Can the prosecution office say that the death penalty is off the table, and then go back on that? Or a judge over rule that decision?

Utah folks are nice, but bloodthirsty for killers like AW.
I’ve never heard of that happening.

That would be a dangerous precedent, as that would have far ranging implications for subsequent cases.

Deal making is a huge part of what DA’s do, and if you can’t trust the word of the DA, then future deals might not be made.

I trust that the death penalty is in fact now off the table, which I can live with.

Her family needed to have her back.
 
Not necessarily. Or not in her mind at least. He's defective.

So he may feel differently about his childhood. Who knows what genetic propensity different people- even siblings have. And of course people experience the same things differently. Qualia is the term, I believe.

Siblings also don't tend to have identical experiences.

And then there's always choice. As Professor Dumbledore (JK Rowling) so eloquently stated: "It is our choices, Harry, that show what we truly are, far more than our abilities."



Yes but just to be clear, I don't think family is dangerous. Just family members with issues. Probably not a good idea to have them babysit or spend the night with kids in the home.

Yes! Rules apply to family, too! Most of these crimes against children occur at the hands of people we “trust.” This hits home for me as my mother is an alcoholic and cannot be trusted to care for my toddler daughter without supervision no matter how much she claims she isn’t drinking.
 
I don’t know.... I understand his criminal record hasn’t indicated prior offenses along these lines, but this is quite a big leap for a first time. He decided to go in and take her, just inches away from her Mom’s bedroom door. He hadn’t even interacted with her that night, she was already sleeping when he got there. He wasn’t timid in his actions at all, but was willing to be risky in order to indulge himself. I just don’t believe this was the first time that he molested or assaulted a child.

His going for a walk was his only way of explaining why he wasn't in the house in the a.m. His lame explanation being he didn't want to hear his Sister and BF being frisky so he split. "Hey I don't know what happened in that house after I left for my walk"

I wondered this.

From my understanding the only way they can back out is if AW breached his part of the deal or if there were extenuating circumstances come up. If they did go back on it without those instances occurring then they usually would not be able to use anything AW said in a trail or sentencing while he was under the assumption that there would be some type of deal

From Balt and I see similar faces as his. Gaunt. Cheekbones sharp. His booking photo is different than the photo on page 1 (post #2) where he's healthier looking. JMO. Could be Meth. But I'd bet the farm he'd test positive for some type of drug.

Also, meth heads have crazed sex drives. Children who live or interact with adult users have a high likelihood of being sexually victimized.

I agree, Jane. My post was with good intentions and wanted her to proceed with caution and check with mods on TOS before posting again due to some initial posts that were remedied. And no disrespect to the poster what so ever, I am glad she is here and appreciate any insight that can be shared. MOO
 
But, Beatrixpotter,
Here is the thing.
As a parent, you should be aware and cautious of all and any of the people you let around your child.
I'm going to take that another step. You should also monitor what your child is allowed to listen to, and watch. Whether radio or television or the internet.
In my opinion, your job is to protect and teach skills that will help them succeed and thrive in our current times. This requires monitoring.

Allowing a repeat jailed offender with drug issues around your child will never be an okay thing to do.
Whether it's your Mother, your Father or your distant cousin. Screwed up people are screwed up people. If as an adult, you choose to hang with them anyway, that's fine, but keep your children away from them. Period.

This is completely my opinion about being a parent. I do not know what transpired within this family to have an end result of a dead little girl.



This has absolutely no bearing on this case though. Her boyfriend wasn't remotely responsible. It was her brother. Are divorced single moms not allowed to have family around? I mean I don't know if the mom made poor choices here. But she's a victim. The responsible party is the murderer. And while I do agree with you to some extent...biological fathers do horrible things to. The real blame needs to lie with the people who commit the crime. Not others who were unable to read the minds and hearts of others or see the future.

I cited a case on here last night, in which search dogs and search parties had walked right passed the body of a dead child.

She was ultimately discovered weeks later, which hampered their ability to collect evidence.

As unfortunate as it is, it happens, And it’s not for a lack of trying.

Yes but I was talking about the poster who thought this was yet another case where mom dated a creep and allowed the man around her child, with fatal results!

Oh I've been there with certain family. It sucks but it's crucial.

This irrigation canal runs between the school and the grove where #LizzyShelley was found. Based on where evidence was collected, it's likely Alex Whipple brought her through here. (2/5) @KUTV2News

This is the grove where she was found. The spot was searched on Saturday, Sunday, and Monday. The property owner tells me there were dozens of searchers and at least three dogs here over multiple days. (3/5) @KUTV2News

Just got a chance to check in and saw the update. I knew in my mind that she would be gone, but when I saw she was found my heart felt both relief and despair.

Why did this happen? Why did this happen to any of the other children whose cases have been mentioned?

Rest In Peace sweet girl.

I initially thought these mulch piles may have been where she was found but the property owner told me these piles were turned over on the weekend. The police chief told me the searchers were "within feet" of her body. We do not know how deep she was buried. (4/5) @KUTV2News
