Two weeks ago, charges were dropped against Andre Jackson the man accused of killing the boy after DNA test results came back. Jackson had been in jail for more than a year.

In an interview via Skype on Friday, Jackson, now 28, said, “I did not kill Josue and I am not his killer.”

Josue was walking home from Marshall Middle School on May 17, 2016. Someone stabbed him more than 20 times.

Jackson insists, “I would never attack a child. I would never kill anyone.”

The sixth grader died on Fulton Street, not far from his family's Near Northside home. Jackson added, “I send my condolences and I pray for them.”

Houston Police say though charges were dropped, Jackson remains the primary suspect. He was arrested about two weeks after the murder, after multiple surveillance cameras showed him in the area during the time, running.

What was he doing that afternoon? Jackson says, “All I want to leave it as is I was on my way to the library around that time.”

Jackson was released in July when DNA results came back. The Harris County D.A.’s Office says there is no match to Andre Jackson in any instance.

Jackson who was staying at a Salvation Army shelter says, “They were trying to emphasize I was homeless. I was a student that day as well.”

He feels he is a victim of “institutional racism” and stereotypes of the homeless.

As for questions about his mental health?

“They tried to come to me with Facebook posts from years ago, talking about being depressed and homeless. But that's pretty much meaningless. I’m not suicidal. I wasn't suicidal. Sometimes young people talk in slang.” he said.

Josue Flores stabbed to death
Flores, 11, was walking home from Marshall Middle School in his Near Northside neighborhood when he was stabbed 20 times. Witnesses reported seeing a man and Josue struggle before Josue collapsed into some grass. The suspect fled and a bystander flagged down police. Another neighbor apparently got into a vehicle to chase the suspect, but he slipped away. Josue stayed after school late for an end-of-the-year science club party. His sister, Sofia, said he wanted to be a doctor when he grew up. "But I know he's going to be my guardian angel," she said.

Houston police make first arrest
Police said tips lead them to him. He matched the description of the attacker and was involved in an altercation at a nearby bus stop at North Main near Quitman the day before the murder. He punched another person in front of a METRO officer and was Tased. He ran from that, but left his bag with his ID in it. A witness of the Josue Flores murder picked him out of a photo lineup. He told police he was innocent and had an alibi

HPD chief defies judge's order to return Josue Flores evidence

HOUSTON, Texas (KTRK) -- In a move that shocked the Houston Police Department, a judge approved a motion to return evidence to the prime suspect in Josue Flores' murder investigation.

Chief Art Acevedo spoke only to ABC13 Eyewitness News about the development he says could hurt the investigation.

"Over our dead body," Chief Acevedo told ABC13. "We're going to fight this tooth and nail."

Court records show Andre Jackson's defense attorney first filed a motion to have his property returned in May 2018. It was not until recently, in March, that a judge approved the motion. bbm

Sources tell Eyewitness News that when Jackson showed up to the station to try and retrieve his property, they refused to give it back.

Now, a legal battle has ensued.

"We're going to file every legal strategy we can, and file every motion we have to, to protect that evidence," Acevedo said.

According to HPD and the district attorney's office, Jackson is still considered a suspect in Josue's murder investigation.

Jackson was charged in 2016, but those charges were later dropped when the district attorney's office said DNA evidence was inconclusive.

"The technology gets better and better in this area in terms of extraction of DNA, so we would be remiss to not fight tooth and nail to get evidence of a person that has been previously charged," Acevedo added.

ETA: Was this motion the fire at the feet of the DA to recharge Jackson? With no motive for why a decorated marine would stab am 11 year old child to death in broad daylight, I believe scientific evidence will be critical to get justice for Josue. MOO

Why the DA's office and HPOU are at odds over Josue Flores case
Since the charges against him were dismissed, Andre Jackson had been asking the court to order Houston police to return the personal items officers seized the first time he was arrested.

Court records show a judge granted that motion earlier this year. Houston police, however, refused to comply, stating that, since Jackson was still a suspect in Josue Flores’ murder, many of the items seized were needed as part of the ongoing investigation.

Houston Police Department officials said, with the help of the FBI, evidence gathered the first time Jackson was arrested was rested at a Florida lab that utilizes more advanced DNA testing techniques that were not readily available in 2016.

  • The DNA tests in 2017 were inconclusive and AJ was released however, LE still considered him a POI.
  • The Cold Case Unit learned about a new DNA test which provided the evidence LE needed.
  • Police said evidence from the crime scene was sent to a DNA testing facility in Florida. Once it was received, they waited for the Grand Jury's indictment.
  • Meanwhile, LE had AJ under surveillance 24/7 until he was arrested on a traffic stop in Baytown.

KHOU 11 legal analyst Gerald Treece thinks Andre Jackson’s fate hinges on science and could be decided before trial.

Twice police linked Jackson the 2016 murder of Flores based on DNA found on Andre Jackson’s jacket. The first time, prosecutors said DNA and blood analysis proved “at best inconclusive and in some regards exclude Jackson as a suspect.”

“It was tested by a lab that had superior capabilities to the first lab that tested it several years ago,” said Kim Ogg, the Harris County District Attorney.

Treece sees one potential problem. Conflicting results demand explanations that Jackson’s lawyers could exploit, Treece said.

“It all depends on the science,” he added. “(Jackson’s lawyers are) going to go through every hurdle and every hoop to see if the science is right to see if it matches up correctly. I wouldn’t even be surprised to see expert testimony on that issue. This is before trial.”

Authorities held on to Jackson’s jacket for more than three years. Detectives believe he was the last person with Flores. Investigators waited for science to bring them better ways to prove it.

This spring, detectives found a lab in Florida able to do so. The FBI paid for the testing, according to Houston Police.

“If this science is held to be legitimate, valid, proper in every way I think the defendant is going to have a hard time,” Treece said.

Now, prosecutors said new advanced DNA testing on a jacket initially seized from Jackson’s home does show a match to Josue.

“Evidence doesn’t take sides," said Wice. "Evidence doesn’t have an agenda. Evidence doesn’t see it as personal. It sees proof beyond a reasonable doubt as a standard by which anybody accused of any crime is judged."

Wice said generally people believe justice delayed is justice denied, but he said this is an exception.

“What we learned in the wake of the grand jury handing a murder indictment against Mr. Jackson is that sometimes, a delay ultimately helps the State of Texas and law enforcement,” said Wice.
