I'm not familiar with criminal trials but I think you can (usually? sometimes? always?) ask for a trial by judge instead of a jury. In theory, a judge would be informed on the rule of law.

It's one thing when drunk drivers who kill people are acting inappropriately in the hours after the deaths. They are presumably still drunk and probably don't grasp what's going on. It's ugly and awful and being drunk isn't an excuse but an explanation for their actions.
