GUILTY TX - Haruka Weiser, 18, found murdered, UT-Austin campus, 3 April 2016 *Arrest*

Alyssa Goard‏ @AlyssaMGoard 23s24 seconds ago
Payan is going over the area where Weiser was found now. Explains that because the creek is hard to get to, it would be tough to push a bike down the path the prosecution suggested, especially for someone new to Austin who’d likely never been to that creek before

Molly Oak‏Verified account @MollyAndAMic 1m1 minute ago
"The killer would want to go this way." Defense showing jury the path. He asks why the killer would choose to take the tougher way as opposed to the easier one.

Molly Oak‏Verified account @MollyAndAMic 2m2 minutes ago
Defense now talking about the "apparent blood trail" and the crime scene. Defense says this shows us Weiser was attacked on the path. Says she was rendered unable to resist almost immediately, but says "we don't know how"

Alyssa Goard‏ @AlyssaMGoard 42s43 seconds ago
He talks about the boulders, one where blood was found and one where Weiser’s body was found behind. “Whoever did this knew this was here, knew these rocks were here, left her right where he wanted her” Payan said

Megan Menchaca‏ @meganmenchaca13 2m2 minutes ago
Payan is saying Criner was unfamiliar with Waller Creek and therefore would not have been able to take Weiser with him to navigate through the rocky terrain.
----------------------------------------------------------------------------------------------------------------------------------

Molly Oak‏Verified account @MollyAndAMic 23s24 seconds ago
Getting into the boulder and the placement of the body more. "This is a treacherous area, if you're not aware of it." Asking jury, "Again, how does he know it's there? In the pitch dark, how does he know it's there?...You have to know it's there to take it there."

Alyssa Goard‏ @AlyssaMGoard 3m3 minutes ago
Payan points out there was no blood on Weiser’s clothes, tells jurors they would have heard about it right now if her clothes were bloodied. So he believes Weiser’s head wound came after her clothes were removed

Molly Oak‏Verified account @MollyAndAMic 29s30 seconds ago
I BELIEVE this is defense referencing that Criner was new to Austin at that point. They previously asked the jury how many of them knew about the area.

Ryan Autullo‏ @AutulloAAS 2m2 minutes ago
Payan says lack of blood on Weiser's clothes shows she was stripped nude before major blows to her head. He said only someone familiar with the creek would be able to find boulders where Weiser's body was placed. He's suggesting Criner was not familiar with it.
---------------------------------------------------------------------------------------------------------------------------------------------------

Alyssa Goard‏ @AlyssaMGoard 5m5 minutes ago
Payan mentions other items of clothing found near the body, underwear, a shirt and other things, that the jury weren’t presented as evidence. Mentions that many items were noted & not collected and many were collected & not tested

Ryan Autullo‏ @AutulloAAS 4m4 minutes ago
Payan appears to be suggesting bloody bra at the scene did not belong to Weiser. We heard in testimony that it was the same size she wears.

Molly Oak‏Verified account @MollyAndAMic 2m2 minutes ago
Defense bringing the bloodied bra into question: says neither of the two types of bras seen in Haruku's drawer match the bloodied bra he says was found 35 yards south of the body.

Ryan Autullo‏ @AutulloAAS 3m3 minutes ago
Payan: "If it's her bra, the hammer's important, the glasses are important. If it's not her bra, the body is 35 feet south." He says bra does not match the ones she owned.

Molly Oak‏Verified account @MollyAndAMic 3m3 minutes ago
REMEMBER: there is no USABLE DNA evidence found at the scene.

Alyssa Goard‏ @AlyssaMGoard 1m1 minute ago
Payan tells jurors there is no blood found on Criner’s clothing. “How do you carry someone with that amount of trauma to her head and not get blood somewhere on your body?”
--------------------------------------------------------------------------------------------------------------------------------

Molly Oak‏Verified account @MollyAndAMic 4m4 minutes ago
"They wanted you to believe that they tracked the suspect from beginning to end.” Defense now talking about the technicians tracking a man by what he was wearing and riding. Says they watched him a "couple of hundred times." “He never said I saw this defendant.”

