GUILTY TX - Haruka Weiser, 18, found murdered, UT-Austin campus, 3 April 2016 *Arrest*

Megan Menchaca‏ @meganmenchaca13 3h3 hours ago
We're now hearing from Aaron Wernsman, a fire specialist with the Austin Fire Department, who responded to a call at the abandoned building on April 4 (the day after Weiser's death) and found Meechiael Criner burning items.

Ryan Autullo‏ @AutulloAAS 3h3 hours ago
Another issue: Documents Criner said he had with him at the jail related to the case are still missing. Wahlberg's court coordinator is planning to speak with Sheriff Sally Hernandez to see if they can track down the papers. Wahlberg is concerned by this.

Ryan Autullo‏ @AutulloAAS 3h3 hours ago
Firefighter who reported to the building, Aaron Wernsman, testifies that the man prosecutors say is Criner was "extremely polite." So Wernsman made calls to set him up with a place to stay.

Ryan Autullo‏ @AutulloAAS 2h2 hours ago
Criner had a red bike with him that could not fit in police car that took him to LifeWorks. So firefighters took it to the fire station for him to pick up later. Note taped to bike says: "Bike belongs to: Meechaiel Criner (sp?). he will pick up. Light Box on Medical Arts."

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
Wernsman said after he picked up a red bicycle from the scene, he took it to the fire station that he worked at. He then wrote a note on it that said “Bike belongs to Meechaiel Criner. He will pick up."
-------------------------------------------------------------------------------------------------------------------------------------------------

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
A few days later, Wernsman then said he watched the first clip in this Youtube video of a press conference held by the Austin Police Department . He said he "immediately believed" the person in the video was the same person he had seen at the fire.

----------------------------------------------------------------------------------------------------------------------------------------

Ryan Autullo‏ @AutulloAAS 2h2 hours ago
Wernsman says he had a "reaction I've never had before" when he saw surveillance video on news of suspect in Weiser's death. "I could feel from my toes to the top of my head ... I knew the individual on the video and it was the individual I encountered at Medical Arts Building.

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
He said his belief that the person in the video and the person he picked up was based on the physicality of the individual in the video as well as the type of the bike in the video. He said two other individuals in the Austin Fire Deparment also agreed they were the same person.

Ryan Autullo‏ @AutulloAAS 2h2 hours ago
Wernsman says two other members of the fire department agreed the suspect riding a bicycle on the video was the same person they encountered at the abandoned building. Police say the individual put bike on kick stand and followed Weiser down path where she was killed.

Ryan Autullo‏ @AutulloAAS 2h2 hours ago
Next to testify is firefighter, John Bass, who works at Station 3 north of campus.

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
Now we're hearing from John Bass, a firefighter with the Austin Police Department, who also responded to the same call as Wernsman.

Ryan Autullo‏ @AutulloAAS 2h2 hours ago
Bass said when he reported to building he discovered a fire in a makeshift brick pit. Among items in the pit was a half-burned black leather boot and a notebook with some math problems. Weiser was wearing black Doc Martens on the night she died. She was taking a Calculus course.

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
Bass said he found three bicycles, a black half burnt leather boot, and a notebook that contained some math problems at the abandoned building. Weiser's friends tesified yesterday that Haruka was taking a math class and was wearing all black before her death.

Ryan Autullo‏ @AutulloAAS 2h2 hours ago
Looking at surveillance video of man walking bike, Bass says he recognizes bike - down to tubes and handlebars - and man as the same bike and man he encountered at abandoned building. Again, police say man on bike is Criner and that he followed Weiser down trail where she died.

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
Bass said he also watched the surveillance video and recognized the bike. He said the shape of the frame of the bicycle in the video immediately caught his attention as the same bike from the abandoned building.

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
CORRECTION: Weiser's friends testified Wednesday, not yesterday.
-------------------------------------------------------------------------------------------------------------------------------

Ryan Autullo‏ @AutulloAAS 2h2 hours ago
Now hearing from Austin Police officer Nick Garcia, who was patrolling the UT area in April 2016 and assisted fire department on call to abandoned building where man believe to be Criner was found.

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
The next person to testify is Nick Garcia, who has been a Austin Police officer for 18 years. He also responded to the same scene.

