CHARLOTTE, Tenn. -- The murder trial for Joseph Daniels and wife Krystal Daniels was delayed Friday due to attorneys still waiting for final DNA evidence test results.

District Attorney Ray Crouch requested a continuance for the trial, which was scheduled to start next month, and the defense attorneys agreed.

Jury selection is now scheduled to begin Feb. 3, 2020. A trial date has not yet been made public. The jury will be chosen from outside Dickson County.

And, who knows, with another year until trial, it's possible that Joe Clyde's remains could still be found. That would certainly help make the prosecution's case.

"The state needs to give the jury a theory of the entire case. He killed the child and this is how he disposed of the child," said Todd.

The twelve-month delay of the trial leaves the window open for more things to develop, potentially more evidence to surface.

I'm eagerly awaiting the DNA results, especially on the blood found on his pants and in the truck.

I have a hunch that between now and February 2020 one of the parents will turn on the other. IMO with a no-body case and few forensic results Krystal is biding her time to see what happens with Joseph's charges.

IOW, if the DA can't come up with enough evidence for murder charges for Joseph then Krystal has a strong argument to get her charge of neglect lowered in order to make a plea deal. But if the DNA results come back as Joe Clyde's blood or other evidence pops up then she may turn on Joseph in exchange for a lesser charge.

I dunno, that's just my opinion for now. I wish both parents would come clean and tell the truth. If one or both did murder Joe Clyde (and that's where I lean) then it's crappy that they're okay leaving his poor body alone in some desolate place. Great parents, huh? MOO.

I get the difficulty of not having a sample of Joe Clyde's DNA - if in fact this is the case - but it seems like there may be options that might sway the judge to allow the blood analysis into evidence.

For example, LE can obtain Joe Clyde's brother's DNA so why couldn't they eliminate his, Joseph's and Krystal's from the blood, leaving what is extremely likely to be Joe Clyde's DNA? It's not 100% proof but a full-sibling or parent/child match are predictable enough to conclude it's Joe Clyde's. For that matter wouldn't a personal item such as a shoe be a source for a sample?

DNA analysis has come a long way since OJ's trial. LE has used close matches in the database to track down a sibling, parent or child of a known felon. MOO.

And who are the "sources" quoted in the article anyway? Certainly not Sheriff Bledsoe.

That doesn't make any sense. They have his biological parents and his biological siblings for comparison and exclusion. They can determine it is his DNA the same way they could identify his body by DNA if it was found tomorrow. DNA tests will show if the blood found is from a child of Joseph and Krystal Daniels and they can also compare to his siblings to show it is their brother's DNA and a profile unique to them. Sure, it's a extra step to explain how they determined it was his DNA, but it's no less reliable than if they had his actual DNA for comparison. MOO.
 
Judge denies Joseph Daniels' request to be moved to another facility


DICKSON, Tenn. (WTVF) — A judge has denied Joseph Daniels' request to be moved to another facility.

Joe Clyde Daniels’ father appeared in Dickson County court Thursday where his attorney again asked for him to be moved from Riverbend Maximum Security prison to a special needs facility.

Defense attorney Jake Lockert said his client has lost more than 50 pounds and suffers from a psychological condition that requires special care. Lockert asked once before for Daniels to be moved but the request was also denied.
 
Can it get any more demeaning? I hope these two are both locked away for the rest of their lives and that Joe Clyde died quickly (though my mind tells me he didn’t my heart wants it that way). What heathen monsters live in our world
 
March 2020? Seriously?? Is that normal?
Believe it or not, it's not unusual for cases to drag on for years. Defense lawyers make motions that have to be addressed, discovery can consist of hundreds of files and needs to be shared by defense and prosecution, mental evaluations are ordered in some cases and on and on. There's one case dear to many of us that has had many twists and turns - since 2014!

In Joe Clyde's case I think prosecution is okay with the delays since it's possible his body will be found before trial, which would go a long way to proving their case. But it gets frustrating.
 
