Also to add to your point, she may have really thought it was her apartment and they can claim stand your ground rules all they want and say that was her reasoning to protect her place, but I would urge the state to counter her statement with every single sign and indicator that she was in the wrong area. Had she paid attention to the multiple signs beginning at garage, she would have never "mistaken that he was an intruder" in her place. Furthermore, I'm not buying I was so tired. She work 13.5 hours and only live 17-20 mins max from her job to her place. Its not like the girl worked a night shift and came home that morning. She came home at 9:30. I'd love to see what her work schedule that week was. Better yet, I want to see her timecard of that day. With all the lies and cover-ups, who knows if they are even telling the truth on that.

There has been, reported in the MSM, an ongoing problem with mandatory OT for DPD LEO's. Officers have apparently quit over this very issue, making it worse for those remaining on the force.

In light of this, AG's possible confusion caused by fatigue is more believable. Back to back 12 hour shifts can take it out of anyone. In my last job as an unarmed security guard, they were mandatory, and I had to catch the bus (a 90 minute ride) to and from my post (work) 5 days a week.

I have a scenario that pulls a bunch of the above together, however unlikely.

AG is working back to back 12's, as mandated by DPD. In this situation sleep is critical, sleep is your friend, sleep is king! (Anybody, or anything that keeps you from sleep is NOT your friend!).

Suppose that BSJ played a TV in his bedroom late into the night, loud and long enough to keep AG from a good night's sleep. If she was already irritated about noise issues with a neighbor that morning (that she had to call into the leasing office during the day), that may have been enough for her to chew on her OTHER noise issue throughout her work day, the one keeping her up at night. What if she decided, especially if she was a Courtesy Officer for the Apt. Complex, to pass by BSJ's apartment after work, on the way to her own apartment. She might have parked on the 4th floor, with the attention of stopping off at BSJ's apartment, before walking downstairs to her own. She has her gear on, and would be more imposing in uniform to deal with the noise issue in her role as a Courtesy Officer.

She goes to BSJ's apartment, and one of several possible scenarios take place:

1) AG knocks on the door, with the usual loud "cop knock", yelling open up. (As she is over him costing her sleep, and wants to deal with this so she can go home, walk the dog, and get out of her gear and uniform!). There is a confrontation between the two, things go South and BSJ reacts in a way that spooks her. Irritated and cranky, she shoots him from the doorway. Maybe he retreated into the apartment when she went for her gun, and tried to duck after the first shot (this accounting for the odd superior to inferior wound track, and not an anterior to posterior one). He says "why did you do that". She does walk in, and flips on the light, sees that he is dying, and calls 911 as the Complex Courtesy Officer, as that was her "offical" LE role at the time, That alerts dispatch, and everyone else, that this is a LEO involved shooting, NOT an involved (e.g. on duty) LEO shooting. She then makes up the "went to the wrong apartment" story on the fly with 911 on the line. She sees BSJ dying, freaks out a bit, and walks out into the hallway (kicking the red rug to block the door open - living in the building, she knows how the door works), and makes calls for emotional support and to firm up her story in her own mind. At some point she puts her key in the door to "dress the scene" to support her evolving story.

2) Starts same as above, but as she approaches BSJ's apartment door, she notices that it IS ajar, held open by the displaced red rug, possibly since 6:30ish. Her Cop-Spidey senses start to tingle, she draws her weapon, walks in looking for a prowler, and confronts BSJ. Being fatigued, she goes into auto, reflex mode, muscle memory point and shoot stress fire - just like on the range. Especially if BSJ made a quick move, reaching for something like his Cellphone. (Not his fault that he got shot in his own home!) This causing the Cop PTSD (Put That S**t Down) reaction in her. The rest of the scenario is the same as in #1 above. (CPTSDS gives LE PTSD!)

She had already been involved in a physical altercation where a male perp bested her, and took away her Tazer away, having had to end that confrontation with gunfire. That kind of experience can make a formally cocky small person insecure. Apparently, she had since started to bulk up, likely hitting the weight room, MAYBE taking Steroids. In Chiropractic College in the 80's, I knew a number of body builders, some on anabolic steroids. There was even one female bodybuilder smaller than AG. Some of the changes in AG's face (from previous, older pictures) SUGGEST that MAYBE she was using 'roids. Other, legal Rx drugs that could cause problems include Provigil and Nuvigil (given to U.S. Air Force B-2 pilots on 36 hour long round trip flights from the U.S. Midwest to the Middle East, and has been generally considered safe by even Flight Surgeons to "treat" sleep deprivation) or Ambien (even the next day - just ask Roseanne Barr).

"Like law enforcement, Merritt has previously said there was a noise complaint about Jean's apartment the day he was shot. Merritt said Wednesday that he learned that was not true. Merritt said there hadn't been a noise complaint against Jean in the two months Guyger had lived in the building."

Yep, the big men fraternal brothers had many laughs at her expense over some perp outweighing her maybe 2:1, taking her taser from her. You can bet she caught nearly unending "good natured ridicule" from her colleagues and I'm sure a few might have offered to protect her in exchange for certain favors.

Does anyone know in cases like this in Dallas how the sentencing works?
If convicted by a jury, does the judge then decide the sentencing or the jury. My guess is the judge but not totally sure.

