South Toledo mother accused of leaving two dead infants in cars pleads no contest

A South Toledo woman entered a plea Tuesday in Lucas County Common Pleas Court after the remains of her two infant son and daughter were found decomposing in separate vehicles 2.5 years apart.

But while the case against Jenna Cisneros, 34, now has moved closer to closure with her decision to enter a no contest plea, the events that culminated with the abandonment of two dead children remains a mystery.

On Tuesday Jenna Cisneros, who has three living children, entered a no contest plea to all charges during an appearance before Judge Linda Jennings. The endangering children charges will merge with the involuntary manslaughter charges, so she faces a maximum sentence of 34 years in prison.

The mother’s voice cracked under her mask when Judge Jennings asked if she understood the potential penalties.

“Yes, your honor,” she answered.

Unfortunately, some of the questions remain unanswered, Frank Spryszak, deputy chief of the Lucas County Prosecutor’s Office, said Tuesday following Cisneros’ plea.

“I would say that’s probably the most frustrating aspect of this case because I would like to get some kind of formal, final resolution outside of just a plea and a conviction,” he said. “We may never get to that point and it’s ultimately going to be up to Mrs. Cisneros if she wants to finally come clean and explain what happened.”

But once the story broke about the couples’ arrest, a former co-worker of the mother commented on social media that there was text-message evidence that showed Cisneros acknowledging the birth of the infant girl, who was named Giovanna Gabrielle Cisneros, prosecutors said.

As the investigation continued, Cisneros told police during a Jan. 15 interview that she did not recall giving birth, and that her husband did nothing wrong, Mr. Spryszak said.

The case before Mr. Cisneros, 34, is pending before Judge Jennings, and scheduled to go to trial on Sept. 15.

A DNA test confirmed the couple were the biological parents of the children.

No mental impediments were found for Cisneros during two separate psychological evaluations, her defense attorney, John Thebes said on Tuesday. However, Mr Thebes argued that his client suffers from anxiety and depression, along with possible other disorders, and her mental health remains a key dispute between the defense and the prosecution.

He acknowledged that prosecutors had a strong case against his client based on circumstantial evidence.

“We believe it’s in her best interest to enter a plea, resolve the case through a plea as opposed to going to trial. At this point, we’re really throwing ourselves at the mercy of the court and hopefully at sentencing we will be able to show the court why she should receive a sentence of the lower end of the spectrum,” Mr. Thebes said.

Mr. Thebes said he hopes at sentencing — scheduled for Sept. 9 — to paint a better picture of who his client is as a person — past, present, and future.

Update: Mother gets 25 years in prison after two children found dead in abandoned vehicles

There may never be a clear-cut explanation about what happened when a South Toledo mother gave birth to two infants, only for their bodies to be found in separate vehicles years apart.

During a lengthy criminal investigation, Jenna Cisneros, 34, provided logic-defying and conflicting accounts of how she gave birth and abandoned her children over a span of approximately 2½ years, Lucas County Common Pleas Court Judge Linda Jennings said during a sentencing hearing Wednesday.

Cisneros walked into the courtroom with her head down.

She rocked side-to-side as she waited to learn her fate.

Then Judge Jennings sentenced her to 25 years in prison, not quite the 34-year maximum she faced.

“Your actions are so horrific, they are void of description,” the judge said. “You killed two of your babies and left them to decay in two different vehicles. It is incomprehensible that a mother could do this, not to one child, but two children that you carried for nine months. You stand here today in tears saying that you're sorry, but you fail to accept responsibility.”

The criminal case that resulted in Cisenros’ prison sentence started in May, 2017, when a baby boy — still referred to only as ‘John Doe’ — was found in a tarp-covered vehicle in the 2400 block of Vaness Drive in Toledo.

There was no indication where the baby boy came from until cold-case detectives in November, 2019, submitted DNA samples to AdvancedDNA, a private company that specializes in forensic genealogy.

The DNA then linked the baby to his parents: Jenna and her husband, Jacob Cisneros, prosecutors said.

The baby’s decomposing remains showed no signs of bodily trauma, and no anatomical or toxicological cause of death was determined by the Lucas County Coroner’s Office.

In February, 2020, the husband and wife were arrested for the death of baby John Doe. Then, as police continued their investigation, they located the remains of an infant girl — later identified as Giovanna Gabrielle Cisneros — in an abandoned Chrysler PT Cruiser registered to the couple.
Cisneros initially denied being pregnant and told investigators she did not recall giving birth to either child, but she had told a co-worker that her daughter died from health complications at a hospital in Ann Arbor.

In a third version of events, Cisneros claimed she gave birth to both babies inside their vehicle in Holland grocery store parking lots. They were both stillborn, she claimed.

She told police she birthed the baby boy in the PT Cruiser in a Kroger parking lot in Holland. She claimed that she cleaned the vehicle, and then at some point, the baby was placed in another vehicle on Vaness Drive, prosecutors said. The child was found clothed and wrapped in a blanket.

As for the baby girl, Cisneros informed her husband that she was pregnant, to which he replied in a text message that he had no desire to have another child.

Regarding the baby girl, Cisneros told a co-worker through text messages that she gave birth to Giovanna in late October, 2018, at ProMedica Flower Hospital, but the baby had health complications and later died at Mott Children’s Hospital in Ann Arbor.

Prosecutors said there were no birth or medical records for either baby.

She told investigators that she also gave birth to the girl inside the PT Cruiser in the Walmart parking lot in Holland, and she said she did not clean the vehicle. The baby’s remains were later found in that car, which was left at an apartment complex when the family moved.