Ryan Autullo‏ @AutulloAAS 2h2 hours ago
Garcia says Criner was not arrested for trespassing because building owner just wanted him to leave. There was no damage to building. Criner got into the patrol car, uncuffed, and Garcia took him to LifeWorks youth shelter..

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
The prosecution was about to introduce video of Garcia picking up Criner from the building. The defense asked Garcia if Criner consented to the search conducted. When Garcia was unsure, the judge quickly dismissed the jury to discuss whether the video is admissible.

Ryan Autullo‏ @AutulloAAS 1h1 hour ago
Outside of jury presence, lawyers are arguing over admissibility of dash cam video from when APD's Garcia searched Criner for weapons before taking him to LifeWorks.

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
According to the arrest affidavit, the video that these attorneys are currently debating shows a bag in Criner's possession that was identified by Weiser's friends as belonging to Weiser.

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
The defense is saying that when the police officer searched the items in Criner's possessions, it was an illegal search. The prosecution says the search was done for safety reasons. The police officer also says the search is standard procedure.

Ryan Autullo‏ @AutulloAAS 1h1 hour ago
Among Criner's possessions is a blue and red duffel bag consistent with the bag Weiser's friends said she had with her on the night she was killed.

Ryan Autullo‏ @AutulloAAS 1h1 hour ago
Wahlberg DENIES defense motion to suppress evidence related to dash cam video that shows blue and red duffel bag consistent with the one Weiser owned. Officer will testify before jury that when looking through Criner's bags he found an Apple laptop. Prosecutors say it was Weiser.
---------------------------------------------------------------------------------------------------------------------------------------------------------

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
Currently being shown dash cam footage, which shows Criner put about five bags on the car. One of these looks to be a large nondescript blue duffel bag with clear red handles/straps. The other bags include a grey backpack and a large green bag obstructing most of the activity.

Megan Menchaca‏ @meganmenchaca13 2h2 hours ago
Garcia says Criner is in the car while another officer looks through the bags on video. These bags include a camo bag, a grey backpack and another bag. The officer is going to say he saw a silver laptop during the search. Defense's objection to this testimony is overruled.

Ryan Autullo‏ @AutulloAAS 1h1 hour ago
Back from morning break, we're about to start up again with testimony from Officer Garcia. The dash cam video the rest of us saw before break will now be presented to the jury.

Megan Menchaca‏ @meganmenchaca13 1h1 hour ago
We're about to be shown the same video again that I tweeted about just a few minutes. This time it will be in front of the jury.

Megan Menchaca‏ @meganmenchaca13 57m57 minutes ago
Now we're seeing a video of the backseat of the police car. An individual who Garcia says is Criner sits in the back seat at around 9:00AM with what appears to be a green bag and a piece of paper that he folded as he got into the vehicle.

Megan Menchaca‏ @meganmenchaca13 47m47 minutes ago
Garcia has just finished testifying. Now we'll hear from his partner, who conducted the search of Criner's bags.
-------------------------------------------------------------------------------------------------------------------------------------------------------

Ryan Autullo‏ @AutulloAAS 44m44 minutes ago
We now move on to another member of APD, Officer Marco Gonzalez. He joined Officer Garcia at the Medical Arts Center and searched Criner's belongings for weapons before transport to LifeWorks.

Ryan Autullo‏ @AutulloAAS 38m38 minutes ago
Gonzalez says he became impatient and threatened to file trespassing charges when Criner took his time picking and choosing what items to bring from abandoned building to LifeWorks. "Very long delay."

Megan Menchaca‏ @meganmenchaca13 7m7 minutes ago
Garcia's partner, Marco Gonzalez, searched all of the bags found in Criner’s possession. He said he found a silver laptop in a bag during his search

Ryan Autullo‏ @AutulloAAS 13m13 minutes ago
Gonzalez says he discovered a Macbook computer in a bag Criner was carrying. He found it odd a homeless person could afford such an expensive item but "you're not here to judge, you're here to help." Prosecutors believe laptop was Weiser's and was identified by Portland sticker.

Ryan Autullo‏ @AutulloAAS 2m2 minutes ago
Gonzalez is off of the stand and the trial is in recess for lunch until 1:45 p.m.