Ryan Autullo‏ @AutulloAAS 4m4 minutes ago
Payan says the two UT surveillance people could not identify Criner as the man they were tracking despite watching 650 hours of video each.

Molly Oak‏Verified account @MollyAndAMic 1m1 minute ago
We're hearing about the AFD testimony from defense now. State brought this up. Talking about the "physical reaction" the firefighter had when he saw the bike in the surveillance video. Defense says this is because he felt betrayed.

Alyssa Goard‏ @AlyssaMGoard 1m1 minute ago
Payan throws doubt on the surveillance video the state says shows Criner following Weiser just before her murder. Urges jurors that they don’t have to be swayed by video because the UT video techs watched the videos for hundreds of hours

Alyssa Goard‏ @AlyssaMGoard 1m1 minute ago
Payan notes the UT video tech who was asked could not identify whether the person in the surveillance video was Criner
-------------------------------------------------------------------------------------------------------------------------------------

Ryan Autullo‏ @AutulloAAS 5m5 minutes ago
Payan says if Criner was truly guilty he never would have agreed to get in cop car at vacant building and be transported to LifeWorks shelter. He would have gotten on his bike and rode off.

Molly Oak‏Verified account @MollyAndAMic 2m2 minutes ago
"Guilty people run. Innocent people don’t flee from police.” Defense reminds jury that in one of the APD officers testimonies, he said Criner did not run away from them and allowed them to take him to the shelter.

Megan Menchaca‏ @meganmenchaca13 2m2 minutes ago
Payan said, if Criner was guilty, he would have gotten on his bike when police and firefighters arrived at the abandoned building and "rode off into the sunset." Payan says "innocent people don’t flee from police.”

Molly Oak‏Verified account @MollyAndAMic 2m2 minutes ago
At this point, defense is now focusing on the trash bin found outside the vacant building. "You can see the sandy clothing, all of it, sitting here at the bottom of the trash bin."
------------------------------------------------------------------------------------------------------------------------------

Molly Oak‏Verified account @MollyAndAMic 4m4 minutes ago
Defense is now showing a picture of Weiser's dorm room. Defense says you can see a picture of plaid boxer shorts on her bed. "I don't know whose they were, they don't know whose they were, you don't know whose they were."

Ryan Autullo‏ @AutulloAAS 3m3 minutes ago
Payan discussing plaid boxers found in bottom of trash can at vacant building. He says no one has tied them to Criner. He then pulls up photo from Weiser's dorm room and zooms in on something on bed he says look like plaid boxers. "Everyone has a pair." I think it was a blanket.

Molly Oak‏Verified account @MollyAndAMic 3m3 minutes ago
Glasses again: this time talking about the ones belonging to Weiser. Defense says no one found those.

Alyssa Goard‏ @AlyssaMGoard 3m3 minutes ago
When Criner was taken from the Medical Arts building to the Life Works, the prosecution characterized him as picking & choosing items to take with him that would dissasociate him w/the crime. The defense characterized it as Criner was rushed to leave & had to throw stuff out

Alyssa Goard‏ @AlyssaMGoard 1m1 minute ago
Prosecution said they believe boxers found in trash can tie Criner to the murder. Defense says the boxers were never tested for DNA, no one know whose they were, and a pair of similar looking plaid clothing can be seen in a photo of Weiser’s dorm room
--------------------------------------------------------------------------------------------------------------------------------------------

The prosecuter copied my use of the word "damning" I mentioned yesterday LOL
But I dont mind because its a good term for some of the evidence. :)

Alyssa Goard‏ @AlyssaMGoard 5m5 minutes ago
“You should know, he committed this horrific and brutal murder and rape, just like his fantasies,” Winkeler said. She urged the jurors to find him guilty, saying the evidence against Criner is “damning”

Megan Menchaca‏ @meganmenchaca13 3m3 minutes ago
Payan emphasizes that none of the items found at the crime scene or at any of the other locations were tested for DNA or fingerprints. These items included a bloodied bra, a pair of boxer shorts, and eyeglasses.

