I’m not privy to the answer to that question but it’s something I’ve been curious about every time I read MSM mentioning their decades of separate living arrangements and her live in boyfriend. They are not divorced but I think her inheritance gets smaller everyday due to lawyers fees.

I forgot all about that, that married couples do not have to testify against each other here in California.

RIGHT NOW: The Smart Family attorney, James Murphy, filed a lawsuit against Ruben Flores and is suing Flores for emotional damages associated with Kristin Smart’s 1996 disappearance. Filed less than 12 hours since Ruben posted bail and was released from jail. @KSBY

Deputy District Attorney Christopher Peuvrelle said bail should remain at $250,000, which he said was affordable, based on documents submitted in court.

The judge concluded the bail should be set at $50,000, explaining that “setting bail in something more than he can afford is a detention under the law.”

His conditions of release include surrendering his passport, remaining in San Luis Obispo County and agreeing to wear an electronic monitor.

The elder Flores has bailed out. Not clear to me who his bondsman is yet.

In a lawsuit filed today against Ruben Flores, James Murphy (Smart Family attorney) alleges on “information and belief” Ruben moved Kristin Smart’s remains on or around Feb. 9, 2020... 5 days after SLO Sheriff served a search warrant at all the Flores’ homes. Text from suit here:

Suspect in Kristin Smart killing previously suspected in 2007 rape allegation
A man charged with murder in the death of Kristin Smart, a California college student who vanished walking home from a party in 1996, was investigated in the alleged rape of a woman in Southern California a decade after Smart's disappearance.

Paul R. Flores, now 44, became the subject of the investigation in 2012 when his DNA profile matched a profile collected from the woman, who was given a forensic examination at a hospital the morning after the alleged January 2007 assault, according to a report from the Los Angeles District Attorney’s Office. But the alleged incident was never prosecuted.
