4/2/19 Update: At least 640 prospective jurors will be available for vetting during the jury selection process. The prosecution and defense will each have 20 opportunities to remove a juror without giving a reason. Jury selection should take several weeks. Jury selection continues tomorrow, 4/3.
 
In the run-up to trial, defense attorneys for the two men charged in the deadly Ghost Ship fire cultivated a public defense strategy around one central argument: Their clients were scapegoats in the warehouse inferno that killed 36 people because Oakland officials were negligent in enforcing the city’s fire code.

The centerpiece to the defense’s strategy will likely be presented to a jury as well, after presiding Judge Trina Thompson on Tuesday — the first official day of the long-awaited Ghost Ship criminal trial — said she’d allow “cover-up” arguments, with some limitations.

Jury selection is scheduled to begin April 8, with opening statements following on April 30.

Witness testimony is scheduled to begin May 6.

Sue Slocum, mother of 32-year-old victim Donna Kellogg, on Monday said she was bracing herself for excruciating testimony. But in the coming weeks Slocum planned to make the two-hour drive from Salinas to Oakland as often as possible, and to book hotel rooms.

“I have to put myself into what happened to her,” she said. “I have to know.”

She wants to know where her daughter’s body was located, and why people on the second floor couldn’t get down. And she wants to know if one troubling witness account is true — that there was someone at the bottom of the stairs telling people not to come down.

“I will not say closure, it’s never about closure,” she said. “There were so many series of errors along the way. And when the trial starts, we’re going to be able to hear all that.

Attorneys in Ghost Ship case discuss Almena, Harris relationship

The lawyers in the case argued over a motion by Almena's lawyer Tony Serra seeking to bar prosecutors from mentioning a New York Times article in which Harris was quoted as saying that Almena "pretended, as a joke, that he was Hitler and I was his Jewish slave."

But Alameda County prosecutor Casey Bates said the quote "shows the relative positions of power" of Almena and Harris at the warehouse.

Bates said he thinks the comment shows that, "Mr. Almena is asserting his dominance and control."

Alameda County Superior Court Judge Trina Thompson said she thinks Harris' quote "is fair game if he takes the witness stand" and testifies.

"That's the risk you take when you voluntarily speak to the press," the judge said.

Thompson said she will read the New York Times article, reflect on the issue and "make an informed decision" on the matter in the near future.

The attorneys in the case were set to discuss additional evidentiary issues later Wednesday as well as on Thursday and next week.

Jury selection is scheduled to begin on April 16 and opening statements are scheduled for April 30 and May 1.

4/2/19 Update: Motions hearing was on what witness evidence will be allowed in the case. Judge Thompson said she will allow some evidence to be admitted about potential negligence by the building owners & the city, but said the main focus of the trial should be on whether Almena & Harris are criminally negligent. The defense has subpoenaed Schaaf (Mayor of Oakland) to appear as a witness & Thompson scheduled a hearing for April 11 on a motion by Schaaf to quash the subpoena so she doesn’t have to testify. Thompson said she will bring in at least 320 jurors next Monday (4/8) & Tuesday (4/9) to fill out questionnaires & said the attorneys in the case will question them April 16 through 18 & April 22 through 25. She said she hopes to have 12 regular jurors & 6 alternates by that time. Thompson said the prosecution & the defense will each be allowed up to 20 peremptory challenges. Judge Thompson said tentatively scheduled opening statements for April 30 & May 1 and testimony to begin on May 6.
4/4/19 Update: The siblings, Eva & Kai Ng, each took the witness stand in a hearing to determine what evidence should be admitted during the trial. Eva & Kai Ng were subpoenaed to testify before Alameda County Superior Court Judge Trina Thompson. Their mother, warehouse co-owner Chor Ng, was not subpoenaed & didn’t appear in court, but she is on the attorneys’ witness list. It’s not clear whether she will be called during the trial; attorneys cannot answer reporters’ questions about court proceedings because they are under court order not to speak publicly about the case. Both Eva Ng & Eva Ng invoked her 5th Amendment privilege to not incriminate herself on the stand to all questions. As did Kai Ng invoke the 5th Amendment privilege to all questions. Trial continues Monday (4/8) with the first panels of 80 jurors coming in to fill out a questionnaire. Opening statements are expected to take place April 30 & May 1.

Nothing new really. Some additional info from another article:

The third owner of the warehouse is Chor Ng, the mother of Eva and Kai, but defense lawyers have said she fled to China after the fire.

After Eva and Kai Ng left the Alameda County Superior Courtroom, Trina Thompson Serra and Briggs said prosecutors should offer them “use immunity,” which would allow them to testify at the trial for Almena and Harris without having their testimony used against them.

But James said his office doesn’t want to offer the Ngs use immunity because it is still investigating the case and hasn’t ruled out the possibility that it might file criminal charges against them at a later date.
Ghost Ship Owners Refuse To Answer Key Questions At Deadly Warehouse Fire Trial

According to the article, next week pools of potential jurors will come to court to fill out questionnaires. Jury selection is set to begin on April 16 and hopefully will be complete by April 30 and May 1 when opening statements will be presented.
 
So nothing happened yesterday? Or were there prospective jurors filing out questionnaires, as they are supposed to do today also? I'm going to post this since I have it in my notes that they will be in court today - unless someone finds something else - besides the next date of April 16. And TIA!

OAKLAND (CBS SF) — The judge in the trial of Ghost Ship warehouse master tenant Derick Almena and creative director Max Harris is expected to decide on Thursday whether Oakland Mayor Libby Schaaf should be ordered to testify.

I used to be able to get into the Alameda County court site, but lately it has not letting me in. I'm hoping we hear something soon on this case! I'm surprised I'm not getting any google alerts from the Bay Area on this case?
Any locals following? Is there any news on "what is going"? TIA if you post! :)