Alyssa Goard‏ @AlyssaMGoard 1m1 minute ago
The glasses are yet again being taken out to show the jury. Suggests the jury examine them to make sure the remaining viewable serial numbers are what the prosecution says they are
--------------------------------------------------------------------------------------------------------------------------

Alyssa Goard‏ @AlyssaMGoard 2m2 minutes ago
Haruka Weiser’s father Thomas left the courtroom for the start of the defense’s opening arguments, he has now returned

Megan Menchaca‏ @meganmenchaca13 2m2 minutes ago
Payan says the glasses found at the trial are not Criner's because of the 12mm difference in pupilary distance. Criner said he left his glasses in a storage room. Prosecutors say Criner had his glasses while killing Weiser and left them at the scene of the crime.

Molly Oak‏Verified account @MollyAndAMic 3m3 minutes ago
"The glasses, are really interesting." We're now talking about the glasses found at the crime scene again.

Molly Oak‏Verified account @MollyAndAMic 3m3 minutes ago
Weiser's dad is not in the courtroom for the defense argument.

Ryan Autullo‏ @AutulloAAS 5m5 minutes ago
Payan says glasses found at scene are not Criner's. The 12 millimeter difference in pupillary distance between the glasses and Criner's prescription would have caused headaches and blurriness.

JMO
The defense attorney is doing a pretty good job of trying to convince the jury of reasonable doubt. This part I disagree with though.

Many suspects will not run and they will act like nothing happened if caught red handed.

Alyssa Goard‏ @AlyssaMGoard 43s44 seconds ago
Payan says Criner did not have electricity in the Medical Arts building and that the reboot activity in the tablet in the hour before the murder happened wcoykd not have just been the computer powering on & off on it’s own. Said tablet wouldn’t have enough power to do that

Molly Oak‏Verified account @MollyAndAMic 4m4 minutes ago
"A human being was interacting with that machine at the time this happened.” Now hearing about Criner's tablet computer.

Molly Oak‏Verified account @MollyAndAMic 2m2 minutes ago
Pointing between the screen and at Criner: "This is the proof, right here that that man, that boy, did not kill Haruka Weiser.” Says, during the time she was killed, someone was using the computer--something was being installed from a USB.

Ryan Autullo‏ @AutulloAAS 6m6 minutes ago
Payan now getting to computer stuff. The USB drive in Criner's tablet was active from 8:43 p.m. to 9:33 p.m. Weiser was killed about 9:40 p.m. He says it's reasonable doubt. State believes keyboard attached to USB drive was being jostled in backpack while Criner was riding bike.
---------------------------------------------------------------------------------------------------------------------------------

Alyssa Goard‏ @AlyssaMGoard 3m3 minutes ago
Payan acknowledges the fictional story about a sexual assault fantasy Criner wrote “was gross.” But tells jurors that story does not help them decide a factual issue in this case

Molly Oak‏Verified account @MollyAndAMic 3m3 minutes ago
Defense now bringing up the...ummm...colorful writing, by Criner, we heard yesterday. "This story was here to do one thing and one thing only: piss you off!" Defenses says, if the jury is mad, they'll make mistakes--says it's basic human psychology.

Molly Oak‏Verified account @MollyAndAMic 4m4 minutes ago
Now we're hearing about Criner's testimony. Says he was living on streets, trying to survive, moving place to place. "He chose this existence. Why? Because he’s not very smart. He doesn’t think ahead. Now I’m not saying he’s stupid”

Molly Oak‏Verified account @MollyAndAMic 5m5 minutes ago
Defense continues, "He doesn’t think about consequences to his actions. Now they’re (points at prosecutors) going to make a really big deal about that in a minute, because that sounds really bad.”