The Grand Jury does not determine guilt or innocence, it only determines if the SUSPECT can be charged with the crime(s) presented to them, after being shown the available evidence by the DA. If the GJ returns a "No Bill", the suspect walks away....for now. There is no "double jeopardy" involved with a GJ, as Guilt was never an issue. The DA can always file new charges, within any mandated statute of limitations, that is usually open ended for Murder. If the GJ returns a "True Bill", then the suspect will be indicted (formally charged) with the lesser (Manslaughter) charge or the greater charge presented (Murder One or Two) depending what the GJ decides.

The charged suspect, now indicted (by the GJ) will go on to trial in front of a Bench Judge or a Jury. IF found guilty, only then can the now Guilty prisoner be sentenced to Jail, Prison, or other alternatives (like a suspended sentence with supervised probation).

However, Texas is a bit "odd". In Texas it is currently legal to shoot to kill in defence of property. Most all States don't allow that. Also, in the past, it was an accepted affirmative defense to a murder charge in Texas, to claim that the "victim" needed shooting like a "mad dog in the street", and all of you (the Jury) would have also shot him if you had been in my boots at the time. It was, and still is Texas.

It may be difficult to persuade a roomful of Texans to indicte a LEO. Though, the fact that the Texas Rangers recommended a charge of Manslaughter may carry a LOT of weight with a Texas GJ.

In Texas, while the word of a Texas Ranger is not absolute law, it can come pretty darn close!

The mother of Botham Jean, a Dallas man killed by an off-duty police officer, said the female officer's actions demonstrate she entered Jean's apartment intending to kill him.

"I have no choice but to believe that she did it intentionally," Allison Jean said on BuzzFeed News' AM to DM.

But Allison Jean says the officer's actions did not follow proper police protocol and her explanation does not reflect her actions. Guyger was off-duty but still in uniform during the shooting.

"The sequence of events she outlined in her affidavit does not appear logical," said Allison Jean.

So the fatal shot is just unimaginable, it does not make sense. I have no other choice but to believe that she did it intentionally," said Allison Jean

When asked what Allison Jean would like to say to the world about her son, she replied:

"I don’t even need to say to the world what my son was. There’s several testimonies we’ve gotten from Facebook, Twitter, the memorial we had in Dallas, several private messages I’ve received that came from people I knew him, who said what an outgoing and loving person he was," she said.

I don't know about vanity or arrogance, but I do wonder about her skill. As I posted upthread, I'd like to know how she scored and ranked at the Academy. I'd further like to know if she had to go in for mandatory re-training after her first shooting incident 15 months ago. If not, that is a big red flag, IMO.
Any LE on the thread who can comment on that?

Perhaps not a *formal* complaint to the management, but I would like to know if it's been confirmed that AG complained to him, or other residents.
 
Believe me, I know exactly what it is like and even to much harsher extremes for more than double the duration of time.

However, I've never accidentally and carelessly somehow ended up in a stranger's home convicted in my belief their home was mine and if I had of, I can't imagine me having any desire or energy to kill them.

She's 30 years old for pete's sake, she can do anything for a long overtime shift for several more years now.

Except SHE can't since it has been proven she simply can't cope or flat out is a raging and deceitful murderer.

Is she was that fast to shoot someone when she's off duty and she's tired, imagine how fast she would shoot someone when she's on duty and she's tired.

Well yes, given these two shooting incidences in a 15 month period (one fatal), I would agree she is unsuitable as an armed protector of the public safety. I'm still focused in on what retraining or investigation transpired after the first shooting incident 15 months ago? This will be an important point to the Decedent's family in whatever action they pursue.

And what good, if any, can come from this tragedy? How can LE screening or training address this tragedy to help prevent something like this ever happening again? What *exactly* went wrong in this woman's training or screening?

That's what I am most interested in. Botham Shem Jean's family will never see him marry, will never hold grandchildren. His friends and family and the world have been robbed of the legacy he was to leave. So what good can come of this? How can Botham effect change, even in death, that so obviously needs to happen?

Around here Yes , there is a house close to the road on my way home ( really nice house ) and every time I drive by at "quittin time" 5pm I smell it STRONG and Ive often wondered when I will see a cop car.... and I did yesterday LOL
 
With all the smoke that has been put up, starting with this gals highly unbelievably story, to her not being arrested on the spot and on and on and on and on..... who knows if there were any complaints about noise, dog poop, roaches, mj, or anything?

How can Meritt or anyone verify anything related to apartment management when they are quoted as stating they cannot discuss anything to do with the case?

Smells and wreaks of insulting propaganda so how about let's just hear the unaltered actual 911 call and let's see how things got started after anyone other than just AG was involved AFTER SHE KILLED HIM???

Techically this one detail is not quite academically accurate. The grand juy either finds or does not find Probable Cause that the person committed a crime.

The DA or Rangers or whomever can charge anyone with a crime. Note the Rangers got a judge, not a grand jury, to sign her arrest warrant for manslaughter, of which she remains charged of that felony crime without her consitutionally assured right of a grand jury finding said probable cause. She could certainly be given the opportunity to waive binding it over to the grand jury to then be arraigned and instead cop a plea if the DA were to advance prosecution against her now.

I'll not convolute this with tangents on their investigative powers and how under certain conditions they simply aren't limited to just eveidence and testimony that the State OR CITIZEN presents before them. However, I did broach that subject.