THREAD: Today is the end to the first week of the trial for Meechaiel Criner, charged with capital murder in connect to the death of Haruka Weiser. After today, prosecutors will have exactly one more week to prove their case before the jury deliberates.

Megan Menchaca‏ @meganmenchaca13 9h9 hours ago
Gonzalez has just finished testifying. We're on a lunch break and the jury will be back at 1:45. But court will proceed earlier than that to discuss Tynes' testimony. The judge says we're going to end proceedings today around 5PM.

Brittany Glas‏ @BrittanyGlasTV 7h7 hours ago
Court is back in session, but without the jury at this point. Attorneys are making their case to Judge David Wahlberg concerning standing and privacy at the vacant building where Criner was staying. @KXAN_News

Megan Menchaca‏ @meganmenchaca13 7h7 hours ago
Detective Tynes is now going to answer questions, NOT in front of the jury, about the day he came to 2911 Medical Arts St. Tynes has testified everyday of the trial thus far. The defense is attempting to suppress the testimony he is expected to give today.

Brittany Glas‏ @BrittanyGlasTV 7h7 hours ago
Concerning an expectation of privacy... how long does Criner get that privacy at the scene of the fire where he left his belongings for 3 days, the state poses the question to the judge. @KXAN_News

Megan Menchaca‏ @meganmenchaca13 8h8 hours ago
Tynes said he reached his hand through a broken window and unlocked the deadbolt from the inside. He said he did not have a search warrant when he did this, but instead assessed the room and sought "legal counsel" to enter.

Megan Menchaca‏ @meganmenchaca13 8h8 hours ago
Prosecution is objecting in the strongest of terms to the interrogation of Tynes. The judge is considering the objection, but allowing the defense to continue their questioning The defense says Tynes' search was a violation of the defendant's 4th Amendment rights.

Megan Menchaca‏ @meganmenchaca13 7h7 hours ago
I want to add, after police found the individual in the abandoned building, they put some of his stuff in a trash can and put it @ a bottom of a staircase for the individual to collect later. When police officers came back to the building a few days later, they seized the items.

Brittany Glas‏ @BrittanyGlasTV 7h7 hours ago
Judge David Wahlberg denied the defense's motion to suppress the evidence taken from the scene of the vacant building fire AFTER Criner left his belongings there when he went to the youth shelter. That's extra evidence for the state to utilize in their case. @KXAN_News

Megan Menchaca‏ @meganmenchaca13 7h7 hours ago
The judge has DENIED the defense's motion to suppress the testimony about the collection of the items inside the building by the police officer. Now they're discussing the motion to suppress items found in the trash can. (i.e. a black leather boot).

Brittany Glas‏ @BrittanyGlasTV 7h7 hours ago
APD detective testifies about the Doc Martin boot found at the scene of the vacant building fire, trash -- the shoe had been burned, he says. He says he knew that this was related. @KXAN_News

Brittany Glas‏ @BrittanyGlasTV 7h7 hours ago
APD Detective: "This was possibly her property." Doc Martin boot, notebook found in the trash at the vacant building where Criner was staying, where Criner had started a warming fire on the morning of April 4, 2016 -- the morning after Weiser was last seen alive. @KXAN_News

Brittany Glas‏ @BrittanyGlasTV 7h7 hours ago
Clothes, sizes of clothes, found in the trash were "consistent" with what APD detective said he believed Weiser would wear. @KXAN_News

Brittany Glas‏ @BrittanyGlasTV 7h7 hours ago
"In my mind this was an exact match" of what I saw the suspect wearing in the video, APD detective says regarding a JOE ROCKET motorcycle' jacket. @KXAN_News

Brittany Glas‏ @BrittanyGlasTV 7h7 hours ago
Bottom of trash can -- roll of duct tape, clothes, black turtleneck with "sandy consistency." @KXAN_News

Brittany Glas‏ @BrittanyGlasTV 7h7 hours ago
Bottom of trash can, also -- plaid boxer shorts in the same condition -- damp with sandy residue, a lime green t-shirt with the sleeves cut off, inside out. @KXAN_News

Megan Menchaca‏ @meganmenchaca13 7h7 hours ago
The judge is also DENYING the defense's motion to suppress evidence from the trash can. Tynes will now testify about all of his actions at the abandoned building to the jury, as previously planned.
--------------------------------------------------------------------------------------------------------------------------------------------

Brittany Glas‏ @BrittanyGlasTV 7h7 hours ago
APD detective talks now about additional evidence found beside the trash can. @KXAN_News

Megan Menchaca‏ @meganmenchaca13 7h7 hours ago
The prosecution is now showing photos taken by the detective near the storage room mentioned yesterday. The photos show at least one condom package found at the location.

