The prosecution is not allowed to call him. It is entirely up to the defendant if he wants to testify or not. And the jury is not allowed to judge him negatively, for not taking the stand.

If he testifies, he opens himself up to a withering cross by the state. Most murder defendants, innocent or guilty, are told not to take the stand by their defense.

Some do so anyway and it works for them. Many do so, and end up on death row. :jail:

Another theory mentioned somewhere else - - The defense attorney is trying to stall so she can carry over cross examination until tomorrow because she wasn't prepared for it today - thought BB would be on the stand today. Makes sense I guess
 
i have sort of lost respect for the judge in terms of what he is allowing here.

But, doesn't the judge have to allow it unless there is an objection from the state? I admit to not knowing TN law but seems to me in most courts of law the judge is there to keep balance, not to tell one side what they are doing is wrong...unless the other side brings it up.
 
This is frustratingly slow and redundant. I don't know how everyone in the courtroom hasn't pulled their hair out. He is simply saying the same stuff as earlier. If she is going to catch him in a lie, I wish she would just cut the chase and get to it already.
 
I disagree. I mean he has been nothing but cooperative in court. But all the vulgerness of what he calls her and how he speaks just naturally profane about her specifically....that was what I got out of this morning. Not him being polite about "Miss Bobo"

I think the reason he did that is he said exactly what he said back then including the vulgar words he used.

Yes, that is the way it is suppose to be. They have to object and the state is not going to object. They have to know this is not going well for the defense so they sure aren't going to object to any of it. The Judge may finally tell her to move on though or maybe not.

I am surprised she would think a dive bar wouldn't be open at 10 am. I have seen bars that open at 7 am....lol

Yep, and it's time to do that. I like this judge but he needs to ask the attorney where this is going and suggest she make her point before much longer. IMO.

Nevermind...looks like she has moved away from the maps now.
 
Oh ground breaking information....he use to meet with someone and do illegal stuff. No duh. He is an admitted criminal. Perhaps after today a certified cartographer.
