Just heard on CP24 that the witness who was the victim's boyfriend (viewing it from the webcam) saw someone come into view of his gf's computer screen, his gf screaming and falling to below the webcam level, two loud thuds and a naked man seen from the waist down reach over and close the computer.
 
TORONTO - The former boyfriend of Qian “Necole” Liu listened helplessly by his computer’s webcam in Beijing as she was attacked in her North York home, a jury heard Monday.

In her opening statement, Crown attorney Christine Pirraglia said Xian Chao Meng and Liu were engaged in an online chat, both visually through a webcam using Skype and through an MSN-style messenger service in the late hours of April 14, 2011 and into the early morning hours of April 15.

While Meng never saw the deadly struggle — which was off camera — he heard his ex-girlfriend say “no” in both English and Mandarin to her attacker’s sexual advances, said Pirraglia.

“Meng then heard what sounded to him like two muffled bangs. He never heard a sound from Ms. Liu again,” said Pirraglia.

Shortly after 1 a.m., Liu interrupted her chat with Meng to answer a knock on her door at her Aldwinkle Heights basement apartment. She briefly spoke to a man, who tried to hug her, said Pirraglia.

The intruder forced his way into her home, closing the door behind him. He shoved Liu, “causing her to fall off camera in the direction of her bed,” said Pirraglia.

Meng saw the man return to the door, lock it, turn off the lights and the next time he appeared on the screen, “he was naked from the waist down, approached the computer and turned it off,” said Pirraglia.

The next morning, Liu’s landlord unlocked her door, discovered her “lifeless body located face down on the floor, a nightgown pulled up around her chest and she was naked from the waist down,” said Pirraglia.

Dickson, who matched the general description given by Meng to police, was interviewed by police a few days later. Dickson denied having any physical or intimate contact with Liu.

DNA samples taken from Liu’s breasts matched the accused’s DNA samples obtained from discarded cigarettes, court heard.

Manslaughter “lacks the level of intent required for murder,” she said.
It happens when death is caused unintentionally through an unlawful act like an assault, she said.
Second-degree murder is when the accused meant to cause the death or meant to cause bodily harm that he knew was likely to cause death and was reckless about whether or not it caused it, she said.
If the criteria for second-degree murder is met but the death occurred while a sexual assault was being committed or attempted, it is automatically considered first-degree murder, Molloy noted.

Little dignity for Qian Liu at ‘webcam murder’ trial: DiManno

Why it was necessary to leave the image of Qian Liu’s lifeless, exposed corpse on the monitor — dark hair fanning around her head, blood caked on her cheeks and encrusted on the floor, naked buttocks displayed — through much of the day is difficult to comprehend. Except if the objective was to sear that ghastly tableau in the jury’s mind, with a weeping mother and stoic father in the front row.

I guess Dickson got to see the image too. Hopefully he wasn't aroused when he was viewing it. Disgusting. JMO

How horrific.. I am wondering why the cause of death has been kept under wraps?.. Why would they do that?.. Or maybe I missed where it had eventually been stated what the actual cause of death was.. Seems odd that they'd be withholding the COD this late in the proceedings.. TIA.
 
COD is likely mechanical asphyxiation but the method cannot be determined.

But as Ms. Pirraglia told the jurors, there was no knife or bullet wound to the young woman, and even the experts she will call “don’t know exactly by what physical means her death was caused,” though she said the forensic pathologist formed the opinion that the cause of death was “mechanical asphyxia involving some form of neck compression.”

Closing arguments heard in 'webcam' murder trial

Brian Dickson has pleaded not guilty to first-degree murder in the death of the York University student from China, but his attorney Robert Nuttall has told the jury that his client never intended to kill Liu and thus should instead be found guilty of manslaughter. Nuttall told the jury that "murderous intent" had not been proven by the Crown beyond a reasonable doubt.

If the jurors do not believe Dickson unlawfully caused Liu’s death, they must find him not guilty.

If they do believe he unlawfully caused her death, they must ask themselves if he had the state of mind required for murder, Molloy said. If they do not believe Dickson meant to kill Liu, he is guilty of manslaughter.

If the jurors have answered yes to the two previous questions, they must consider whether Dickson sexually assaulted Liu, Molloy said. If their answer is no, he is guilty of second-degree murder, but if their answer is yes, they must consider the fourth question, Molloy said.

That question is: were the sexual assault and murder part of the same series of events? If the answer is no Dickson is guilty of second-degree murder.

But if the jury has answered yes to all four questions, Dickson is guilty of first-degree murder, Molloy said.
