SAN ANTONIO — Almost exactly three months after San Antonio authorities began searching for an 8-month-old baby boy who his father claimed to have been kidnapped at a gas station, that father – along with two others – is facing several charges after being indicted by a Bexar County grand jury on Wednesday, the latest development in what has become a case with many pivots.

In just a matter of days, the search for baby King Jay Davila eventually turned into an investigation in which police alleged Christopher Davila and others staged his kidnapping to cover up his death. The infant's body was found in a black backpack and buried in a field six days after his reported disappearance.

King Jay's death has since struck a chord with San Antonians. Memorials have been organized in remembrance of him, and some have used their talents to ensure that he isn't forgotten.

According to the district attorney's office, the indictment alleges Davila either struck his baby with an object or struck him against an object on Jan. 3 and “failed to seek medical treatment,” resulting in King Jay’s death, before “intentionally concealing” the body while police were searching for him. Davila is the one who eventually led authorities to where King Jay was buried.

He faces charges of injury to a child causing serious bodily injury, tampering with evidence, felon in possession of a firearm and possession of a controlled substance. All are felonies, and his potential punishment – if Davila is convicted of any individual charge or combination of them – ranges from two years to life in prison.

So happy with all these GJ indictments and it looks like they won't be wasting a lot of time getting them to trial. YAY!
 
PALESTINE — The man accused in the death of King Jay Davila, the infant whose purported disappearance launched search parties into action, may not be the father of the boy after all.

Martin Gonzales III, an inmate at a Northeast Texas prison, said he is the father of the 8-month-old boy. He was shocked to learn King Jay had died in January and that his estranged wife’s fiancé, Christopher Davila, claims to be King Jay’s father and had a hand in his death.

April 16:Christopher Davila signs papers acknowledging that King Jay is his child although his lawyer now says he is not the father. The notary stamp on the document belongs to Harry D. Abelow, who died in May 2017.

So the question is: Did Mom know that he was not the father when he signed the faked paperwork? This gets worse all the time.
 
Bail reduction denied.
Earlier in the hearing, Gonzales told a judge that her family does not have the money needed to pay a portion of the $1.25 million bail set by a judge in January.

Bob Behrens, Davila’s lawyer, said Davila’s family would have to come up with $125,000 if they were to pay the standard 10 percent that is charged by a bondsman. He said that amount is excessive, especially considering that Davila is not a flight risk.
Earlier this month, a Bexar County grand jury indicted Davila on five different charges, including injury to a child, a first-degree felony punishable up to life in prison.

Since he was arrested, Davila has maintained that King died after the car seat holding the boy fell off a bed. He says he did not call 911 because he panicked.
In an interview... from prison, Martin Gonzales says he knows King Jay is his "blood." He said he was shocked to learn that Jasmine filed for divorce and wanted to declare Davila King Jay's father. He said he doesn't remember signing any papers. The docs were notarized by someone who had died a year earlier.

Davila is facing multiple crimes which could land him in prison for 2 to 20 years. And he's not yet been charged with murder. He's in deep doo doo.

So far mom is not charged with anything but I'm keeping an eye out as it seems to me she broke some sort of law by apparently forging the divorce documents.

You can search for Davila's records here. His middle name is S (Sampayo) but not all his cases include it so I started with the January 2019 cases. They don't list DOB but I think it's 04/20/1984. Also, take a look further down the list and you'll see some info regarding paternity and child support issues. Just be careful as there are other Davilas not connected to the case.

Tried to stage a fake kidnapping. Police Chief William McManus said Davila was pressured by the evidence against him & ultimately confessed to burying his son in an open field. Investigators later found the burial site near Davila's Northeast Side home & recovered the baby's body on 1/10/19.

Torres, was arrested after she allegedly attempted to shoplift a pack of razors from a Dollar General store, then attacked an employee who confronted her about the theft. In the process of investigating the robbery, police identified Torres, 45, as the woman from the surveillance video stealing the car. Confessed to crime.
2/9/19 Update: Tampering pretrial hearings on 2/19 & 2/28; robbery pretrial hearings on 2/26, 2/28 & 3/6. 3/6/19: Ask for bond reduction. Awaiting indictment. 4/4/19 Indicted on tampering with evidence. Arraigned on 4/5. Plead not guilty. Next Set Trial Date hearing on 6/3.

Beatrice had been the one who drove Torres to the gas station so that she could pretend to abduct King Jay & dispose of the car seat. Torres told authorities that Beatrice Davila had disclosed to her that King Jay had been severely injured by the baby’s father. Both women now face charges of tampering with evidence.

Sampayo's defense attorney says she is suffering from cancer and needs treatment unavailable to her in the Bexar County Jail, where she is currently being held. The judge approved Sampayo's bail reduction from $250,000 to $50,000. She will now have to pay only $5,000 to be released from custody on a condition of drug and alcohol testing. Released (2/10/19) with ankle monitor. Next pretrial hearings on 2/13 & 3/6. Awaiting indictment.

"After having been granted a judge’s order, Child Protective Services removed four boys—ranging in age from 2 to 8-years-old—from the grandparents’ home today," said Walker. "A newborn was removed on Friday, May 10th. The four boys are brothers of King Jay Davila, however, there are no additional ties to his particular case. A bilingual CPS worker whose first language is Spanish was specifically sent with the assigned caseworker to translate and to answer any questions from the grandparents. Please note that CPS removes children when there is a genuine and strong belief that children may be at imminent risk. A show cause hearing will be held within 14 days to determine if the children will remain in CPS care."

I wonder if the grandparents were legal guardians of the children or did the mother just plop them on them after they were born?

If I recall correctly, this couple (Justine and Christopher) were using the paternal grandparents for daycare right up until King Jay reported abducted.

The paternal grandmother was also indicted with the phony abduction story and went to jail so there went the free babysitter.

I don't think these kids have a chance as long as the family enablers have custody. MOO
 
I'm really not sure if the grandparents had legal custody of these children. The baby that was just born was also taken into custody. The baby would have probably been plopped into the care of the grandparents so mom could just move on and have another baby.

According to a family friend, the grandparents are the parents of baby King Jay's mother—and took in two boys a few months ago.

This came after Christopher Davila led detectives to the infant's body in January after Davila reported him missing. Investigators later learned Davila staged a kidnapping to cover up the infant’s death.

Monday night, King’s Angels, a non-profit formed in memory of baby King, released the following statement:

Today, the grandchildren of King Jay’s grandparents; his siblings, were removed the grandparents home. We believe this was a poor choice on CPS as we have taken every step to ensure they are adequate caregivers of these children. We have worked side by side with these grandparents and watched them grow and blossom as they lovingly cared for all four boys. We helped to reconstruct their home to make more room for the children, and were even preparing to build a trampoline for them. We watch these grandparents every single day- do everything in their power to love and provide for these children. CPS just ripped away children from a loving home and CPS is failing our children. We are asking that you remember the photos of them standing by our side screaming for JUSTICE at the courthouse for King Jay. We ask that you pray that CPS does the right thing and let God guide these children back to where they are loved. Please understand that the state makes mistakes sometimes and we firmly believe this is one of them and the only ones suffering are King’s Siblings- who were ripped from their grandparents arms today in front of police and strangers- with no reasoning, paperwork, and no Spanish translators to help them understand what was happening.

I wonder if it's true that there was no reason give and no interpreter. The article at the bottom claims there was one. But I've seen enough to know people lie and CPS fails. I'm not sure what to think. I'm sure the kids don't need any more trauma unless it's necessary.
