"Prosecutors now allege Aubrey Trail and Bailey Boswell began conspiring to commit murder more than four months before they met Sydney Loofe, according to court documents.

The allegation arose in a court filing Friday afternoon in the prosecution of Trail, who is accused of strangling the 24-year-old Loofe in Wilber on Nov. 15, 2017.

Assistant Nebraska Attorney General Sandra Allen filed a conspiracy to commit murder charge in Trail's case and alleged he and Boswell began plotting July 1 to kill someone.

In their conspiracy, Boswell "solicited" young women on social-networking sites, Allen said in the filing.

Together, they selected Loofe as their victim and bought tools to kill and dismember her, the amended information said."


Sydney's death was no "accident!" Both of these depraved sub-humans spent months planning to murder and dismember a woman. Sydney was the unlucky one snared in their diabolical scheme. I have no problem with either one of them getting the death penalty. Let them spend every day for the decade or more it will take to come about thinking about their own deaths and living in fear and dread. Such pure evil deserves no less. I hope Boswell's daughter did not inherit whatever psychopathy her mother has. I hope Trail never reproduced. MOO.

It’s so impossibly sad to think that Sydney was so excited to meet a “great” girl... and was so misled.

I’m not particularly in favour of the DP... but I hope they fry.

IMO , I have a hard time believing that Sydney was the first girl lured into a devastating trap. They began their plan in July and she was killed in November. It’s sickening to think about, but I think “the hunt” for a victim was part of their thrill... and I don’t think she was the the first victim, especially with the amount of planning that was done. Trail did mention at some point earlier on that he could give info on a similar case.
 
Prosecutors filed a motion to amend the charges against Aubrey Trail.

The motion says Boswell searched through social media for a victim that she and Trail ultimately selected. It also says the two recruited others to commit murder, bought materials used to kill and/or dismember Loofe and jointly disposed of the remains.

The court records don't show a similar motion filed in Boswell's case.

Trail (51) charged & indicted (6/11/18) & arraigned (7/13/18) with 1st degree murder & improper disposal of human remains & charged (3/1/19) with conspiracy to commit murder. Plead not guilty. No bond. DA will seek DP.
Trial to start 6/17/19 thru 7/5/19
2/2/18: AT says "accidentally suffocated Sydney”.
6/19/18: Waives right to prelim hearings & wanted to proceed Pro-Se, Judge appoints ‘stand-by’ attorneys & agrees to have lawyers; case is bound over to the District court. 8/20: Status hearing.

9/20/18 Update: Motion hearing: Saline County District Judge approved the defense's requests to hire a pathologist & forensic anthropologist to review the case. She also approved a request for computer access so Trail can review the files. One of Trail's court-appointed attorneys had asked for TV or radio access for their client but withdrew the motion after he was granted computer access. The computer won't have access to the Internet. Bound over for trial. Jury selection to begin 6/17/19. No further hearing dates given.
9/28/18 Update: Hearings on 12/5 & 12/12. 10/24/18: Hearing on 11/7, Status hearing on 12/5 & 12/12, trial will begin 6/17/19 thru 7/5/19.

4/3/18: Aubrey Trail agrees to plead guilty to one of the 14 counts Federal fraud case ($400K gold scam), each of which is punishable by up to 10 years in prison or a $250,000 fine; sentencing date is August 3rd.
7/3/18 Update: Trail tries to withdraw his guilty plea in fraud case, cites state of mind, coercion. U.S. District Judge John Gerrard will consider Trail's request at sentencing in August. At his sentencing, Trail would face up to 10 years in federal prison, $250,000 in fines and hundreds of thousands of dollars in restitution. 8/3/18 Update: Sentenced to 10 years in prison for gold scam.

*Bailey M. Boswell (23) charged & indicted (6/11/18) & arraigned (8/6/18) with 1st degree murder & improper disposal of human remains & charged (3/1/19) with conspiracy to commit murder. Plead not guilty. No bond. DA will seek DP.
6/18/18 Update: Prelim hearing. 7/24: waives right to prelim hearing. 8/1: DA files motion to seek DP. 8/6: Arraignment hearing. Def. Motion filed arguing the DP. Entered no plea.

