Yes. One of the subsections for 1st degree murder is for multiple victims. He also indicated that charges might change at grand jury.

Its a little confusing to me too on the 1st degree and 2nd degree charges. I think the charges will likely be modified once they are able to find more details. Seems 1st degree would be appropriate in all the murders.
 
What is a conflict defender? (Too lazy to Google.)

[FONT=&amp]Private attorneys may represent indigent clients in felony matters in local criminal courts where the concerned county public defender's office has a conflict of interest and cannot represent a client. Sometimes these attorneys are appointed by the concerned conflict defender offices in a county. For example in New York's Monroe County there is the Office of the Conflict Defender and Assigned Counsel Plan that has a panel of attorneys who may represent such litigants. Legal representation and a fair trial is ensured for these clients by the conflict defender's office. The assigned counsels may be private attorneys with panel membership. A court may order the appointment of a conflict defender for a litigant.

tl;dr If there is a conflict of interest with the public defender's office, the conflict defender takes over.[/FONT]
 
Legal Definition of Murder in New York and several other states:

Second Degree Murder: Any premeditated murder or felony murder that does not involve special circumstances.

First Degree Murder: Not only is the murder premeditated, but it also involves special circumstances, such as

- murder of a police officer, judge, fireman or witness to a crime;

- multiple murders; and

- torture or especially heinous murders.

Note that under this legal system, a "regular" premeditated murder, without such special circumstances, is not a first-degree murder
; nor are murders by poison or "lying in wait" per se first-degree murders.

To clarify, the prosecutor at the press conference said the charges presented at arraignment were the ones chosen by police for probable cause purposes, and that the single charge of 1st degree murder was under the subsection for multiple victims. He added that charges could change (as they often do) once the case is presented to a grand jury for indictment.

As someone else already noted, NY does not use the concept of premeditation to differentiate 1st and 2nd murder murder. Instead, an intentional homicide is 1st degree if one of several special circumstances is present, including multiple victims. Here's the statute if anyone is interested. There's a subsection for homicides committed in an "especially cruel and wanton manner pursuant to a course of conduct intended to inflict and inflicting torture." Murder for hire and the killing of a witness are also covered.
