1) was planned and deliberate
2) was contracted
3) was committed against an identified peace officer (LE, JP, mayor +)
4) while committing or attempting to commit the hijacking of an aircraft
5) while committing or attempting to commit sexual assault
6) while committing or attempting to commit sexual assault with a weapon
7) while committing or attempting to commit aggravated sexual assault
8) while committing or attempting to commit kidnapping and forcible confinement
9) during a hostage taking
10) while committing criminal harassment
11) was committed during terrorist activity
12) while using explosives in association with a criminal organization
13) while committing intimidation.

Second degree murder in Canada is any murder which is not first degree murder.

There may not have been enough evidence (at this time) to bring first degree murder charges. If, say, there was a planned friendly meeting and an argument/scuffle occurred and she fell and fatally banged her head and he then panicked and dismembered…?
 
I am kind of confused too as dismemberment shows premeditation and deliberation. Plus there are charges for disturbing a dead body. Perhaps a lower charge for to keep him being bars until they sort it all out?

They should also see if he is related to Sonia Varaschin.

When I saw he was a construction worker that crossed my mind too, wonder if they checked his work boots.
 
In the press conference the police spokesman mentioned "2nd degree" and "domestic". That would lead me to think it was an altercation that led to the death. Would dismembering the body and scattering the parts make a difference to the charge, or would that be another charge?

Perhaps there would be a second degree murder charge as well as a charge for performing an indignity upon a body if the body was dismembered posthumously. I think Magnotta was charged with performing an indignity, along with first-degree murder.

The dismemberment doesn't necessarily show planning of the murder itself. Could have been a spontaneous blow-up, victim is killed ... then "what to do, what to do ... I know, I'll dismember and dispose ...". There is a separate charge for offering an indignity to a human body which would be in addition to the 2nd degree murder charge.

Given the alleged perp is an ex-boyfriend and the victim's plans to return to her husband in China however, I suspect that the ongoing investigation may turn up evidence of premeditation, in which case charges could be upped.

IMO, if this is domestic/personal, I don't feel it will be related to Sonia. Victimology seems different (i.e. Sonia was not high-risk lifestyle, seems she was blitzed by an intruder, and iirc, there was no dismemberment. That takes a special kind of beastie).

I might be a bit more inclined to consider Kera Freeland who was in the escort business in Toronto. Although she was not dismembered (that we know of?), you are right that there was time for the perp to evolve with the hope that the remains might not be found as easily as Kera.

BTW, do we know yet if the ex-boyfriend is "Ken"? If she lived with her bf at the townhouse and it is the crime scene, I can't see "Ken" being absent while an ex-bf was in the home, let alone for the length of time it would take to subsequently dismember a body. Now, IF the ex-bf and Ken are two different people, then the ex could have been watching the residence for Ken to be away, in which case it might support some pre-meditation.
 
I thought I read that Ken was caucasian. JMO
 
Police were searching this house in Scarborough (where the suspect lived).

They still don't know yet where the crime took place, but he was a POI early on.

from the article coco linked above, the suspect's townhouse is on Brimwood Blvd, near Brimley and Finch.
Also:

Neighbours also said police removed a four-door sedan from the complex’s underground parking garage Sunday night.

Police continued their investigation in the townhouse Monday evening and they are expected to remain there for several days.

Hopefully they will find evidence in his vehicle.
 
Might be just an interesting coinkydink ... in looking for a telephone listing under the alleged perp's surname, I didn't find one on Brimwood. There are however two listings for the surname only (not an uncommon Asian surname in Toronto) on Bonis Av at Kennedy, within a stone's throw of where some of the victim's remains were located. Seems it might be the highrise apts at the eastern end of Bonis. Could be nothing, but ..
 
this is a long shot prob. But Nancy Jo Scamurra ,was only found by her torso,Her other body parts are still missing.But that was back in 1984 and her torso was found in the oswego harbor in .NY

Liu&#8217;s parents only heard of her brutal murder when her ex-husband, another native of Changle living in Canada, called them after seeing the news on Canadian television. With his limited English, he didn&#8217;t understand exactly what had happened to his former wife. He knew only that she was dead.

Her parents learned the horrible details of their daughter&#8217;s dismemberment from Chinese television.

An old transliteration error added to the confusion and hindered the news from coming to the family more directly.

Oh geez. How gruesome...and a little bit brazen.

I don't feel like this guy will be connected to any other unsolved murders around the area. He and Liu were together for 4 years...I'm sure this is going to be a case of a scorned lover snapped - especially with the second degree charge. He likely caught wind of Liu wanting to return to China and confronted her...then things got out of control. I don't think a guy who's killed before is going to be washing tools in his yard with surgical gloves on. JMO.
