[h=1]Legal move to keep Gerard Baden-Clay’s hands off Allison’s estate[/h]
A COURT has been asked to formally declare Gerard Baden-Clay has no right to more than $1 million from his murdered wife Allison’s life insurance and superannuation policies.

The notorious former real estate agent stood to reap the major windfall from his wife’s death as the sole beneficiary in her will.
But Allison’s father Geoff Dickie has asked the Supreme Court to declare Gerard “is not entitled to obtain or receive any benefit… from the death”.
If the court application succeeds, Mr Dickie will be appointed executor and Allison’s estate will go to the couple’s three daughters.

At first I thought Baden-Clod was pushing for it but upon reading it appears Mr Dickie is tying up any loopholes. IIRC Baden-Clod is doing a law degree in prison.

It will just need to be formally set up so this murderer does NOT get these funds. I am sure it will be okay. Mr. Dicky will get the funds for his granddaughters.

“Gerard is disqualified from acting as the executor of the estate because he has been convicted of murdering her,” Mr Dickie wrote in the documents submitted to the court.
The application is a formality and Baden-Clay would "not get a cent" following his conviction for his wife's April, 2012 murder in the couple's Brookfield home, a lawyer told the newspaper.

In documents filed last week, Mr Dickie told the court there was $236,505 sitting in an IOOF super account that had an added "crisis care" insurance policy.

The estate also includes two life insurance policies yet to be paid out – a TAL $434,069 policy and $348,497 from a Suncorp life insurance policy.

The money from the two policies has already been paid out but was placed in a trust until Baden-Clay's criminal proceedings and appeals were exhausted.

Baden-Clay removed from Allison's will

Gerard Baden-Clay won't be able to access any part of his murdered wife Allison's $1 million estate.
Her family on Thursday made an uncontested application for full administration of her estate, including life insurance and superannuation policies, which was granted by Brisbane Supreme Court Justice Peter Applegarth.
Allison's father Geoffrey Dickie has been made the sole administrator of her will and Baden-Clay, convicted of her murder in 2014, has been barred from receiving any benefit.
