Unfortunately, I’m not having success uploading SG’s documents. The pdf2jpg.net was a temporary storage site which expired after a few hours. I’m not able to get imgur.com to work for me in the manner that I uploaded KM’s documents. I keep getting an error message “Your Image Failed To Upload”.
I tried uploading KM’s documents again and that works, but SG’s documents don’t upload. Grrrr….
 
I comprehend better now. Thank you. It could work with the least educated and biased jury member. As soon as ABC flips and says something to the effect of XYZ told me to push the button on him so that RST will give 15K, the game is over.

IMO -

no. if SG (and KM) ultimately flip, CA can argue that the only reason he/they are flipping is to save his/their own hides and to cut sweet deals with the state like LR did.

I doubt that SG will flip. From what I've seen, he never had any direct contact with the A`s; all of the communication went through KM. Didn`t he tell the jailhouse informant that he wasn't going to let his lady take the rap for something he did? I don't think he'll rat on her, even at the risk of being convicted of first degree murder, partly because he loves her, partly because of his macho belief that real men protect their women.

May be Magbanua is the key for convicting Garcia?

On 4/6/2017, Judge HANKINSON denied Rivera’s request for money “ORDER DENYING DEFENDANTS MOTION TO INCUR COSTS FOR MITIGATION SPECIALIST”. It appears

RIVERA is still planning to mitigate his punishment. Why is RIVERA’s case still so active?

Isn’t it done deal that he has been sentenced?
May be the judge HANKINSON is overwhelmed by work load or other burdens, making the cases SLOW and denying the victim’s family the justice.

TALLAHASSEE, Fla. (WCTV) -- Sigfredo Garcia, the accused triggerman in the murder of Florida State University professor Dan Markel, was in court on Monday morning for a status hearing. The judge immediately rescheduled the hearing for later this month, saying he needs more time to consider evidence. Garcia is one of three people accused in the murder-for-hire killing back in 2014. Garcia's girlfriend, Katherine Magbanua, is also named as a suspect. Luis Rivera, another suspect in the case, accepted a plea deal and is serving 19 years in prison.
Garcia is facing the death penalty.

If he pleads guilty now to spare KM, and insists she had no foreknowledge of the hit, how would he be tied to DM's murder if he had no connection to CA? Would he owe the prosecutor and judge an explanation of how he drove 500 miles to target DM, a man he apparently didn't know?

Is SG's best strategy to plead not guilty in hopes he'll be found NG in a trial? But, how would that vindicate KM? She has already been linked to DM by LR, who has confessed and linked KM via the A's. Yet, if a court of law finds LR believable because he's aware of the connection between KM and the A's, then why wouldn't a court of law find LR believable when he confesses that he and SG committed the crime since he's aware of the connection between SG and KM, and between KM and the A's?

1. SG might not be pursuing a plea deal PRECISELY BECAUSE of the fact that he doesn't want to implicate KM. SG can't get a plea deal without implicating KM because the state would never accept it. the state will only accept it if SG agrees to be 100% truthful about the entire plot and ALL of the participants with no omissions. you can't get a deal by agreeing to just tell part of the truth - especially in a conspiracy case - you have to tell the WHOLE truth.
2. SG's defense will be the SODDI Defense ("Some Other Dude Did It") - perhaps blame it on LR?
3. KM's defense will be that she's just an innocent victim of an overzealous prosecution.
4. CA's defense will be that SG (or LR) heard of DM through KM second-hand and thus acted on his own without CA's consent or knowledge in order to ingratiate himself with CA. money was only paid because he was in fear for his life.
5. remember that all of these defense strategies will be argued independently of each other in each case so they don't have to match up.

I don't see any of these 4 scenarios being realistic.

Unrealistic if they attempt and no way they will win if they do.

Quite frankly, I don't see any reasonable or believable defenses for any of them.

Their (KM and SG) best bet is to make a deal and spill. Otherwise it will be the needle.

KM is not facing the death penalty.
Well then, it will be the bars. As in steel.

Also, if she really wants to come up with an alternate defense strategy she should consider Jose Baez.

to play devil's advocate -

i think CA can argue that - "yes, i bought KM a boob job and yes i gave her a bunch of money. so what? i was dating her at the time! of course i would do that - lots of boyfriends do! what she did with the money i can't be responsible for. did she give some to her baby daddy to help him out? maybe. but i had no connection to that decision. i just gave her some money to help her out."

the defense attorneys all have a hard job ahead of them but so does the state! i don't believe any of the remaining players will be pleading guilty and thus they need a defense strategy along with possibly alternate theories as to what could've happened. i think the defense strategies i listed are the best choices of a bunch of ugly choices. you don't get to litigate the case you want you have to litigate the case you've got. will they be effective? who knows? look at O.J., Casey Anthony, etc. anything is possible.
 
Despite the materials in the public domain that allude to probable cause, and strong statements from the police jurisdictions and the Adelson’s, this case appears to fold without the main characters who commandeered the hit. JMHO.

I recall reading Dan Markel’s obituary in the Emmanuel College Magazine, Vol. XCVII (2014-2015) p. 208. Prior to the arrests of Sigfredo Garcia and Luis Rivera. The original was from The New York Times (cf. below). I felt at that time that this case will be unsolved. Somehow, this morning, I feel the same way again. This case will fold without the main alleged characters by the Police theory, as the beneficiary of the contract killing, being taken to court.
“The affidavit further outlined investigators' theory that Markel's death was a contract killing, since neither of the accused knew Markel, and no property was taken. The motive was believed to be the desire of the family of Wendi Adelson, Markel's ex-wife, to allow her to relocate to the Miami area with the children. She had been granted 50-50 custody when the couple's acrimonious divorce had been finalized in 2013, when Markel had won an order prohibiting her from moving to Miami with the children. Markel filed a motion in 2014 that would have prohibited his mother-in-law from being alone and unsupervised with the children due to alleged disparaging remarks about their father. Investigators alleged Adelson's brother, who reportedly disliked Markel, was in a "personal relationship" with Garcia's ex-wife. Garcia's ex-wife was the first call Garcia dialed after Markel was murdered.”

Dan Markel, 41, a professor at the Florida State University College of Law and a leader in the world of online legal scholarship, was shot Friday morning in his home in an upscale neighbourhood of Tallahassee. The police, responding to reports of shots fired, found him wounded in his home; he died Saturday at a hospital. On Monday, chief Michael DeLeo of the Tallahassee police called the death a murder, and the department issued a statement saying that there was no indication of a robbery and that ‘it appears at this time that Mr Markel was the intended victim in this incident’. I think that the "slow downs" engineered by the defense, has put a damper on things. But not the public's interest in finding justice for Dan.

The two years that went by after the murder without any new info or arrests, and thinking the case had gone cold was over the day there was an arrest.

Interest is still high. Waiting is always the tough part.
