In a novel decision that could pave the way for other lawsuits, a judge on Tuesday ruled that Harvey Weinstein can be sued for violating a federal sex-trafficking statute by a young actress who claims he coerced her to engage in sex acts with him in exchange for a false promise of a movie role.

The judge said the classic casting-couch inducement to have sex with the producer could fall under the sex-trafficking law, which makes it a crime to entice and force a person to commit a “commercial sex act” in return for something of value.

Kadian Noble, a British actress, accused Mr. Weinstein in a November lawsuit of sexually assaulting her after he lured her to his hotel room in Cannes, France, in 2014. Mr. Weinstein had promised the actress that they would review her movie reel, but he molested her and forced her to watch him masturbate in the bathroom, she said. Her lawyers argued the incident was legally the same as forced prostitution.

A New York judge has ruled that an aspiring actress can sue Harvey Weinstein for violating sex-trafficking laws because the proverbial casting couch, in which women are asked to trade sex for Hollywood opportunities, could be considered a “commercial sex act.”

U.S. District Judge Robert W. Sweet said the lawsuit filed by Kadian Noble last fall was fairly brought under sex-trafficking laws Congress passed that had an “expansive” definition of what could be considered a commercial sex act. His ruling, dated Monday, was filed publicly Tuesday.
 
I haven't followed this closely, but I think this is a new one. Cannes again.

German actor Emma Loman has filed a lawsuit against Harvey Weinstein, alleging the disgraced movie mogul raped her in 2006 at the Cannes film festival.

In a complaint filed on Monday in Los Angeles, Loman said that she met Weinstein in 2004 at the Venice film festival and he later invited her to Cannes as his guest to discuss her career.

Loman said she was initially hesitant to accept the invitation but Weinstein was persistent, with his assistant calling her up to 30 times a day.

This is interesting. She made that "bargain" under duress to escape him. It is not therefore a legal binding agreement IMO. You cannot make a binding contract with illegal proposals in it AFAIK.

Even marriage contracts are dissolvable by unreasonable behaviour.
I am sure any such bargain wasn't enforceable. His argument is, he was trying to promote her career, not destroy it, because he expected her to fulfill the bargain after she got the award.

Harvey Weinstein prosecution suffers second significant blow in a week
The Manhattan District Attorney’s office this afternoon issued a pre-emptive notice to Harvey Weinstein’s defense team, alerting them to yet another potentially serious problem connected with the investigation that led to criminal charges against the disgraced movie mogul.

The assistant district attorney handling the case told Weinstein’s team that one of the alleged victims was told by a lead detective in the case to delete from her phones any information she didn’t want prosecutors to see when she turned the devices over to them.
