Opening statements will now kick off on April 29 instead of March 18, after multiple cult members, including heiress Clare Bronfman, have claimed they don’t want to stand trial next to accused sex traffickers Keith Rainiere and Allison Mack.

Bronfman, Lauren Salzman, her mother Nancy Salzman, and Kathy Russell are variously charged with forced labor conspiracy, wire fraud conspiracy, and racketeering — but not sex trafficking.

Mack allegedly headed a secret master-slave group within Nxivm, called “DOS,” in which women were branded with her and Raniere’s initials and forced to submit entirely to their assigned masters. At least one of the slaves had sex with Raniere, prosecutors charge.

“Smallville” actress Allison Mack along with two other defendants swept up in the alleged sex trafficking conspiracy by the self-help group, that many call a cult, NXIVM may avoid their respective trials next month thanks to a plea deal.

It was revealed in court that Mack and the others are in “active plea negotiations” as a fourth defendant, NXIVM co-founder and alleged ringleader of the cult, Keith Raniere, appeared in court to plead not guilty to child *advertiser censored* charges related to the case.

Mack is best known for her long-running role on the superhero TV show about the early days of Clark Kent’s life. However, it was previously reportedthat she was heavily involved in the NXIVM organization. Mack allegedly got involved with the organization when she was unhappy with her acting career. She reportedly rose in the ranks to become a key player in its activities, which allegedly included branding its members and finding sex slaves for Raniere.

Mack is currently on pretrial house arrest at her parent’s home in Los Alamitos, Calif., on a $5 million bond. However, next month she’s expected to travel to New York to stand trial, unless she’s able to make a plea deal.

Additionally, defense attorney Mark Geragos said that his client, Seagram liquor fortune heiress Clare Bronfman, will be asking for a separate trial on charges she bank-rolled the Albany-based group that has been compared to a cult. Bronfman and Mack have previously denied the charges.

“We don't need to be the collateral damage," Geragos said.

Accused Nxivm sex slaver Allison Mack wants to go to work, school and church

“Smallville” star Allison Mack is begging a judge to separate her case from accused Nxivm sex cult leader Keith Raniere’s — in the wake of fresh allegations that he abused children.

Mack’s team of lawyers made the request Friday in a filing that also seeks to have tossed out a superseding indictment against her, Raniere and their co-defendants.

“The Court should not allow evidence of Child Exploitation Acts before any jury that will judge Ms. Mack. As an initial matter, any evidence of the alleged Child Exploitation Acts would highly and unfairly prejudice Ms. Mack, who has no connection whatsoever to these new predicate acts or the substantive counts against Raniere,” the filing said. “Given the well-recognized inflammatory effect of such allegations, the Court should sever Ms. Mack from Raniere and order a separate trial.”

Prosecutors allege that Raniere, 58, had sexual relationships with children and made kiddie *advertiser censored* — and that Mack and her co-defendants Seagram heiress Clare Bronfman, Lauren Salzman and Kathy Russell “facilitated” the illicit affairs.

Mack, 36, was slapped with an additional racketeering charge — but her lawyers downplayed the new indictment as “barely changed” from the initial one but acknowledged that it added “disturbing allegations” against Raniere.

The one-time “Smallville” actress is charged with being Raniere’s right-hand woman, luring young women to the alleged cult as sex slaves.

Opening arguments in the trial are set for April 29.

Kristoff St. John may have died with a will after all.

Paris St. John, the older daughter of the late “Young and the Restless” star, recently petitioned the court for control of her father’s estate after it appeared he passed away without a will. But now Kristoff’s father has come forward and submitted a will that appears to have been handwritten by Kristoff fewer than two years before he died, according to The Blast.

According to the will filed by Kristoff’s father, Christopher St. John, the late soap star wrote, “In the event of my untimely death,” and indicated he wanted his personal savings and money to be shared between his two daughters, Lola and Paris. The finances would be split 75 percent and 25 percent, respectively.

The letter also claims there was a $100,000 check given to Kristoff’s father for Lola, and the actor noted, “He must give money for Lola immediately.”

Kristoff wanted Lola, his younger daughter, to be able to access portions of her money on her 16th, 18th and 21st birthdays. He requested Paris receive a lump sum.

Dated Aug. 12, 2017, the will also requests Kristoff’s father be the executor of his estate.