However, Toledo police determined there was no physical evidence that a child was born in the vehicle, leading to “another example of Mrs. Cisneros not being truthful with us when she had an opportunity,” said Frank Spryszak, deputy chief of the Lucas County Prosecutor's Office.

A cause of death was undetermined for the baby boy.

While the baby girl’s cause of death was determined to be asphyxia by the umbilical cord, the coroner’s office ruled it undetermined — or unable to say if the death was natural, accidental, or intentional — which is why Cisneros was not charged with murder.

Regardless she did not seek medical care for the babies.

“We don’t have the specific answers as to if the child was legitimately stillborn, there were complications, or she actually killed the child,” Mr. Spryszak said. “Because she’s never given us legitimate, straight answers regarding anything else, it’s difficult for us to believe that this was a stillborn child, speaking of the second child.

But it’s a matter of what you know and what you can prove, which is why we indicted her the way we did.”

When it was her turn to speak on Wednesday, Cisneros apologized and asked the judge for leniency and mercy.
“I need help with my mental illness. I need help,” she said, barely audible through tears.

Jenna Cisneros in August entered a no-contest plea to felony charges of involuntary manslaughter, endangering children, tampering with evidence, and obstructing justice. Jacob Cisneros faces the same charges in a case pending before Judge Jennings.

Defense lawyer John Thebes on Wednesday said Jenna Cisneros’ mental-health struggles and strained relationship with her husband culminated in her irrational actions.

In the past, he said, Cisneros was diagnosed with schizoaffective disorder, bipolar disorder, depression, and post-traumatic stress disorder following a history of abuse.
“All of those factors were a smoldering bomb that were about to go off as she advanced in age,” Mr. Thebes said.

Many have asked why Cisneros didn’t take the babies to a safe haven, such as a fire station.
“She doesn’t know why,” Mr. Thebes said. “She didn’t act like any normal, rational person.”

Family members and others from the community wrote letters to the judge, describing Cisneros as good mother to her three living children. No relatives were present for the sentencing hearing.

Judge Jennings noted that any mental health issues that Cisneros was suffering from did not interfere with raising three other children or from holding a job.

I hope the story from Jacob is more clear-cut. Absolutely nothing about this case makes sense. I think the three living, seemingly thriving children are throwing me off more than anything else.

I do want to highlight the fact that the female baby's cause of death was asphyxia by the umbilical cord, but they're unable to determine the manner of death (natural, accidental, or intentional). For anyone like me wondering how common it is and how likely it was to happen naturally: "According to WHO, 4 millions deaths yearly occurred due to birth asphyxia, representing 38% of all deaths of children under 5 years of age." 7/30/20 Update: On Thursday, Mr. Cisneros appeared before Judge Linda Jennings by video connection and was released from the Lucas County jail on electronic monitoring. Prosecutors said the move was necessary to ensure charges against the defendant were not dropped. Jacob was released from jail Thursday due to speedy trial issues amid the coronavirus pandemic. Jacob was scheduled for trial Aug. 11, but that date fell outside of modified speedy trial requirements put into place by state lawmakers. A new trial date for Mr. Cisneros has been set for Sept. 15.

Tuesday, October 27th:
*Trial set to begin (@ 9am ET) – OH – Baby Boy Doe (2 mos. or younger) (found May 11, 2017 decomposing in a 1988 Ford Mustang, South Toledo) & Giovanna Gabrielle Cisneros (was Baby Jane Doe) (infant) (found Feb. 10, 2020 decomposing in PT Cruiser which had been towed to police lot) – *Jacob Andrew Cisneros (33) arrested & charged (2/3/20) & arraigned (2/4/20) with involuntary 1st degree manslaughter & endangering children. Those charges were dismissed (on 2/13/20) , indicted (2/13/20), Charged & arraigned (2/19/20) with 2 counts of 1st degree involuntary manslaughter, 2 counts of 3rd degree endangering children, 2 counts of 3rd degree tampering with evidence & 2 counts of 3rd degree obstruction of justice. Plead not guilty. $400K bond. Bond changed (2/19/20) to $1,225,000.
Trial set to begin on 10/27/20.
10/14/20 Update: Motion to modify bond. 10/15/20: Motion to modify bond-Denied.
*Jenna Nicole Cisneros (34) – 8/17/20: Plead no contest. Sentenced on 9/9/20: 10 years in prison as to Count 1; 30 months in prison as to Count 3; 30 months in prison as to Count 4; 10 years in prison as to Count 5; 30 months in prison as to Count 7; and 30 months in prison as to Count 8. The sentences in Counts 3 & 4 are ordered to be served concurrently to each other.

7/30/20 Update: On Thursday, Mr. Cisneros appeared before Judge Linda Jennings by video connection and was released from the Lucas County jail on electronic monitoring. Prosecutors said the move was necessary to ensure charges against the defendant were not dropped. Jacob was released from jail Thursday due to speedy trial issues amid the coronavirus pandemic. Jacob was scheduled for trial Aug. 11, but that date fell outside of modified speedy trial requirements put into place by state lawmakers. A new trial date for Mr. Cisneros has been set for Sept. 15.
9/15/20 Update: Hearing held, present: Asst. prosecutor Frank Spryszak, Peter G. Boyer on behalf of defendant & defendant. Per defense motion for trial continuance-granted & has been rescheduled to 10/27/20. Bond continued at S/or with electronic monitoring.
10/14/20 Update: Motion to modify bond. 10/15/20: Motion to modify bond-Denied. 10/27/20 Update: Trial rescheduled at defendant's reuest. Hearing held on 10/27/20. Present: Assistant DA Frank Spryszak, Peter G. Boyer on behalf of defendant & defendant. Motion granted pursuant to the request of defendant to continue trial date. Trial has been rescheduled to 1/19/21 @ 9am.