Megan Menchaca‏ @meganmenchaca13 7h7 hours ago
The detective tells the jury that he observed as a Doc Martin boot in a cardboard box in a trash can at the abandoned building where Criner was found. Also in the box is what appears to be a composition book and another black article of clothing.

Megan Menchaca‏ @meganmenchaca13 7h7 hours ago
The black Doc Martin boot is more than halfway burned. The black article of clothing in the box appears to be black leggings which are slightly sandy.

Brittany Glas‏ @BrittanyGlasTV 7h7 hours ago
Cell phone case found on the ground outside the rear door of the vacant medical arts building. @KXAN_News

Megan Menchaca‏ @meganmenchaca13 7h7 hours ago
The next "layer" of items in the trash can include a motorcycle jacket with "patches" on the shoulders. Very similar to one seemingly being worn by the suspect in the previously introduced surveillance videos.

Megan Menchaca‏ @meganmenchaca13 7h7 hours ago
They're now showing a sandy black turtleneck, a large male black shirt that is sandy with the sleeves cut off, sandy and plaid boxer shorts, a lime green t-shirt, AND an orange bandana. An orange item was worn around the suspect's neck in the yesterday's surveillance videos.

Megan Menchaca‏ @meganmenchaca13 7h7 hours ago
All of these clothes found in the abandoned building where Criner was previously picked up by police are INCREDIBLY similar to clothes that either Weiser's friend's said she was wearing the night she died or clothes worn by the suspect seen in the surveillance video.

Brittany Glas‏ @BrittanyGlasTV 5h5 hours ago
Also seen, shown as evidence this afternoon -- hair found on one of the shirts found in the trash, this was one of the concerns for the state had the defense's motion not been denied. @KXAN_News
-------------------------------------------------------------------------------------------------------------------------------------------------

Megan Menchaca‏ @meganmenchaca13 6h6 hours ago
The final witness, Jennifer Aguirre, a crime scene specialist with the Austin Police Department has taken the stand. She has been a specialist for nearly 22 years and 900 hours of formal classroom training.

Megan Menchaca‏ @meganmenchaca13 6h6 hours ago
Aguirre is about to show the jury evidence collected from the abandoned building, which included the burnt black shoe. Tynes said during his testimony that this was a Doc Martin shoe, which Weiser's friends say she was wearing during the night of her death.

Megan Menchaca‏ @meganmenchaca13 6h6 hours ago
We've got, from what I can tell, all of the evidence that I previously mentioned was found at the scene is currently in the court room being shown to the jury. When Aguirre takes some of the evidence out of her bags, some of them are spilling sand on the floor and table.

Megan Menchaca‏ @meganmenchaca13 5h5 hours ago
Aguirre says that in the pockets in a sweater found at the scene has a receipt with Haruka Weiser's name. I also believe Aguirre said the receipt was dated a few days before April 3.

Megan Menchaca‏ @meganmenchaca13 5h5 hours ago
Aguirre said the writings in a notebook that she collected from the abandoned building had what she believed were Calculus notes inside of it. Weiser was taking a Calculus class in Spring 2016.

Megan Menchaca‏ @meganmenchaca13 5h5 hours ago
Now the gallery is seeing burned pages, allegedly taken out of the Calculus notebook. The only visible text is "4sinx + 6cos." There is also a piece of paper that says "How to fFail Physics" inside of a notebook. Inside of the notebook is Meechaiel Criner's name, dated in 2015.

Megan Menchaca‏ @meganmenchaca13 5h5 hours ago
The green shirt previously mentioned has the logo of an eagle on it. We are now being shown the receipt with Weiser's full name on it, dated March 27. It is a receipt from Jester City Limits with the words baked chk plate and eco nickel on. Total is 5.94.

