LeAnna (Mom) #2

"This petition for divorce is not filled with venom. It doesn't accuse him of anything. All it says is our marriage is over and I want out," said Randall Kessler, an attorney who has been practicing family law for nearly 30 years.

According to the divorce filing, acknowledged by both Ross and Leanna, they were married in May 2006 and separated on June 18, 2014 -- the same day their son Cooper died...

Kessler says Leanna still maintains her right to remain silent about anything she and her husband discussed before and after Cooper's death.

I bet she's met someone else.

Wonder what took her so long. I'd have filed long ago, especially after all the pervy stuff was reported.

If she was involved in any way, or knew in advance what he was planning, she might have to walk softly in this. If he goes down for a long time and hears she is moving on with her life, he might decide to pull her down with him.
Maybe she has visited him in jail, and told him she was thinking of divorcing him OR he told her to do it.
Both of these two just seem off to me.
God bless little Cooper.

Anyone else as cynical as me? I think she is doing this right before the trial as a PR move, because everything Justin was doing will be exposed and she doesn't want it to affect her image? Or maybe she wants to repair her image? I think she is just waiting for a book deal or a chance to cash in on this situation.

Whatever her motivations, I feel they are self serving.

I agree that there's probably an ulterior motive. LE has dropped enough hints that I wonder if there's still a possibility she'll end up charged as an accessory.

As slimy as I'd feel doing it, I'd read a book if she wrote one!

The prosecution’s filing regarding the evidence it plans to show came days before Harris’ wife, Leanna Harris, filed for divorce. Her attorney, Lawrence J. Zimmerman, filed the paperwork, which alleges the Harrises’ marriage is “irretrievably broken,” and the two have been separated since his arrest and “continue to live in a bona fide state of separation.”

The divorce proceedings could play a role in Harris’ trial.

A spouse cannot be compelled to testify against their husband or wife, Cauthorn said, though the spouse is free to do so if they wish. That spousal privilege ceases, however, upon divorce.

But Cauthorn said communications between the two during the time of their marriage remain privileged even if a divorce is finalized.

“The spousal privilege against being compelled (to testify) terminates when the person is no longer a spouse, whereas the privilege with regards to inter-spousal communications does not terminate upon divorce, so that privilege exists even after the divorce,” he said. “There is historical reason for that, and that is there is no longer a marriage to be sanctioned and supported by the court system once the divorce takes place, therefore compelling to testify is not going to destroy the marriage because the marriage no longer exists. That’s why the law treats the compelling one way, and treats the inter-spousal communication privilege a different way.”

The only way I see her getting a book deal is if the trial is sensational and gets a significant amount of national coverage, but I think it is going to be overshadowed by the election.

Leanna could be forced to testify against her husband even if they are still married when the trial commences.

Marital privilege typically allows spouses to be exempt from testifying against each other in criminal trials. However, an exemption to that privilege in Georgia means Leanna Harris could be forced to testify against her husband because the victim in the case, Cooper, is under the age of 18.

I hope not to miss much of this Justice for Cooper trial. Is it obvious that this was a premed murder case given the internet searches? By both spouses, at the time b/c they are divorced now? A special last day breakfast at Chic-Filet. A moment, at the fork in the road, and RH took the road less traveled. A package of light bulbs tossed into the car after lunch to make sure his plan was working. Sexting like crazy back inside the office.

How could RH hop behind the wheel of his vehicle and just go to the movies? Ross drove off with a dead baby boy named Cooper, strapped tightly, inside Cooper's carseat that was inside his Daddy's hot car for over (7) seven grueling hours. Did that baby Cooper know his Daddy forgot him, while he was suffocating by inhaling intensively hot air and that dad wasn't coming back until it was too late? After fighting the oppressive heat by scratching off his skin and pulling his hair and tugging at his tiny clothes for a long time then, CH lapsed into unconsciousness and he never came back. It was too hot inside that car for Cooper when he realized his life was slipping away.

MSM states that RH had some legal motions ruled in his favor. There is plenty of evidence. LeAnna probably talked. That's why she's divorced and with the trial just beginning, it is interesting. What was her role in this awful way to die for CH. Bless his heart.

Here's the 100% Kicker of the Ironic Twist.
They are both leading child-free lives. LeAnna gets a divorce and takes her maiden name as if that entire chapter of her life with RH and their son, CH, is nonexistent. A couple of years have passed, LeAnna is back, who she was, before she met RH, only hopefully, she learned a yuge lesson. RH should rot in jail.

Did RH really think he'd get away with planning the murder and execution of his angelic child, Coop? RH should plead guilty for life and save the reputation and memory of his child, his marriage, his losses, and the planning the very death of his son, CH by throwing himself on the mercy of the court. Treat evil with goodness and mercy by locking RH away from everything normal. His proclivities make him a danger to the public and a peril to society.

All my own opinion based on facts and findings of the case and all that jazz!

There was a front page article about the case and upcoming trial in the Sunday edition of the Atlanta Journal Constitution. I will touch on a few statements Zimmerman, Leanna's attorney made.

Though they've never come out and said so, it appears prosecutors no longer believe she/Leanna was in cahoots with her former husband.

She has, however, been subpoenaed by the state. Perhaps to augment their contention that Harris killed his son in part because he wanted out of his marriage.

But, Zimmerman said his client, remains convinced Cooper's death was an accident.

Leanna is also expected to be called by the defense, which has already used testimony from some of the other women in Harris' life.

I have never heard of any of those cases except Brian Nichols. I didn't recognize the name, but the circumstances were familiar. I think Ross's case is already the most high-profile of them, but maybe locals disagree.

You must not watch any reruns of Dateline, 48 Hours, or 20/20 on ID channel. Fred Tokars is the only one of those I didn't know, and I live in CA. Lynn Turner was the predecessor to Stacy Castor, with antifreeze poisoning. Bart Corbin- dentist killed his wife and made it look like suicide, then they reopened the death of his girlfriend and discovered he shot her too. Brian Nichols was being escorted to court on rape charges, he overtook the female guard, took her gun and committed the murders, then broke into the apartment of a nearby woman and holed up overnight.

Usually I do not believe that women are involved in their partner's crimes. This case, though... I am really surprised how much evidence there is to support the theory that LH either knew what was going to happen or may have been involved. I am amazed that she is still defending him against all evidence that he is probably guilty. That victim impact statement really sealed it for me. Of course she took a lie detector and passed so she's been ruled out. Still, I cannot imagine losing a child, nor can I imagine losing a child in such a fashion that would bring me nightmares for the rest of my life. I also cannot imagine standing up in front of a televised funeral and telling the world I wouldn't want him back after knowing what he went through in his final moments. That's unconscionable to me.

Did she take a lie detector test? I hadn't heard that.

"I'm so glad he won't experience rejection in middle school, and the loss of his parents blah blah blah...but it doesn't bother me that what he did experience was horrifying terror as he got hotter and hotter and sweated so much his hair was still wet 7 hours later, and pulled some of his hair out and scratched skin off of his face...but that amazing husband of mine said he looked peaceful, like he was sleeping, with his eyes closed, so I believe him! Even though detectives say he did not look peaceful at all and his little blue eyes were open."