Candle Light Vigil For Joe Clyde Daniels To Be Held

Dickson, TN- Texas Equusearch Ohio/midwest chapter has announced they will be holding a candle light vigil for Joe Clyde Daniels on April 4th at 7pm at Friendship Baptist Church in Dickson.

The date marks the one year anniversary that the Tennessee City, 5-year-old was reported missing.

The childs father has been charged with murdering the 5-year-old. The childs mother has been charged with child abuse charges. Their trial is scheduled for February of 2020.

The missing 5-year-olds remains have yet to be recovered.

The event will be held rain or shine.

*Trial was set to begin for both-delayed (@ 9am ET) – TN – Joseph “Joe Clyde” Daniels III (5) (April 3, 2018, Dickson) – *Joseph Ray Daniels (28) “father” arrested & charged (4/7/18) & indicted (6/8/18) with 1 count of 1st degree murder, felony murder, aggravated child abuse, filing a false report & tampering with evidence. $1M bond.
Confessed on 4/6/18. Waived rights to Prelim hearing. Joseph Daniels told officers that he beat his son to death after his son urinated on the floor.
6/4/18 Update: JRD charge will stay. His case is bound over to the grand jury. Waived right to preliminary hearing. 6/8/18: Thursday, 6/7/18 indicted by a Special Called Session of the Dickson County Grand Jury. Friday, 6/8 arraignment for Joseph was indicted on 5 counts of first degree murder, felony murder, aggravated child abuse, filing a false report & tampering with evidence. Judge Wolfe asked District Attorney Ray Crouch if he was seeking the death penalty for either Joseph or Krystal. Crouch said his office was not seeking the death penalty — but kept open the possibility.
6/19/18 Update: JRD will undergo first mental evaluation. Will be back in court in August (no specific date given) & tentative trial is August, 2019. 8/20/18: JRD will be transferred from prison to the Middle Tennessee Health Institute in Nashville for a new competency evaluation. The trial is still tentatively scheduled for next March (19th), and hearings on the case can continue between now and then, but no trial until the competency issue is resolved. 10/23/18: Daniels had been in Middle Tennessee Mental Health Institute in Nashville for evaluation until last week, when he was returned to Riverbend Maximum Security Institution, also in Nashville. 10/29/18: Defense files motion for change of venue.
11/2/18 Update: The public defender for Daniels plans to file two motions this week to change venue for trial & move him back to the Dickson County Jail. He also plans to have his client's confessions thrown out, which is has been a big evidence for prosecutors. Motions hearing planned for later this month (November). 11/27/18: JRD & KD appeared in court on 11/27. Change of venue requested-granted. Jurors will be brought in from a different county, but will be tried in Dickson County. Joe Daniels requested to be transferred from Riverbend Max to Dickson County jail-requested denied.
2/1/19 Update: Both at hearing. DA Ray Crouch requested a continuance for the trial, which was scheduled to start next month, & the defense attorneys agreed; due to attorneys still waiting for final DNA evidence test results. 6/4/18 Update: Charge for Krystal Daniels stands. Her case is heading to the grand jury. Her public defender did file a motion to reduce her $1M bond. Public defender fighting for judge to reduce Krystal Daniels bond to $50K instead of a million. The judge has ruled her bond amount will remain the same.
6/8/18 Update: Thursday, 6/7/18 indicted by a Special Called Session of the Dickson County Grand Jury. Friday, 6/8 arraignment for Krystal was indicted on 3 counts of criminal responsibility, aggravated child neglect, and filing a false report. Judge Wolfe asked District Attorney Ray Crouch if he was seeking the death penalty for either Joseph or Krystal. Crouch said his office was not seeking the death penalty — but kept open the possibility. Tentative trial date set for March 19, 2019; Crouch said the trial would take at least a week. No update of further court dates as of 11/27.
8/6/18 Update: Krystal had a Status hearing on 8/6/18 & was appointed a new attorney after her previous one posed a potential conflict of interest. She was also granted a motion to transfer her from the Dickson County Jail to a state facility in Davidson County. 11/27/18: KD in court with JRD.
