Wow! I’m not sure why the prosecution would allow him to plead guilty. 42 years is not enough for what he did to this woman and his own son! JMO

Man sentenced to 42 years for murder of Walsenburg single mother

HUERFANO COUNTY – One of the suspects involved in the murder of Amy Garcia, a single mother of four children from Walsenburg, was sentenced Wednesday.

A judge sentenced Heith Gleason to 42 years in prison Wednesday for second-degree murder in the case. As part of the plea agreement, Gleason pleaded guilty to the murder charge. All other charges were dropped.

The probable cause affidavit in the case disclosed disturbing details about Garcia’s murder, which happened in rural Huerfano County on Dec. 20, 2018.

Garcia’s body was found inside a burned out car just off of Silver Mountain Road near County Road 530, west of Walsenburg. Investigators had determined that she was shot before the fire.

Gleason and his son were arrested outside of a McDonald’s in Santa Fe, N.M. the same day Garcia was killed. Gleason’s son is set to appear in court on July 26.

A friend described Garcia as “super amazing” and supportive of her children.

Captain Milan Rapo with Huerfano County Sheriff’s Office told us back in January that Garcia’s murder shocked the community.

ETA: No mention if plea agreement includes assisting prosecutor with charges against his minor son. Nonetheless, murder to sentencing in less than 6 months is swift justice for Amy.

Gleason and his juvenile son were arrested in December after Garcia’s body was found in her burned-out car in front of their home in Walsenburg.

A witness says Garcia was in her car when the elder Gleason went outside and fired a shot. He then came back inside and said he didn’t kill her.

According to court records, the son then went outside, and the witness heard more gunshots. Heith Gleason reportedly told the witness his son “had earned his man card.”

Suspect, 12, in homicide to face charge in Colordao

A 12-year-old boy wanted in connection with a recent homicide in Gardner will be extradited to a youth detention facility in Colorado after an extradition hearing Monday in Santa Fe, according to the Santa Fe New Mexican newspaper

The newspaper reported that Gage Gleason appeared before District Judge Sarah Singleton. He and his father, Heith Gleason, 35, were arrested on a warrant charging the boy with murder at a McDonald’s restaurant in Santa Fe on Dec. 21.

Huerfano County sheriff’s deputies believe the boy shot 41-year-old Amy Garcia, whose body was found behind the steering wheel of her burned-out sedan n front of Heith Gleason’s house on Dec. 20, according to the arrest affidavit.

Garcia’s family members have told Colorado news outlets she was a single mother of four children.

Spencer Wertz alerted Huerfano County Sheriff’s deputies to Garcia’s death.

Wertz told officers he, Heith Gleason, Gage and Garcia had just returned from picking up some alcohol at Garcia’s home in Walsenburg. Garcia was in her car outside the Gleason residence when the elder Gleason picked up a gun, said “I’ll kill her,” and went outside, according to the affidavit.

“Mr. Wertz stated a heard a gunshot but that Mr. Heith Gleason came back into the residence and stated ‘he did not kill her,‘” according to the affidavit. ”[The witness] continued to say that Mr. Gage Gleason then went outside with a .22 caliber firearm with a scope and once more [he] heard more gunshots and that Mr. Heith Gleason then stated his son Gage ‘had earned his man card.’ ”

12-year-old involved with murder in Huerfano Co.: police

Captain Corey Daniels with the Huerfano County Sheriff’s Office said the two thought they got away with it. Heith Gleason and his 12-year-old son both shot Heith’s new girlfriend to death outside of his home in rural Huerfano County.

Capt. Daniels said that a man called 9-1-1 to report that he had witnessed the murder of 41-year-old Amy Garcia.

The witness said the 12-year-old shot her first, with a .22 rifle, while she was trying to get in her car and leave. Then Heith Gleason shot her two more times with a different gun.

Then according to the witness, somebody lit the victim’s car on fire with her body inside in an attempt to destroy all evidence of their involvement. The two of them also tossed their clothes and guns inside the burning car.

The witness said that the couple didn’t seem to be in a visible argument but there was some tension.

After leaving the state, Heith called dispatch himself in an attempt to throw police off and even told police where he was, believing he had an alibi and all the evidence was destroyed in the fire.

Eventually, Heith and his son were taken into custody about 200 miles away at a McDonalds in Santa Fe, New Mexico.

ETA: This witnesses account seems one where Dad takes the fall for fatal shot but ultimately not consistent with probable cause affidavit. I wonder if Heith Gleason's shot struck Amy?

42 years, probably out in 10. I don't know who makes these laws and determines the punishment for crimes like this, but they need adjusting to reflect the seriousness of the crime. I think this is ridiculous. MOO.

In Colorado - punishment for first degree murder is either life sentence, or death.

Second degree murder - punishment includes up to $1 million in fines and between 16-48 years in prison. It will be up to the judge to determine how many years you will spend behind bars. The judge will consider a number of factors when making this decision, including your prior criminal record and the nature of the crime.

In Colorado, murder is both an “extraordinary risk” crime and a “crime of violence.” These designations call for a mandatory minimum prison term and a maximum term that is more than double the penalty for other crimes in the same class.

Generally, second-degree murder is classified as a Colorado class 2 felony under 18-3-103 (3)(a) C.R.S.

The punishment for Colorado second-degree murder as a class 2 felony includes, at a minimum,16 years in a Colorado prison. However, this is the minimum penalty.

Heath also burned the body in attempt to destroy evidence. I don't see this guy ever getting out. MOO

12/31/18 Update: Gage will be extradited to a youth detention facility in Colorado after an extradition hearing Monday (12/31/18) in Santa Fe. Gage appeared before District Judge Sarah Singleton & the boy signed documents voluntarily agreeing to be returned to Colorado, where he faces a charge of first-degree murder. Hearing set for 1/7/19.

As far as I know & per my notes he is in jail.
