The assistant prosecutor told the jury during opening statements that if either of the Ritchies had gotten medical help for Austin, he would have likely survived. She said that even though Anna told Ritchie that Austin was hurt, he never checked on him.
Robert Ritchie's attorney Frank Schiavone IV said his client wasn't even home for five hours, when Anna covered up what she had done. He claimed Ritchie had no idea about what had happened.
The jury then heard the 911 call from Robert Ritchie. Ritchie told the dispatcher his son was as "stiff as a board". Ritchie cried as the jury was shown a picture of Austin.
Robert Ritchie told Franklin Police Sgt. Shannon Cotton that he checked on his son by listening through the door. He told Sgt. Cotton that he had heard his son talking. Sgt. Cotton was the first witness to testify in the trial.
Franklin Fire Capt. Joshua Reed took the stand next. He testified that Austin was "cold and stiff" when he responded to the Ritchies home. He described seeing burns on Austin's legs and puncture wounds on his upper torso.

Anyone recall that as basis for mistrial? How ill was/is he? Any pic or vid of him in ct room? Emerging from ct room or bldg? TiA.

Are any of our Buckeye sleuthers close enough to attend, armed w Puffs tissues, aspirin, AlkaSeltzer, TUMs, etc, on standby, in case he sneezes or coughs, so mistrial is not declared again??? /sarc

The third trial of Robert Ritchie, the Franklin father charged in connection with his 4-year-olds scalding death, is scheduled to begin Monday, Aug. 21.
In March, a second mistrial was declared on the second day of trial when Ritchie became ill during the testimony of a doctor who performed his sons autopsy.
A Warren County judge ruled Tuesday that Robert Ritchies third trial would continue, despite issues with testimony after a clerical mix-up and objections by the defense.... Both sides agreed to a stipulation that the mistake will be preserved for appeal evidence.
During the coroner's testimony, Ritchie clutched a small book filled with Bible verses. He began shaking and crying while prosecutors showed autopsy photos.
Prosecutors were concerned and asked for a sidebar. The judge then asked jurors to take a break.
"This is part of the trial where its very difficult to observe the photographs, and I think your concern is Mr. Ritchie, the defendant in this case, is struggling at this point," Peeler said. "We had a mistrial because he was unable to maintain his composure in the last trial. We can't continue to repeat that."
After a warning, the trial continued.
When Anna Ritchie got Austin out of the tub, she said his feet were bleeding. She broke down when she described his injuries. That's when Robert started crying uncontrollably. The judge decided Robert could watch the testimony in judge's chambers so he wouldn't be a distraction.
A Warren County jury determined Robert Ritchie was at least partly responsible for his son Austin's death for failing to get him help after his wife put him in a scalding bath. They convicted him on involuntary manslaughter and child endangering charges after about two-and-half hours of deliberations.
me too. When I was 6 my mum had filled the sink with boiling water for me to wash my hands and face. She went to get soap and while her back was turned I climbed the vegetable rack and plunged my hands in up to my elbows.Thank God! This crime haunts me so much.
Robert Ritchie, 33, a manager at a Dollar General store with no criminal background, was sentenced to seven years in prison by Warren County Common Pleas Judge Robert Peeler after a jury found him guilty in August of involuntary manslaughter.
Ritchie asked the judge for mercy saying he wanted to honor Austin by becoming a minister.
“I want to do good in this world for my son. Something good has to come from this,” Ritchie said.
“You did not do this, but you could have prevented it,” Peeler said to Ritchie, asking “why didn’t you check on your son?”
During the sentencing hearing, those who wanted to see a longer sentence and those who hoped for parole spoke to the judge with polar opposite opinions on Robert’s responsibility.
“I wish I could say, ‘May God have mercy on your soul,’ but I can’t,” said Austin’s maternal grandmother, Sheri Gredig. “You’re destined for hell and the devil himself.”
More than a dozen of Robert’s friends and family came to show support for him.
“He did love Austin, he still loves Austin. He cries every day for the loss of Austin. He is not the monster he is portrayed to be,” said Robert’s aunt, Melissa Hobbs.
