Newton boy's death: Attorney files motion to dismiss complaint for 7-year-old's guardian
"MANITOWOC - A hearing to rule on a motion to dismiss the criminal complaint for Timothy Hauschultz was filed Monday just hours before Timothy, Damian Hauschultz and Tina McKeever-Hauschultz appeared in court for their initial appearances.
Timothy Hauschultz's attorney, Donna Kuchler, filed a motion to dismiss a defective complaint on Monday. The document states: "The complaint is defective because it fails to provide adequate notice and specificity for counts 1-6. The complaint is also defective because it fails to prove probable cause to support counts 1-6."
The hearing was scheduled for the same time as Timothy Hauschultz 's preliminary hearing — 2:30 p.m. Feb. 18.
A preliminary hearing for McKeever-Hauschultz was scheduled for 2:30 p.m. Feb. 20.
Damian Hauschultz also appeared for an initial appearance, but it was adjourned because his attorney, Edward Hunt, was unavailable. The initial appearance was rescheduled for 1:30 p.m. Feb. 18.
Damian Hauschultz, 15, faces charges of first-degree reckless homicide related to the death of a 7-year-old Newton boy in April. He is also charged with three counts of substantial battery and three counts of physical abuse of child — intentionally cause bodily harm...."
