I'm sorry to see the Copenhagen Post says 'experts' think PM may well win because he killed 'only one person'. I hope the other factors in the case will override that.

Submarine murder: appeal has started

The appeal trial of Danish self-taught inventor Peter Madsen, sentenced to life imprisonment for the murder of Swedish journalist Kim Wall in his submarine in August 2017, began on Wednesday in the Copenhagen High Court.

Three hearing days have been scheduled for September 5, 12 and 14.

So it's a very compressed version of the burden case, but without witnesses meeting personally. So it will be a lot of reading, which is what's happening now. Next Wednesday there will be a reading of selected testimonies and Madsen's personal relationships, mental examination, etc. Perhaps they also have Wednesday procedures where defendants and prosecutors must come up with their punishment and explain what, seen from their tables, is soothing and aggravating, and mention earlier judgments. But it will probably be next Friday, when the verdict is also expected

So today was a recap of the trial, with the defense acting as if several statements of PM have not been disproven by the evidence that was used to convict him and sentence him to eternal captivity. Dear me. They sure know how to keep themselves busy. Hope someone comes up with a decent legal analysis, if there is one.


 
I thought I must have slightly got the wrong end of the stick, what with translations and all, about PM's lawyer arguing for a sentence based only on desecration of the body, as if he'd never been found guilty of the murder at all. But no, this is also what Deutsche Welle understood:

I think it must just be defence desperation - like Ian Stewart's lawyer in the Helen Bailey murder case suddenly bringing into the defence closing statement all sorts of things that were never in the case. But this defence lawyer is taking it a ludicrous stage beyond. I pin my hopes on the fact that everything we have seen from the Danish system so far has been sensible and efficient, even if some feel it errs on the side of leniency. I am hoping for a blast from the judge next week.

His lawyer, Betina Hald claims that he accepts the guilty verdict, because it would be too exhausting for him to go through anther full trial.

*Appeal (Day 2) (@ 9:30am CET) - Denmark - Kim Isabel Wall (30) (Aug. 10, 2017) - Peter Langkjær Madsen (46) charged with premeditated murder in addition to dismemberment & sexual relations other than intercourse of a particularly dangerous nature & indecent handling of a corpse. Plead not guilty.
Appeal dates continued 9/12th & 14th.
Verdict was unanimous, all three judges.
The case has already been appealed. 23 minutes after the verdict.
In Denmark, a life sentence (Livsvarigt fængsel in Danish) theoretically means life without parole: that prisoners will spend the rest of their lives in prison. However, prisoners are entitled to a pardoning hearing after 12 years, and upon motion of the minister of justice, the Danish King or Queen may grant a pardon, subject to a 5-year probationary period.

9/5/18 Update: Madsen is sentenced to life imprisonment for murder on the Kim Wall. However, he has only appealed against the length of the sentence, the guilty issue will not be re-examined.
Defense Attorney Betina Hald Engmark will try to convince the Supreme Court over the next three hearings to mitigate the verdict's judgment in Livstid to Peter Madsen. A final decision is expected on Friday, September 14th. Prosecutor Kristian Kirk read from the verdict in the City Court as part of his documentation in the appeal case. After an overall assessment, the court finds that the accused has killed Kim Wall, finding the court's judgment, which was disposed of in April this year. Appeal hearing continued to 9/12.

I see one of the three judges has had to withdraw. The EB site says that if there is a disagreement between the remaining two, the view most favourable to the defendant has to be taken.
Doesn´t seem fair to me! I hope the two agree.

If a judge had to withdraw, there should be a new trial!
