Penalty Phase #12

DT is intentionally not presenting their case now and trying to blame judge and court and prosecutor.

Now, all of a sudden Nurimi wants motions in open court not sealed, for his theatrics and to blow the case in public.

This is ridiculous. They have had this case for YEARS. Beyond manipulative.

In recess attorneys are nowhere near #JodiArias, seems they're avoiding her.

Is Nurmi gonna break into song? "please release me, let me go."

Diet coke just flew out of my nose..my daddy sang that every Saturday night when he played guitars with my brother...that and walking the floor and letter edged in black.

I bet she will not defend herself either this is classic she is such apsychopath that she will not give anyone the satisfaction in getting up there to defend herself. Instead she relied on others to do this for her and when those people did not materialize she basically gave the court the finger. NOT EVEN HER MOTHER????

I have to say I love the way JSS straight out told Nurmi his motions were denied. Goooo JSS!

Mr. Nurmi started acting like my little son there for a moment. But I can see how frustrated he must be. I think his real frustration is with JA, but he is projecting it on to everyone else.

Did the jury witness that steaming pile of poop?

It's reversible error for them not to present a mitigation case. I don't practice criminal law...but I believe that they aren't putting anyone on at all in an effort to prevent the reviewing appeals court from denying their appeals based on the fact that she did get to present a mitigation defense. It's a decent tactic (legally speaking) but I doubt that it will be successful given the fact that the Judge offered them the opportunity to have the witnesses heard in camera.

Can someone explain this to me?

Now the Defense is saying (at least that's what it sounded like to me) because the Court does not grant our motion to mistrial, we're not going to call any witnesses.
But there were supposed to be more witnesses than just that one woman who withdrew from testifying, right?

So won't they hurt their client's case if they don't call anyone else now? Or does that mean the other witnesses withdrew, as well?

I'm confused, because while I didn't always agree with their tactics, to me it always seemed like the Defense was trying to get the most out of it for their client, working with what little they had, and this move now seems like a child stomping their foot to me - like, you know, you didn't do what we wanted, so now we're not going to proceed accordingly. Which I don't even think this actually is, I'm just stumped as to what else it could be.

I'm sure I'm simply missing the legal/ trial-related background to this, so if someone could give me a quick explanation, that would be great.

WTF are we doing now? :stormingmad: My live feed must have been behind... I heard the jury being called in, went to my video tab and there is the seal???

oh my, no defense

I don't think you're allowed to create an incompetent defense by being pouty when you don't get your way
Ya wouldn't think so, but failing here the DT seems to be kicking this case upstream.

#JodiArias is talking wit the mitigation specialist. Looks like Nurmi and Willmott are waiting to go back to chambers.

They are doing this to deliberately give her ineffective counsel so she will get a new trial on appeal, right?

Umm....what the heck just happened? The seal came up immediately and stayed:stormingmad:
