GA - 2 corrections officers killed on bus, 2 inmates on run, Putnam Co., June 2017 *CAPTURED*

The lack of following procedure reminds me of nurses getting all bent out of shape because 'state inspectors' were coming. Well, if you're doing your job by the books all the time, you don't have to sweat when inspectors show up. Just keep doing what you've been doing. Always worked for me.

People just comfortable in their job, cut corners, and don't really think of why those rules were put into place to begin with.

No way I would want criminals in my vehicle without being properly secured. And leaving them on the bus with the door was not locked? Come on folks! Remember your loved ones, and do the job correctly!

Tragedy that could have been prevented. Saddened.

Death penalty trial date up in the air
In accordance with the Unified Appeals process, Bradley made it known in open court that the state is seeking the death penalty against Dubose and that the notice had been property filed with Putnam County Superior Clerk Sheila Perry.

“Judge, we want to do this very professionally; we want to do it one time and we want to do it right,” Bradley said.

When it comes to discovery in the case, Bradley pointed out that the prosecution team was going to give the defense team everything they had.
 
DA seeking death penalty against man accused of killing two officers
Donnie Russell Rowe appeared in Putnam County Superior Court for a preliminary hearing. Rowe is one of two men accused of killing Sgt. Christopher Monica and Sgt. Curtis Billue on a transit bus in June.

Court started promptly at 10 a.m. District Attorney Stephen Bradley notified Rowe that the state is seeking the death penalty in this case. Surrounded by officers, Rowe entered the courtroom wearing a white jumpsuit, handcuffs, and shackles.
 
Inmate pleads not guilty in slaying of 2 prison guards
A Georgia inmate has pleaded not guilty to killing two prison guards during a 2017 escape.

Defense attorney Adam Levin says the inmate, Donnie Rowe, would plead guilty if a prosecutor would agree not to pursue the death penalty.

However, District Attorney Stephen Bradley says execution is "the only just solution," according to The Atlanta Journal-Constitution .

"PUTNAM COUNTY, Ga. -- Ricky Dubose one of the men accused in the June 13, 2017 murder of two Georgia Department of Corrections officers was in court.

Dubose's defense pushed for the judge to make decisions before the case goes to a jury. His attorney asked judge Alison Burleson to rule on motions previously filed in the case.

The defense asked to prevent the prosecution from introducing non-statutory aggravating evidence including victim impact.

That motion said it's believed that the state will try to introduce evidence of Dubose's alleged prior criminal behavior and victim impact evidence at the trial...."

"EATONTON, Ga. — A judge has decided that Putnam County will be the site for the November death penalty trial of Donnie Rowe, an incarcerated state inmate accused of killing two corrections officers nearly two years ago during an escape from a prison transport bus.

Rowe will stand trial in the same county where the crimes took place on June 13, 2017....

Dubose’s death penalty trial is set for September of Brunswick, Ga. Ocmulgee Judicial Circuit Superior Court Judge Alison T. Burleson will preside over that case....

The judge said jurors for Rowe’s upcoming death penalty trial will be selected from Grady County.

Jurors will be brought to Putnam County to hear testimony and view the evidence in the case.

Trammell said she had not yet made a ruling on whether or not the jurors will be sequestered.

During the start of the hearing, which lasted less than 20 minutes, Trammell told prosecution and defense attorneys that they were getting close to the end of the motions that have been filed in the case....

Rowe death penalty trial slated for November

June 21, 2019

"...Another pre-trial hearing to discuss additional motions related to the capital murder case was held Thursday morning in Putnam County Superior Court in Eatonton before Ocmulgee Judicial Circuit Superior Court Judge Brenda H. Trammell.

Plans going forward are to begin jury selection process in Grady County on Monday, Oct. 28, Trammell said.

The judge said she had spoken with the chief judge in that circuit, and that everything had been lined up to begin jury selection and then transport the jurors to Putnam County to begin the trial of Rowe, one of two defendants accused in the shooting deaths of GDOC Sgt. Curtis Billue and Sgt. Christopher Monica. ...

Lavine said he and his co-counsel were not ready to try the case yet and said he didn’t anticipate, constitutionally speaking, being ready in November.

The other co-defendant in the case, Ricky Dubose, is charged with the same crimes as Rowe and will be tried first in a separate trial. Dubose’s trial will be held in Brunswick beginning Sept. 30. Ocmulgee Judicial Circuit Superior Court Judge Alison T. Burleson will preside over that trial.

The latest hearing involving the Rowe case lasted only a half-hour and included prosecution and defense attorneys once again discussing outstanding motions related to the case.

They did not argue any of the motions during the public portion of the hearing.

Motions brought up at the hearing included:

Motion No. 41 - To bar unconstitutional convictions and bad acts.
Motion No. 30 - To prohibit non-statutory aggravators.
Motion No. 46 - To preclude the admission of gruesome photographs and highly prejudicial photographs.
Motion No. 47 - To preclude judicial security measures.
Motion No. 101 - For district attorney to reveal acquisition of medical records.

Several of the motions are expected to be argued by attorneys during Rowe’s next hearing date, which is set for July 12."

From television news, WSBTV Channel 2 - eight of the inmates that were traveling on the bus have filed a Federal lawsuit lawsuit claiming physical and psychological damages. The inmates attorney said that the officers did not follow protocol.

"All eight are represented individually by Kennesaw attorney Ted Salter, who is seeking jury trials and at least $250,000 for each man.

“People died because of stupid mistakes,” Salter said Wednesday afternoon. “It was just unbelievable the number of things that all came together at once and all could have been avoided if the people who were calling the shots had done their jobs.”"

Timothy Dotson, Timothy Faison, James Geiger, Timothy Ghiden, Samuel Moss, J.D. Powell, Dennis Roberson, and Christopher Trammell all filed lawsuits against the Georgia Department of Corrections and some state prison officials. All eight are represented by Theodore Salter, a Kennesaw lawyer.

According to the eight separate lawsuits filed in May and early June in the U.S. District Court in Macon, the inmates claim their civil rights were violated during or after the shooting deaths of corrections officers Curtis Billue and Christopher Monica....

The lawsuits blame the Georgia Department of Corrections, saying they failed to follow procedures..."

"EATONTON, Ga. — Franklin J. Hogue, who has represented several defendants in death penalty cases, announced Friday morning that he is the new lead defense attorney for Donnie Rowe, a state inmate accused in the killings of two state corrections officers more than two years ago in Putnam County....

Hogue, a well-known criminal defense lawyer from Macon who also teaches about the death penalty, told Ocmulgee Judicial Circuit Superior Court Judge Brenda H. Trammell that he had agreed by request to come onto the case as lead counsel....

The judge asked Hogue if it was his testimony that he could be prepared for trial at that time.

“Well, yes and no,” Hogue replied. “If the court requires us to start the trial then, I will be here to do my best.”

He said that he could be present when the court requires him to be, but “no, we will not be ready for trial on Oct. 28.”..."

Corrections official testifies about Dubose

"EATONTON, Ga. — A state corrections official testified Tuesday afternoon in Putnam County Superior Court in Eatonton that there have been several disciplinary problems with Ricky Dubose since he has been incarcerated.
Ahmed Holt, who serves as field director of operations for the Georgia Department of Corrections, said various behavioral incidents had resulted in Dubose being moved to Special Management Unit or what he called SMU.
Two such incidents involved Dubose reportedly throwing urine on a corrections officer, and later setting fire to his cell....

Pre-trial hearings are underway this week for both men.

Ocmulgee Judicial Circuit District Attorney Stephen A. Bradley is seeking the death penalty against both Dubose and Rowe – both of whom are slated for separate trials later this year. The district attorney is being assisted in the prosecution of the two men by Chief Assistant District Attorney Allison Mauldin, and Assistant District Attorney T. Wright Barksdale.

Jurors for both trials will be selected respectively from Glynn and Grady counties, but both trials will be held in Putnam County....

The assistant district attorney specifically asked Holt about the use of stun cuffs.

Barksdale asked Holt if it would be his recommendation that stun cuffs be placed on Dubose during the course of his upcoming trial to prevent any threat to any court officials, law enforcement officers or anyone in the courtroom.
Holt said he would recommend that stun cuffs be used in the Dubose case, because he considered Dubose to be a high-risk inmate....

Pre-trial motions will once again be taken up on Wednesday morning in the Dubose case."

