGO — State leaders have already allowed the arming of teachers. But that topic is still being debated in Pinellas County, whose sheriff helped make the Florida law a reality.

The Pinellas County School Board has maintained for more than a year that arming school staff is not an option. But on Tuesday, after an emotional, three-hour presentation by Sheriff Bob Gualtieri, some board members say they're reconsidering that stance.

“People say teachers should be teachers and cops should be cops,” Gualtieri said. “The reality is that isn't going to mitigate the harm, and that's not the world we live in.”

The sheriff said those who apply to serve as guardians would be put through a “rigorous” background check, then undergo extensive training that goes beyond what sworn officers receive at the police academy. School staff allowed to carry a weapon in schools would use a “retention holster,” the sheriff said, to prevent it from falling out.

“It's going to happen fast,” the sheriff said. "There is no way in the world that you're going to have a cop there in time."

The shooting at Stoneman Douglas, he said, was over in fewer than four minutes. He played the recording of a 911 call from the Feb. 14, 2018 attack to show how long it takes to relay information to law enforcement. At one point, Gualtieri spoke over the noise of the recording: “Think about what's going on at the school right now. Kids are getting shot.”

It took one minute and 24 seconds to dispatch officers to Stoneman Douglas, he said, and “the majority of (victims) had been killed by then.”

They really need to figure out how to control this sorry sack of SUGAR HONEY ICED TEA. His bratty courtroom behavior and clear lack of remorse irk me more than anything has ever irked me before and I've been irked plenty. His lawyers must be pulling out their hair because I'm fairly certain I'd be considering a career change by now.

Shed no tears for the former Broward County school resource officer arrested for negligence

I hope they throw the book at him.

I would be more inclined to feel pity for Scot Peterson, 56, were it not for the fact he maintains he did nothing wrong. It would be one thing if his inaction left him apologetic and broken with guilt, knowing that he did nothing to save the children he was tasked with protecting. In that event, I would say that his arrest was unnecessary, as it would only prolong the Parkland tragedy. But Peterson claims his cowardice is justifiable. He claims he did nothing wrong. He needs to be held accountable. We will see what the state has to say about it.

The question has emerged out of yesterday’s arrest, which appears to be an unprecedented punishment for a law enforcement officer’s inaction during a shooting.

TALLAHASSEE — New questions are emerging about who is responsible for the safety of others during a mass shooting after Tuesday’s arrest of a Broward County Sheriff’s deputy who hid outside during the 2018 Parkland massacre.

The sponsor of this year’s bill which allowed classroom teachers to carry guns said Wednesday it’s possible armed teachers could similarly be on the hook, legally, if they don’t do everything required of them to keep kids safe during a shooting.

“Whether it’s involving a firearm or not, if there’s an employee who did not do everything in their power to protect students in that situation they would be open up to facing those kinds of charges,” Sen. Manny Diaz, R-Hialeah, said. “Now, it’s really up to a prosecutor to find where that line where a person has crossed where (failing one’s) employment duties has to pass into criminal.”

The state’s teacher’s union, the Florida Education Association, has opposed the idea of arming teachers in Florida since it was first proposed, arguing more guns in the hands of people who aren’t law enforcement make schools less safe. Tuesday’s arrest of Scot Peterson, however, could make a dangerous law even worse by shifting more liability to teachers, said Fedrick Ingram, president of the union.

“What responsibility do you then have as a volunteer who is saying, ‘I’m going to arm myself?’” Ingram said. “How far does that responsibility go? ... That’s a thought process our teachers should not be faced with.”

Even more unsettling for union members is that in August the state amended the Department of Education’s insurance policy for teachers to exclude coverage for claims arising out of “armed instructional personnel while acting in the scope of their activities for the educational institution.”

The Coward of Broward, Scot Peterson has been called: a sworn law enforcement officer accused of standing by while people died.

Here's the thing: It is not a crime to be a coward. It is not against the law to hesitate, to not find it in yourself to act. It's difficult to mandate that people do the right thing.

Smart lawyers say pinning responsibility on Peterson could be a stretch. If the charges make it past a judge, maybe a jury will convict purely on the emotion and horror of what happened — and what might have been prevented — only to have it overturned on appeal.

And isn't civil court the appropriate place in our justice system for this?

Instead of taking charge and entering the building upon hearing of the presence of a gunman, Peterson stood behind a cement pillar for 48 minutes “while students and teachers were slaughtered,” Ryan Petty, the father of one of the victims, Alaina Petty, told CNN.

These charges against Peterson are purely political in nature and placed only to appease the angry crowd. Nowhere has it been posted that the Florida prosecutor is going to have an impossible time making this case. In fact all the charges could be dismissed before the case sees the light of a courtroom.

It will probably surprise most people to know that there are ar least three Supreme Court cases that say that a police officer has no statutory requirement to protect any individual citizen.

There are a ton of things that officers do that the law says that they are not required to do and only do so as a courtesy to the public. Some of them are responding to traffic wrecks, looking for missing persons, and answering burglar alarm calls.
 
The Gonzalez case I believe held that there was no right under the US Constitution to receive assistance from law enforcement. But that is different from what is happening here. That case was a civil lawsuit. This is a criminal proceeding brought under statutes of the State of Florida. Those statutes state that if you are in certain positions of a "caregiver" of children, you have a duty to protect and failure to do so is a crime. Typically, normal patrol officers would not likely fall under that definition unless they had a child in custody for example. But the role of a school resource officer may well be different, and that definition certainly may apply. If that definition does apply to a resource officer, then Peterson was indeed required to try to protect those children. No doubt LE unions will pony up to defend him. So it will be interesting to see how this plays out. But it will play out in state court, not federal.
 
Sheriff suspended after Parkland shooting fights for his job

"TALLAHASSEE, Fla. — Florida Gov. Ron DeSantis’ decision to suspend the sheriff who oversaw the response to the Parkland school shooting was a knee-jerk reaction based on politics, not facts, a lawyer said Tuesday as a Senate hearing began on whether to uphold the suspension.

The lawyer for suspended Broward County Sheriff Scott Israel portrayed DeSantis as using the deaths of 17 students and staff members at Marjory Stoneman Douglas High School for political gain, saying DeSantis was promising to remove Israel even before the governor was elected in November....

The hearing was being held before former state Rep. Dudley Goodlette, who was appointed by Senate President Bill Galvano to hear facts in the case and make a recommendation on whether Israel should be removed from office. The full Senate will later decide Israel's fate.

DeSantis suspended Israel three days after taking office in January, saying the response to the Parkland massacre showed incompetence and neglect of duty...."
