FWIW I don’t think having stents in would’ve prevented him from committing the murders. It certainly didn’t stop him from prospecting etc. I know 2 people with stents in, initially you have to take it easy for a few weeks but after that you are kinda encouraged to exercise.

I agree. He makes it sound like it was "recent"... well, how recent is recent? LOL

I understand what you're saying, but as devil's advocate, if the prosecution or a detective hears something in court that makes them think, and then that person goes home that night and does some more work and discovers NEW evidence/information -- should the prosecution then just ignore that information and not bring it up in the trial? Even though it may help the jury in their decision?
You are right, of course. Why would or should evidence be rejected or ignored just because it's new? That makes no sense at all.

I'm not sure what you mean, Missy.

I would expect to see proof of both, since they both have been asserted as being true.

What is attested to in SWs are far more important, and official, than what an attorney may say or any defendant..

Usually at some point in a trial a detective will take the stand to give testimony concerning any SW that may have been gotten, including the probable cause affidavit attached to each one will be shown, and explained.

So respectfully, Missy, imhoo, comparing what an attorney may have said or CM, and what was in any official SW recorded document is like comparing apples to oranges.

This is what I would like to be confirmed through testimony.

1. Joey loaned CM money (30K) to pay off some of his gambling debts.

2. CM created a 100k in medical bill debt due to having heart problems, and it was due to having a heart attack.

If so, both sides should produce the evidence they both ascert to be true.

Proving CM had been given loans by Joey must be proven by the state.

However proving CM encountered such a serious debt of 100K due to having a heart attack would help the defense, and should be proven by them, not just because the attorney or CM said so.

If it was that serious there would be a long period of time he would have been unable to work, due the long time it takes to recover.

Has anyone else, like those who worked with him at MSM or elsewhere, testified about any of that, and how serious it was at the time? Surely the DT would take any opportunity to bring that to light through witness testimony.

In the PH, did CJ, mention it was tough for them financially when CM had his heart attack that landed him in the hospital where he racked up 100K in additional debt?

I think everyone wants both things proven one way or the other.

I don't know why anyone would want one proven only, and not the other. Why not both?

So has anyone else besides his attorney, and CM, himself verified it all happened?

How long was his hospital stay, and how long was he incapacitated at the time, before he recovered where he could get back to doing laborious work like usual?

As an aside: when I see the tv ads for viagra (spelling ?) they caution anyone from taking this particular drug if they have heart problems.

Didn't he just go to Mexico to buy viagra in January before this happened?

Imo

I believe CM is guilty. I also believe he is telling the truth about his heart attack and the hospital bill. I don't have proof of it.

I am not a cardiac nurse, but i am an RN. He could have been having chest pain and went to the ED. If he had positive troponins and EKG changes it would be classified as a myocardial infarction. A person can just have slightly elevated troponins and small EKG changes. They likely took him to the cath lab for stents at that time. Easy to rack up 100k in charges, even if was just there overnight, which is entirely possible for an MI with stents.

100K for that? lol crazy! A few years ago, my Dad spent 3 1/2 months in hospital, my whole family would be bankrupt if we had to pay (and was uninsured). I know how much health care costs, and we just pay for it in other ways... taxes... but I just cannot even imagine having to face those kind of charges in a medical emergency. I won't even tell you how many times my hubby has to see a doc or specialist or has been in hospital or all the tests he has had in just the last few years... can't imagine the cost of that either! lol

I had to come back to this post... lol

I don't think that CM is that smart or would think that far ahead, do you? Giving him way too much credit!

On another note, I have been trying to follow that case as well (not posting much)... it is CRAZY! I just have this sinking feeling that it's going to end up crazier than what we already know.

Well, he had enough "smarts," to stage the house with rotting food and popcorn, to cover his tracks. He's spent enough time in prison to learn a *LOT* of tricks. Those inmates have nothing better to do.

Welcome Back! Unfortunately... I think you will have to start a Trial thread #1 :( There may have been another thread in the original McStay forum that we started for that first day or 2.

Don't forget the link posted by Recidivism!

This is a weekly recap of the trial. It's not daily but it's something. It would help for getting caught up for sure.

There should have been another update yesterday but haven't seen anything yet.

Right! I recall watching it on HLN, but always had it on my computer because I didn't like missing anything and didn't do commercials... and I think HLN only covered until a certain time (but I might be mistaken). One of the SB local stations should stream this trial!!! they would probably have less problems than L&C anyway.

The reason the medical records are related is that the court verified them.

He was hospitalized in May 2010?

If what he said in the Dugal interview has any truth to it... he said something about being in the hospital (I can't recall if he said heart attack at that time, and I can't recall when he said he got stents? If it was at that time or not)during his last hearing and that is when the warrant was issued... that looks to be September 2009.

I don't recall the exact details, only that in 2009 there was some type of major health issue. It makes sense given his congestive heart failure.

Yes, I've been there. And what happens, I would imagine, is as has been described - water collects in the depression, and a whole lot of mud is created.

Ok.. stupid question maybe ... but would that water "stand" there for a bit? With the ground being so dry, it doesn't get absorbed right away, right? We have had downpours after dry conditions and that's what happens, even in my backyard or garden lol So I'm thinking in conditions like the desert, it would be even worse.

I posted the docs. I can bring you to the water, or the water to you, but I can't make you drink. You are going to have to make some effort if you want to be familiar with the documents that are available on this case.

I guess I will have to put forth more effort when probation reports are referred to as probate documents. Makes it very confusing.

Not that I recall. It has always been from the defense from the get-go. But it's also confirmed by family that it's something he's had all his life, so not a recent condition that would have him on death watch.

On the supposed heart attack, I don't recall hearing about this before the trial and maybe just in the last couple weeks. Can someone point to where this originated? Testimony? This sounds to be something spoken into fact.
I have a vague memory of hearing it somewhere from Rick Baker - that Chase had the heart attack after he returned from Saudi Arabia. In his book "No Good-Byes," on page 160, he refers to Chase's personal and physical life taking a downturn after the disappearance of the McStays. Considering the source, obviously FWIW.