9/17/18: The court heard arguments on Monday in the case of Boswell to declare Nebraska's death penalty statutes unconstitutional in the murder of Lincoln store clerk Sydney Loofe. State prosecutors said they plan to seek the death penalty for Boswell on Aug. 1, citing the slaying's "exceptional depravity". The state will have until Oct. 1 to file a written response to the motion, and Boswell's defense will have one week after that to respond.
11/20/18 Update: Judge Vicky Johnson has rejected a death penalty challenge from the defense. Judge said in a ruling issued Tuesday that Boswell's challenge was premature, because Boswell has not yet been convicted nor has her case been deemed eligible for the death penalty. Next Plea hearing on 12/17. Was in court on 11/29/18 & plead not guilty to all charges.
12/17/18 Update: Next Pretrial hearing on 1/28/19. 1/28/19: Next Pretrial hearing on 2/6. 2/6/19: Next Status hearing on 4/3.

5/4/18: Boswell pleads guilty in Federal fraud case ($400K gold scam); in exchange for her plea Judge will dismiss the remaining 13 counts. Boswell faces up to 10 years in federal prison and a $250K fine at her sentencing on Aug. 3rd. 8/3/18 Update: Sentenced to 5 years in prison for gold scam.
 
New charge filed against Aubrey Trail as trial for Sydney Loofe's accused killer nears


SALINE COUNTY, Neb. — Prosecutors have succeeded in an effort to add a new charge against the man accused of murdering Neligh native Sydney Loofe in 2017.

Aubrey Trail is now charged with conspiracy to commit murder, along with charges of 1st degree murder and improper disposal of human remains.

He has pleaded not guilty to all charges.
[.....]
So far, prosecutors have not added a conspiracy charge against her.

A date for her trial has not yet been set.

Boswell’s trial is set for Oct. 15 through Nov. 1 in Wilber. The state has said they will seek the death penalty against Boswell.

Trail is scheduled to go to trial June 17.

Loofe’s remains were found on Dec. 4 and 5, scattered across a rural area near Edgar, Nebraska, in plastic bags.

Nebraska last carried out an execution on August 14, 2018, so maybe it'll happen some day for Trail and /or Boswell. I think they have reason to worry. MOO.

Court documents filed Tuesday show Aubrey Trail, 52, says the death qualification of the jury "violates his rights under the Fifth, Sixth, Eighth and Fourteenth Amendments to the United States Constitution, and Sections 3, 6, 9, 11, and 15 of Article I of the Constitution of the State of Nebraska."

WILBER -- Before prosecutors charged him with Sydney Loofe's murder, Aubrey Trail told investigators, the attorney defending him against federal fraud charges was "screaming from the rooftops" for him to stop talking.

But Trail kept talking and Lincoln police investigators and FBI agents kept meeting with him as they searched for Loofe's body, and after, in an effort to find out what happened to her.

At a two-hour hearing in Saline County on Wednesday, Ben Murray, one of Trail's court-appointed attorneys, argued the statements he made to them shouldn't be allowed to go before the jury at his murder trial in June.

But what exactly Trail told them wasn't at issue at Wednesday's hearing.

Catching up on this article and somewhat taken aback that the FBI gave these two over $1000 each that was apparently on them when apprehended. Weren't they accused of stealing from various people/bad checks/forgery, etc.? Yeesh.

Ben Murray, one of Trail's court-appointed attorneys, argued the statements he made to them shouldn't be allowed to go before the jury at his murder trial in June...

Murray also argued that Trail's statements were made in exchange for promises of money, his medication and a move from a jail in Missouri, where he was arrested, to Wilber, all of which were delivered.

"I think a lot of that is just him trading stories for what ended up being a substantial amount of money," he said.

Murray said an FBI agent gave Trail and his co-defendant, Bailey Boswell, each over $1,000 to be put on their books at the jail.

"So it was their money that was returned to them?" Saline County District Judge Vicki Johnson jumped in to clarify.

Murray said the money had been in the hotel room when they were arrested.

Then he circled back, arguing that none of Trail's statements should be admissible because at all points he had an attorney who wasn't there.