Christopher has filed Kristoff’s handwritten note with the court and requested power over his estate starting immediately. The document still needs to be vetted by the courts and officially entered into the star’s probate case before anything official is decided.

Kristoff was found dead at his home on Feb. 4. He was 52.

His death was declared an accident on his autopsy report, obtained by Page Six, and stated that he suffered from a history of alcohol use, bipolar disorder and suicidal ideations. The Los Angeles County Coroner confirmed to us that he died of hypertrophic heart disease. Other “significant conditions” were the effects of ethanol and myocardial bridging of the left anterior descending coronary artery.

    1. Geragos says this is true, but he doesn’t know if Avenatti intended to file a notice of appearance in this case “because of the other case.” They don’t say on the record if that’s Avenatti’s SDNY case, or one of Bronfman’s pending civil suits.

He also decided that they would be “partially sequestered,” meaning they will be taken to and from the courthouse by U.S. Marshals and required to stay inside during trial days. It’s rare for this to happen, considering these kinds of measures are typically used for defendants like Mexican drug lord Joaquín “El Chapo” Guzmán.

Garaufis admitted that “there is no actual danger to the jury,” but he didn’t like the “possibility” that a journalist or member of the public could approach a juror posttrial......."

John Marzulli, Public Information Officer for the U.S. Attorney's Office for the Eastern District of New York confirmed Mack's plea, which was entered Monday.
As part of her guilty plea, Mack admitted to state law extortion and forced labor.
Attorneys for Mack did not immediately respond to a request for comment.

Mack admitted to receiving “labor and services” from two alleged female slaves she oversaw on Raniere’s behalf. Additionally, Mack admitted to engaging in a conspiracy to commit the above federal crime. What she didn’t plead guilty to were the sex trafficking and sex trafficking conspiracy charges in the indictment. This could loom large when it comes to the length of her prison stint.

So, how long does Mack face in prison?

Codified at 18 U.S.C. §1962(a), the law on point here reads, in relevant part:

Each of the two counts to which she pleaded guilty on Monday carries a maximum sentence of up to 20 years in prison. But a maximum sentence of 40 years isn’t likely in a high profile case like this–especially not with a deep-pocketed defendant like Mack.

Trial lawyer Page Pate told Law&Crime that it looks like Mack has gotten a “very good deal” if there was clear evidence to support the sex trafficking charges that were alleged in the indictment.

“RICO sentencing guidelines are also mostly based on the amount of money involved in the case whereas the sex trafficking guidelines have numerous and often draconian enhancements,” Pate explained. “The bottom line is this is a very good deal for her if there was sufficient evidence to support the sex trafficking charges. Perhaps there wasn’t, and that’s why she was allowed to plea to the lesser charges.”

Law&Crime Network host and former New Jersey prosecutor Bob Bianchi also provided some clarity on the situation. Bianchi explained that “there are a lot of variables at play with this sentencing” and noted the mandatory maximum was only technically a possibility.

“She will get a downward departure for ‘acceptance of responsibility’ and is presumably a first offender, low offender category,” Bianchi noted. “She may be cooperating with the [prosecution] which could also lower her sentence.”

But Bianchi said there also factors which definitely don’t bode well for Mack:

When the judge evaluates the “relevant conduct” of this case they will see the sex offenses as an upward departure, even though she did not plea specifically to the sex crimes. The upward relevant conduct is not good for her. Many victims, serious harm, extortive conduct, and length of time conduct was occurring all inure to her detriment.

“As a defense attorney, I would be very concerned of a lengthy sentence given the seriousness of the harm caused, and her role in victimizing these women,” Bianchi added.

There may, however, be a way for Mack to downplay her own admitted role in the alleged sexual slavery scheme.

“The defense will undoubtedly attempt to off set the above by stating that in a sense she was a victim too–brainwashed to a point she didn’t know what she was doing was wrong, or appreciate the seriousness of the harm she was doing,” Bianchi said. “Depending on facts of the case, that may, or may not, mitigate her punishment.”

Ultimately, of course, it’s up to the court.

“The judge will balance all of these, and many other relevant conduct factors, to give a sentence they feel is appropriate,” Bianchi concluded.

Mack’s sentencing hearing is scheduled for Sept. 11, 2019.
