That is my point LOL
It wasn't 19,000 + 14,480 + SUPPLIES.
No, even Chase told LE he was using Joey's CC and blank checks for supplies on projects. How could Joey "be out $14,480" if he hadn't paid for materials? What did Joey use the $14,480 for? Printer ink? New tires? Surf boards?
The materials were out of the $14, 480. Chase would NOT be paying back the $19,000 if it involved material expenditures.

Did CM even have a bank acct. at that point or had it been closed for too many NSF's? I thought JM gave him a check for a small amt., like $100-200, around that time, so the loser could open up another acct. somewhere else.

I believe CM took the $200.00 legit check from JM on 2/2 and used $100.00 of it to open a BofA acct.

MOO

I have no idea. And to answer your other question, the defense I think said they had 44 on their witness list, they didn't plan on calling all of them but those were their potential witnesses as of about a week or 2 weeks ago when it was mentioned. Again, I believe a lot of the delay right now is because juror's had appointments, and lawyers had other court commitments. That was from Cathy Russon I think and I believe it was mentioned in court.
Thanks, Missy. I couldn't figure out how and why this went down.

I know some of Merritt’s withdrawals were an exhibit, but were we able to see what his bank balance might have been during that first week of February? Since the DA is intimating the motive was money, if CM had substantial money in the bank, you would think his defense would point that out over and over again. It would be an interesting piece of the puzzle to get a glimpse of what his balance actually was around then.

RSBM BBM

I don't think CM EVER had a substantial amount of money in the bank. lol

The 14K was a chargeback on Paypal, it has nothing to do with supplies, it was the 50% deposit on the fountain that the company paid before the fountain was even started. Months later, it was charged back and it came out of Joey's PayPal account if I understand it correctly (sucked out of his account).

So it was 19K + 14,480= 33,480 ... he actually says he "lost $33,800"

no problem! If I heard correctly... even Michael McStay was not available until the 27th or 28th, and although he will be considered their witness, I imagine he would like to get this over with as well. JMO They are also already scheduled to be off on April 1 and 2nd I believe, again for appts or other court commitments

So.......let's add the $2,900 to the $19,000 because, hey, we're talking Chase Merritt and honesty is NOT his forte. I don't believe for one second that THAT zebra changed his stripes.
I can't believe ANYONE would think he is nothing more than a liar and a cheat. Seriously, look at his track record before and after his association with Joey.
Does that automatically make him a murderer? No.
But, does his lies make him pre-disposed to murder if the possibility of jail or prison threatens his freedom? I certainly believe so.
Ironically, there was no better time for him to change his stripes! They were on the cusp of making it big. CJ testified to that dinner with Joey. They were all going to take a vacation. The two families celebrating together.

So what do you think the funds from the $14k deposit went to?

I may be a little off topic from what's being discussed...but this case really reminds me of the Scott Peterson/Laci Peterson case. Laci & Conner's bodies washed up right where Scott went "fishing." The McStay bodies were found buried right where Chase Merritt's phone pinged. You can't have a better "smoking gun" than that. That's the main reason I'm convinced of his guilt. 100%

BBM. Honestly, I just don't think that the phone pings near the graves are that big of a deal. Sometimes, when I'm stressed out, I like to take a nice long drive to clear my head. I can totally see Chase, after a long exhausting week at work, just wanting to take a drive in the desert to relax. Maybe while playing some country music, with the window rolled down, wind blowing through his hair. A cold drink to sip on. I mean, there's no way to prove that if he did drive in the vicinity of the graves, that it had anything to do with the murders. We don't even know exactly what day the family was killed, or what day they were buried for that matter! IMO.

So what do you think the funds from the $14k deposit went to?

It is probably part of the 19K that went to Chase. Because otherwise joey would be out another 14K LOL It's pretty simple math IMO

Does anyone here truly believe that Chase go 65% of the cost of the fountain and didn't have to pay for the supplies, whether it was Joey fronting the cost or not? So Joey made 35% minus the cost of making the fountain? That would be a ridiculous business model, Joey was naive IMO but not that naive.

Merritt did open a new account with $100 that first week of February, but do we know it was because his other one was closed or overdrawn? I don’t think that was part of any testimony. I may be wrong, but I sure don’t remember it.

What were they using to show all the casino withdrawals? That had to be a bank statement of some sort, no?

I wish my memory was better on when but there was testimony about CM's bank accounts, Rodriguez showed charts with the looping line of his balances. The account before the one he opened in Feb. was closed because of NSF, I think the Union one was also. Wish I could tell you when that testimony was, it seems like years ago with all these delays.

So you're saying that none of the original $14,480 was paid out for materials? Okay....it doesn't make sense in a business sort of way. Usually deposits are used for material expenses and labor but maybe Joey used a different type of business model?
I know I never used that type of reasoning in any business I ran, nor my husband, but maybe Joey wasn't that "business savvy".

Chase told LE in his interview he wasn't there that day or any other day.

First you have to believe anything that Chase says. That's the first hurdle.
I can't get past that one. JMO.

Do you recall if there were many objections by the state or not?
And who else do you think they will bring the topic up with? DK? But i don't think DK was involved with Prevecho was he?
No, DK wasn't involved with the custom fountains. Perhaps financial or legal experts to attest to the Provecho bankruptcy and clarify the figures that are listed.