Megan Menchaca‏ @meganmenchaca13 6m6 minutes ago
Payan says this about Criner: "He’s not very smart. He doesn’t think ahead. He doesn’t plan. He doesn’t consider consequences for his actions."

Alyssa Goard‏ @AlyssaMGoard 3m3 minutes ago
Payan says “You have a guy who is charged with capital murder who is childlike” and explains prosecution only shared the story “to piss you off”

Molly Oak‏Verified account @MollyAndAMic 1m1 minute ago
Defense compares pictures of Criner to Marquel Boone. Defense says Boone was the first suspect and is strong and wears glasses. Says Boone also had a history of sexual assault, bike theft, and being on UT campus.
--------------------------------------------------------------------------------------------------------------------------------------

LOL
Defense attorney now covering the part where the defendent said "it doesnt look good for me"

He knew that was bad and so trying to cushion the blow from yesterday.

Alyssa Goard‏ @AlyssaMGoard 2m2 minutes ago
Payan compares pictures of Criner and Marquell Boone, the original suspect in Weiser’s murder. The two look kind of similar. Boone is clearly the more muscular of the two Payan said he “liked his odds better” over Criner’s in carrying a body and wedging it between boulders

Megan Menchaca‏ @meganmenchaca13 5m5 minutes ago
I believe Payan is showing the difference in strength between another suspect in the case (who has a history of sexual assault and women's bike theft) and Criner. He showed pictures from, I believe an Instagram feed, of the other suspect in which the suspect shows his muscles.

Megan Menchaca‏ @meganmenchaca13 2m2 minutes ago
Payan said Criner was stupid to say ‘it doesn’t look for me' on the stand. He said "that is the dumbest thing he could have said."

Ryan Autullo‏ @AutulloAAS 6m6 minutes ago
Payan puts up photos of alternate suspect and points out his physical resemblance to Criner. And yes, it's a pretty strong resemblance. The other man spoke with Austin police, who ended conversation after getting new information that tied Criner to the attack.

Ryan Autullo‏ @AutulloAAS 4m4 minutes ago
Payan on Criner telling jury that odds of acquittal don't look so good: "How stupid do you have to be to say that? That is the dumbest thing he could have said." A guilty man would have lied, Payan says.

Molly Oak‏Verified account @MollyAndAMic 3m3 minutes ago
Remember when Criner said "It doesn't look so good for me?" yesterday during his testimony? Defense says, "That is the dumbest thing he could have said.” Defense says, “I couldn’t stop myself from rolling my eyes.” Defense says Criner is young, not a planner, & honest to a fault
-------------------------------------------------------------------------------------------------------------------------------------

JMO
Defense is wrong that computers cant do actions by themselves. There are all sorts of ways a computer will take action at a certain time on its own. Including rebooting itself if it crashes due to low battery or something.

Molly Oak‏Verified account @MollyAndAMic 1m1 minute ago
"Mick did not commit this crime. Look at the evidence. And you'll see all the pieces, all that circumstantial evidence come together. But at the time of the murder, the computer is being used." Defense says there were 50+ operations happening during the time period.

Alyssa Goard‏ @AlyssaMGoard 2m2 minutes ago
Payan describes Criner as “honest to a fault” and someone who does not plan things ahead. Mentions Criner telling the jury frankly yesterday “I don’t like my odds” as an example

Megan Menchaca‏ @meganmenchaca13 3m3 minutes ago
Payan: "Mick did not commit this crime"

Molly Oak‏Verified account @MollyAndAMic 1m1 minute ago
"That doesn't happen by itself, someone has to push the button. That someone was that boy over there. If he's pushing the button, who's killing the girl?" Defense asks jury. Defense is done, for now. Prosecutors back up. "This fella over here writes some pretty heinous stuff."

Alyssa Goard‏ @AlyssaMGoard 2m2 minutes ago
Payan notes there were more than 50 different computer processes happening on Criner’s tablet during the window in which the state says Criner was seen on surveillance video near the area where Weiser was killed. “If he’s pushing the button, who’s killing the girl?”