Megan Menchaca‏ @meganmenchaca13 5h5 hours ago
Reminder: all of these were collected from the abandoned building. Now the jury is being shown the red bike that was collected from the firehouse by Aguirre after investigators collected it from the abandoned building.

Brittany Glas‏ @BrittanyGlasTV 5h5 hours ago
The red bicycle Criner had at the vacant building is now being unwrapped and taken out of its evidence box in front of the jury. It took a number of staff to unwrap it. @KXAN_News

Brittany Glas‏ @BrittanyGlasTV 5h5 hours ago
The APD crime scene analyst testifying says the red bicycle with curved handlebars was collected from the fire station. @KXAN_News

Megan Menchaca‏ @meganmenchaca13 5h5 hours ago
The bike has its handlebars wrapped with plastic. It also still has the note written by the firefighter. I can't see the note, but the firefighter previously testified that it said “Bike belongs to: Meechaiel Criner (sp?). He will pick up.”

Brittany Glas‏ @BrittanyGlasTV 5h5 hours ago
No further questions for her from the state. Judge David Wahlberg announces court recess for the day. Says trial will resume Monday morning. Asks the jury to arrive by 830 a.m. to get started by 8:45 a.m. @KXAN_News

Aguirre is clarifying her testimony from Friday, explaining the techniques she used, including the usage of UV lighting and LCV chemicals, to look for blood and other various substances at the crime scene she examined.

Ryan Autullo‏ @AutulloAAS 10m10 minutes ago
We begin week two of Meechaiel Criner's capital murder trial with testimony from an APD Crime Scene Specialist. We're going over blood stains on the boulders along Waller Creek where Haruka Weiser's body was found.

Megan Menchaca‏ @meganmenchaca13 12m12 minutes ago
Aguirre is still clarifying her testimony, explaining that all of the items found in the abandoned building were all "damp and sandy." Prosecutors implied Friday that the sand was from Waller Creek. The defense is implying now that the sand was from the trash can.
-------------------------------------------------------------------------------------------------------------------------------------------------

Ryan Autullo‏ @AutulloAAS 8m8 minutes ago
Defense lawyer Ariel Payan questioning crime scene specialist about dirt/sand on bottom of trash can where items were found at vacant building. Last week, APD detective said sandy items came from sandy area on creek where Weiser was found. Payan offering different explanation.

Megan Menchaca‏ @meganmenchaca13 15m15 minutes ago
Defense attorneys are now questioning the relevance of the condom, found near the storage room where Criner was seen before Weiser's death. Aguirre says there was also a tequila bottle and a cigarette butt. Defense is implying that this means the condom was left by someone else.

Megan Menchaca‏ @meganmenchaca13 11m11 minutes ago
Prosecution is now looking back at photos taken of the storage room (with all of the stuff in it) hours before Criner was found. There is also condom wrapper in there, that looks incredibly similar to the one found by Aguirre a few days later near the storage room.

Megan Menchaca‏ @meganmenchaca13 10m10 minutes ago
Aguirre has finished testifying. The next witness is Tyrik Patterson. He is/was a UT Austin dance student who was friends with Haruka Weiser.
---------------------------------------------------------------------------------------------------------------------------------------------

Ryan Autullo‏ @AutulloAAS 8m8 minutes ago
Now hearing from Tyrik Patterson, former dance major at University of Texas and classmate of victim Haruka Weiser. Patterson left the Winship Building around the same time as Weiser on the night Weiser was killed.

Ryan Autullo‏ @AutulloAAS 6m6 minutes ago
Patterson and Weiser left the building at the same time but departed within 20 feet of leaving, he says. He went right into the student union and kept walking along Gregory Gym. Weiser went down pathway behind alumni center.

Megan Menchaca‏ @meganmenchaca13 31m31 minutes ago
Patterson was in production lab on the same day as Weiser and left the Drama Building at the same time as her on April 3, 2016 He said they separated as he went in front of Gregory Gym to get back to Jester Dormitory, while Weiser went through a pathway by Waller Creek.

Megan Menchaca‏ @meganmenchaca13 27m27 minutes ago
The defense attorney asked Patterson what Weiser was wearing. He mentioned a long sleeve shirt, tights, and glasses, which are going to be a point of contention during the rest of the trial today.
