I found this reference to the email from law enforcement testimony at the prelim hearing

it appears to prove that CM's contract fees included MSM's costs, but that CM had been ripping of JM by not paying the supplier.

In these cases, JM honoured the debt

15 A Yes, I did.
16 Q Did you speak with David Sequieda?
17 A Yes, I did.
18 Q What did he tell you about the business relationship
19 between Joseph and/or between Earth Inspired Products and his
20 business?
21 A He stated that he had a partnership with Joseph. That it
22 was between him and Joseph to create these fountains, and that
23 Charles Merritt worked in the shop, he helped do the creating,
24 the materials, and shipping out the product.
25 But the primary area of the business was between Joseph
26 and David Sequieda.
27 Q Did David Sequieda provide you with an e-mail from Joseph
28 regarding an unpaid invoice for a project?

2 Q What did that e-mail say?
3 A It was an e-mail to Joseph asking about funds for
4 materials. Joseph’s response to that e-mail was, as he had
5 talked about before, that Chase was responsible for the
6 materials, the creating, as far as the materials go, to ship.
7 And that if he wouldn’t pay that, Joseph would take care of it
8 again, like he had done in the past. Basically, he would pay
9 the debt.

10 Q When was that e-mail?
11 A I don’t recall the date.
12 Q Do you recall how long in relation to February 4th?
13 A It was approximately one month prior.
14 Q Did you ask the defendant during the October 22nd, 2014
15 interview whether Joseph owed Metro Sheet Metal money? Or did
16 you ask him about these checks that were created to Metro Sheet
17 Metal?
18 A Yes, I did.
19 Q What did he tell you about those checks?
20 A He said Joseph gave Merritt checks to pay Metro Sheet
21 Metal.

So in relation to this witness, it may not be that Metro's work fees hadn't been paid - as per the invoicing statement that the defense wanted to show the witness before they went to sidebar - it may be that they needed to pay for new materials that Joey had given money to Merritt to purchase.
 
I've a question about the electrical cord knotted around Joey's neck. Was the size of the loop ever stated and could it mean that Joey might have been strangled with it?

Yes I suspect this is the point.

That CM had been working a scam here. But one that would appear to be a breach of contract rather than fraud.

Perhaps the prosecution case is that he clearly had been ripping JM off over a period of time, but then on 1 Feb he escalated to actual theft.

I wonder if this will be clarified once the financial investigators testify. I am unsure of the exact relevance of the two deleted cheques to MSM
 
Do you mean crime scene as in the desert or the house?

I guess with dumping the trooper, he could walk away from it and maybe catch a cab or something locally? Or get picked up by someone.
 
I think it's possible he rented a one-way car using Joey's drivers documents from the Trooper. Wearing a hat he may have been able to pass himself off as Joey to a non-observant unsuspecting clerk.

That’s one hell of a risk though if it didn’t work so I can’t imagine he would of been that stupid. It had to much potential to backfire.
 
A few things I have been thinking about...

Metro Sheet Metal - I think I need to hear from Carmen, the secretary, to fully understand what was owed to MSM and by whom. David Sequieda in his testimony made it pretty clear that the invoices were supposed to be paid by Joey, they would never have done business with Chase, so I don't understand how Chase would owe them money.

The only thing that makes sense to me is that the Sequieda's ended up having to actually ship out some fountains, and because that was not part of their "job", they wanted to be paid for it. If Joey paid Chase in advance for certain jobs, then yes, I can see Joey saying it was Chase's responsibility, but ultimately, it was between Joey and Chase. If this is the case, the prosecution should have made this clear. We have more information available to us and personally, I am left with questions after that testimony.

CJ and Chase phone calls - I will be interested to see other phone patterns with the 2. IIRC, in the preliminary hearing, there was info that CJ said he never shut his phone off, even in the casino's, he just didn't answer. I want to see if it's out of the ordinary that she would call 4-5 times in a few hours and him not answer. How old were their kids at this time? And is she really testifying for him??? lol

I agree but I think he has shown himself to be a risk taker - calling QuickBooks and pretending to be Joey after Joey disappeared, as well as printing off and deleting checks that could be linked to him because he cashed one of them at his own bank. That's like leaving a note at the house saying I was here, imo.

I bet he kicked himself a thousand times for not having kept Joey's phone to call Quickbooks on, to not only get the account deleted but also to make it appear Joey was still alive days later than he was.

I think he's only been called to prove that a bad relationship over money was potentially developing between Joey and Merritt building up to the murders, which they are witness to, not to prove that Merritt was actually misappropriating money Joey gave him to buy materials - that can't be proved because Joey isn't able to testify to what financial arrangement he had with Merritt. moo.
 
I remember hearing that Chase is a very talented welder, FWIW.

I was intrigued to know as I always come back to why Joey continued to hire him when he had obviously had quite a few issues over a period of time. So it makes a-little more sense that Chase was a great welder so Joey could justify some of Chase behaviour probably in his head due to how good he was.

It was also placed in in Long Beach for whatever reason. The person who placed the ad was tracked down and determined to be erroneous.

It appeared to me to be about the size of a nickel or quarter. Certainly not a slipknot type knot that would strangle but more to restrain.
