A man named Andre Jackson was initially arrested and charged on June 3, 2016 for the murder, but the charges were dropped.

Then this year, on the three year anniversary of Josue's death, Houston Police Chief Art Acevedo and cold case detectives reiterated that Jackson is still a person of interest in the case.

Acevedo said in May that advances in DNA technology could help point to Josue's killer.

Last Friday, ABC13 Eyewitness News was the first to report that investigators discovered new physical evidence in the murder case.

"While it is painful for a crime victim's family to wait for justice, sometimes the passage of time helps a case," Ogg said.

Sources said Friday that DNA evidence tested at the out-of-state lab matched Jackson.

In a statement Tuesday, Acevedo said: "For the past three years, our department has worked tirelessly to bring justice to Josue, the Flores family, and our extended community. I never followed this case before, but I just watched some of the live reporting: I hope the DA has enough evidence to put away Josue's killer. I also hope that the evidence will clearly show they have the right person. MOO.

So sad that this thread doesn't have much attention. An 11 year old boy was stabbed to death! I hope the press has good coverage of the trial. MOO.

I hope so too. I've been reading the thread and I think they could very well pursue the death penalty. He was stabbed over 20 times! :( MOO

A @houstonpolice officer keeps an eye on the scene of the crime- to make sure everyone stays safe. On May 17, 2016 around 5pm Josue Flores was just a few blocks from home when he was stabbed nearly 2 dozen times. He died along Fulton near James on the city’s north side. #khou11

I agree, I just read the thread and caught up too. I couldn't believe it when I read he was stabbed 20 times! :eek::( Anyone who can do that is a grave danger to society. I just hope they have a slam dunk case here because Andre Jackson was the second man arrested back in 2016 after the first man arrested was released due to having an alibi. MOO.

GRAND JURY INDICTS JACKSON FOR MURDER IN JOSUE’S DEATH
June 18, 2019

After prosecutors presented newly tested evidence, a Harris County grand jury indicted Andre Jackson for murder in the death of 11-year-old Josue Flores, who was stabbed to death in 2016, District Attorney Kim Ogg and Houston Mayor Sylvester Turner announced Tuesday.

“We have always said we will follow the evidence, and sometimes a case grows stronger with time, Ogg said. “We look forward to presenting all the evidence at trial and finally delivering justice for Josue, his family and the community.”

As grand jury proceedings are secret, Ogg said she was prohibited by law from discussing details regarding the newly tested evidence.

Ogg was joined at a news conference by Turner, City Councilwoman Karla Cisneros and Executive Assistant Police Chief Troy Finner.

“The city has always remained focused on justice for Josue Flores. I want to thank District Attorney Kim Ogg and the prosecutors who tirelessly worked this case,” Turner said. “I want to thank members of the grand jury, who listened and carefully weighed new evidence presented, and this morning, returned an indictment.”

“Police Chief Art Acevedo and HPD investigators also deserve credit for staying focused on identifying the main suspect in the Josue Flores murder,” Turner continued. “To the family, I want you to know we will remain by your side every step of the way – until this journey ends in justice for Josue Flores.”

The indictment handed down Tuesday marks the second time Jackson has been charged with murdering Josue.

Prosecutors asked that murder charge indictment against Jackson be dismissed in 2017 until and if additional evidence was found. The judge granted that dismissal.

If prosecutors had proceeded to trial at that time, and Jackson had been found not guilty, double jeopardy would have prevented this charge.

However, by dismissing the case against Jackson at that time, they reserved the right to charge him again should additional evidence be discovered.

If convicted, Jackson, 30, faces five to 99 years in prison, or life. He was arrested Tuesday by Houston Police.

Jackson, now 30, was staying in a Salvation Army homeless shelter in northeast Houston at the time of the killing.

Jackson is a Marine who served four years from 2007-2011, rising to the rank of corporal. Military records show he deployed to Iraq in 2008, where he served as a nuclear, biological and chemical defense specialist.

Military records show Jackson received medals for Marine Corps Good Conduct, Navy & Marine Corps Achievement.

Jackson has previously said he has PTSD.

Jackson also has a criminal history in Harris County, with charges ranging from theft, trespassing and unlawfully carrying a weapon.

A former Marine was arrested in the fatal stabbing of an 11-year-old Houston boy who was attacked while walking home from school last month, authorities said Saturday.

Witnesses described hearing loud screaming and seeing a man and the boy struggle before Josue collapsed and the suspect fled, according to Houston police. The boy was hospitalized with multiple stab wounds but died at the hospital, police said.

Authorities had offered a $20,000 reward for a tip that led to the person responsible for the killing. Another man in his 30s was originally arrested and charged in the murder, but the charges were dropped when his alibi checked out.

On Thursday, police released new surveillance video and photos of the suspect. A man in the video can be seen running near where the boy was stabbed.

Houston Police Department Lt. John McGalin said the video led to a tip about another video, which led investigators to Jackson. He said a distinctive jacket that was worn by the man in the videos was found with Jackson, who "provided a statement that corroborated a lot of things we knew to be true and led us to believe we have the right guy." bbm