"EATONTON, Ga. — Defense attorneys for Ricky Dubose and Donnie Rowe argued in an unprecedented pre-trial hearing Thursday before two judges that grand jury indictments should be dismissed against their clients.

Separate death penalty murder trials have been set for later this year for Dubose and Rowe in Putnam County Superior Court in Eatonton. The two prison inmates are accused of shooting to death Sgt. Curtis Billue and Sgt. Christopher Monica, both officers with the Georgia Department of Corrections, during an escape from a state prison transport bus outside Eatonton on June 13, 2017....

The joint appearance by Dubose and Rowe was the first time since they have appeared together in court since they were recaptured and transported from Rutherford County, Tennessee after their daring daylight escape and the nationwide manhunt that lasted three days.

Both defendants pleaded not guilty to felony charges against them.

Ocmulgee Judicial Circuit District Attorney Stephen A. Bradley objected to Thursday’s joint hearing before Superior Court Judges Alison T. Burleson and Brenda H. Trammell. Bradley contended that the pretrial hearings should be held separately. Despite his objection, the joint hearing went on as planned.

Burleson is overseeing the Dubose case, which is scheduled for trial on Sept. 30 in Putnam County Superior Court....

During the joint pre-trial hearing, Pittman and Levine asked the respective judges in their cases to “quash” the indictments against their clients.

Defense attorneys contend that the indictments should be dismissed because of the unconstitutional composition of the grand jury, among other reasons....

Putnam County Superior Court Clerk Sheila H. Perry, along with Grady County Superior Court Clerk Debbie Kines testified at Thursday’s hearing concerning how grand jury lists are comprised.

Another witness called to testify during the hearing was Jeffrey Martin, classified as an expert witness. He is a well-known mathematician and consultant on jury pools and statistical issues and lives in Atlanta.

Both defendants were seen writing notes at various times during the day-long hearing, amid the presence of heavy security from members of the Georgia Department of Corrections Interdiction Response Team, as well as deputies and detectives from the Putnam County Sheriff’s Office."

"Just a few weeks after his co-defendant was granted a continuance, Donnie Rowe’s attorneys filed for a continuance for his trial, and it was granted Friday, Aug. 31, according to court records.

Rowe and Ricky Dubose are facing the death penalty in Putnam County, being charged in the shooting murders of Georgia Department of Corrections officers Sgt. Curtis Billue and Sgt. Christopher Monica. The slayings happened in June 2017.

They are being tried separately, with the original plans to have Dubose’s trial begin the end of this month and Rowe’s was to begin the end of October. On Aug. 6, Ocmulgee Judicial Circuit Superior Court Judge Alison T. Burleson granted a continuance for Dubose’s case. The trial will be held in Putnam County at a yet-to-be-determined date, with jurors coming in from Glynn County.

On Aug. 31, Rowe’s attorneys, Franklin J. Hogue of Hogue & Hogue in Macon, and Adam S. Levin and Erin Wallace, of the Georgia Capital Defender Council, filed a motion for continuance, which means a request to postpone, Rowe’s trial which was slated for Oct. 28.

The reasons listed for the motion and need to postpone include more time is needed to investigate, interview witnesses and secure additional records...."

Testimony offers insight into jury process in Grady Co.

"EATONTON, Ga. — Expert testimony during Tuesday’s pre-trial capital murder hearing for Donnie Rowe offered insight into the way jurors are drawn in Grady County

Jeffrey Martin, an Atlanta resident, considered an expert on jury pools and statistical data issues, testified for the defense team in Putnam County Superior Court....


In an unrelated matter, during a break period, Bradley and Hogue discussed crime scene photographs that were taken of Sgt. Billue and Sgt. Monica onboard the state prison transport bus where they were slain.

The two men later talked about the photographs near the bench where Trammell sat.

Hogue objected to several of the crime scene photographs, as well as autopsy photographs.

Bradley described many of the photographs as graphic and disturbing.

When that was mentioned, members of both officers’ families left the courtroom, but returned a few minutes later after the discussion about the photographs had concluded.

Trammell reserved making any immediate ruling on the motions she heard Tuesday. "

I think it’s pretty absurd that his officers didn’t follow protocol and their actions led to their own deaths and endangered the lives of thousands of people.
